THE CITY OF GREELEY, COLORADO
ORDINANCE NO. 57 ,1973
AN ORDINANCE VACATING THAT PORTION OF 16TH AVENUE LYING CONTIGUOUS
TO BLOCKS 181 AND 182, AND VACATING THE ALLEY IN BLOCK 181, ALL IN
THE CITY OF GREELEY, WELD COUNTY, COLORADO.
WHEREAS, the Owner of property lying on each side of the herein-
after described portion of 16th Avenue and on Bach side of the herein-
after described alley has petitioned the City to vacate a portion of
16th Avenue and the alley, and
WHEREAS, the Greeley Planning Commission has considered the
Petition, in accordance with Sec. 22-54 of the Code of Ordinances,
City of Greeley, Colorado, and has recommended to the City Council
in favor o£ granting the Petition; -
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL 9F THE CITY
OF GREELEY, COLORADO:
Section 1. The sections of the avenue and alley described in
Section 2. of this Ordinance, being the same as referred to above,
are hereby vacated as a public street or avenue and alley and as a
public way for vehicular and pedestrian travel and the City of
Greeley hereby relinquishes all right, title, and interest in said
sections of the avenue and alley and hereby authorizes the appro-
priate city officials to execute any necessary documents to accom-
plish such relinquishment. The foregoing vacation and relinquishment
is subject, however, to a reservation and retention of an easement
or easements for all utility lines and appurtenances now installed
and located in, on, or under those sections of the avenue and alley
described in Section 2. and of an easement for drainage, if any such
drainage easement has heretofore been established.
Section 2. The areas to which this Ordinance relates are:
• That portion of 16th Avenue lying contiguous to and between Blocks
181 and 182 in the City of Greeley, Colorado and the entire alley
lying within the boundaries of the Block 181, in the City of Greeley,
Colorado.

Section 3. The City Council hereby determines and declares that
this ordinance is necessary to the immediate preservation and pro-
tection of the public health, property, and safety, and therefore this
ordinance has been enacted as an emergency ordinance pursuant to
Section 3-18 of the Greeley Charter. In support of its determination
that an emergency exists, the City Council hereby declares that passage
of this ordinance as an emergency ordinance is necessary to enable .
Weld County to proceed, in accordance with its contract, with the con-
struction of a public building to be located on or near the above-
described vacated areas. For all of the above reasons, this Ordinance
shall be effective upon its final reading, as provided in Section
3-18 of the Greeley Charter. •
PASSED AND ADOPTED, SIGNED AND APPROVED, by the affirmative vote
of two-thirds or more of the City Council membership this 18th day
of September, 1973.
