RE: APPROVE PARTIAL VACATION OF USE BY SPECIAL REVIEW PERMIT, USR-798 -
GARY AND CONNIE SANDSTEAD
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated August 19, 1987, the Board approved the request of
Gary Sandstead, for a Site Specific Development Plan and Use by Special Review Permit,
USR-798, for an Agri-Business (wood mulch operation) in the A (Agricultural) Zone District, on
the following described real estate, to-wit:
Part of the W1/2 SW1/4 of Section 6, Township 3
North, Range 66 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board has received a request from the current property owner, Gary and
Connie Sandstead, 17450 County Road 25, Platteville, Colorado 80651, to partially vacate Use by
Special Review Permit, USR-798, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of the
Department of Planning Services staff and all of the exhibits and evidence presented in this matter
and, having been fully informed, deems it advisable to approve said partial vacation, conditional
upon the following:
1. Pursuant to Section 23-2-280.6 of the Weld County Code, the applicant
shall submit a revised USR map, titled "Partial Vacation of Use by Special
Review Permit, USR-798", conforming to Section 23-2-260.D of the Weld
County Code.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Use by Special Review Permit, USR-798, be, and hereby is, partially
vacated, with the abovementioned condition, with said map to be titled and recorded as Partial
Vacation of Use by Special Review Permit, USR-798.

Subject: Partial vacation of USR-798 —Wood Mulching
Date: May 27, 2020
The Department of Planning Services received the attached letter on March 5, 2020 Gary and
Connie Sandstead that requests a partial vacation for USR-798. The applicants have submitted
a recorded exemption application to split the parcel on which the USR-798 is located. USR-798
will remain on proposed Lot B of RECX20-0008 and be removed from proposed Lot A of
RECX20-0008.
Additionally, staff is requesting that USR-798 be vacated from Lot A of Amended Recorded
Exemption AMRE-4026, the property adjacent to and south of the subject property. This
property, AMRE-4026, was created in 2005 and at that time the USR-798 should have been
vacated from the property. This is a housekeeping item for this property.
If this partial vacation is approved the applicant will need to submit a revised USR map for USR-
798 per Section 23-2-280 of the Weld County Code.
The Department of Planning Services is recommending approval of this partial vacation from
proposed Lot A of RECX20-0008 and vacated from Lot A of AMRE-4026.
Background information:
Legal Description: Lot B of Recorded Exemption RE-4026; being a part of the SW4 of
Section 6, T3N, R66W of the 6th P.M., Weld County, CO
Location: East of and adjacent to CR 25 and approximately 300 feet north of CR 36
November 20, 1987: USR-798 was approved by the BOCC on November 20, 1987, and the
USR map states, The Use by Special Review permit is for an agri-
business (wood mulch operation) as submitted in the application
materials on file in the Department of Planning Services and to the
Development Standards stated herein.

RE: APPROVE USE BY SPECIAL REVIEW FOR AN AGRI-BUSINESS, WOOD
MULCH OPERATION - GARY SANDSTEAD
WHEREAS, the Board of County Commissioners of Weld _County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 19th day of August, 1987, at the hour of 2:00 p.m.
in the Chambers of the Board for the purpose of hearing the
application of Gary Sandstead, 7615 West Ontario, Littleton,
Colorado 80123, for a Use by Special Review for an a-gri-business,
wood mulch operation, on the following described real estate,
to-wit:
Part of the W} SWi, Section 6, Township 3
North, Range 66 West of the 6th P.M. , Weld
County, Colorado
WHEREAS, said applicant was present, and
WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and, having been fully informed, finds that this
request shall he approved for the following reasons:
1. The submitted materials are in compliance with the
application requirements of Section 24.7 of the Weld
County Zoning Ordinance.
2. It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24.4.2 of the Weld County Zoning Ordinance as follows:
a. The proposed Use by Special Review is within the

and is consistent with the Weld County
Comprehensive Plan as outlined in the Urban Growth
Boundaries Goal and Policies Section. The Urban
Growth Boundary Goals Section directs the
concentration of urban development in or adjacent
to an existing municipality, as well as to maintain

those areas so that an official definition between
future urban and agricultural land uses can be
perceived.
b. Because of the location of the Use by Special
Review being approximately one mile north of
Platteville, and the Town of Platteville's
inability to annex this site because of the town's
lack of a capital improvement plan for those areas
outside the incorporated town, the municipality and
the County shall coordinate plans, policies, and
standards relating to land use, zoning regulations,
and other closely related matters affecting the
orderly development within the Urban Growth
Boundary Area. In a phone conversation with Bob K.
Thorson, Platteville Town Administrator, on July 2,
1987, Mr. Thorson indicated that the Council of
Governments in 1980 projected a future growth of
Platteville equaling 3,060 by the year 2000. This
increase in population would have the incorporated
boundaries at .5 miles from the Use, by Special
Review site. It was further stated that at this
time, Platteville is losing population and the
projection could not be considered relevant. The
proposed site is zoned Agricultural and any future
development of the surrounding area is intended to
remain agricultural in nature and regulated as
agricultural.
c. The Urban Growth Boundary Policies #1 states that
land use development proposals within an Urban
Growth Boundary shall be encouraged so long as they
conform to the desires of the municipality. The
Town of Platteville in its referral dated June 9,
1987, indicated that the proposal is consistent
with the Town's Comprehensive Plan and would not
conflict with its present or future interests. The
proposal will not cause a significant service
impact or require additional public facilities.
d. The proposed use is consistent with the intent of
the agricultural district and is provided for as a
Use by Special Review. The proposal is that of an
agri-service establishment, wood mulch operation,
to be used by the agricultural industry. The
surrounding area is zoned for agricultural uses.
It is the Board's opinion that the proposal is
compatible with the future development of the
surrounding area as permitted by the Comprehensive

Plan of the County and the Town of Platteville.
The proposed use will not interfere with the
agricultural activities or other activities related
to agriculture.
e. The proposed use is not located in an overlay
district.
f. The applicant has demonstrated a diligent effort to
conserve productive agricultural land in the
locational decision for the proposed use.
g. The Use by Special Review Development Standards
will provide adequate protection of the health,
safety and welfare of the neighborhood and County.
NOW, THEREFORE, RE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for a
Use by Special Review for an agri-business, wood mulch operation,
on the hereinabove described parcel of land be, and hereby is,
granted subject to the following conditions:
1. The Use by Special Review plat shall be amended to show
the exterior dimensions for all structures and
dimensions from other structures and lot lines.
2. Prior to beginning the Use by Special Review activity on
the property, the applicant shall submit to the
Department of Planning Services a plan approved by the
Platteville Fire Protection District showing the
following:
a. An adequate water source capable of supplying 500
gallons per minute.
b. An automatic fire sprinkler system for all
structures.
3. The attached Development Standards for the Use by
Special Review Permit being adopted and placed on the
Use by Special Review plat prior to recording the plat.
4. The Use by Special Review activity shall not occur nor
shall any building or electrical permits be issued on
the property until the Use by Special Review plat has
been delivered to the Department of Planning Services
Office and the plat is ready to be recorded in the
office of the Weld County Clerk and _Recorder.

1. The Use by Special Review permit is for an agri-business
(wood mulch operation) as submitted in the application
materials on file in the Department of Planning Services and
subject to the Development Standards stated herein.
2. Wood shavings and waste materials shall be handled, stored,
and disposed of in a manner that controls fugitive dust,
blowing debris, and other potential nuisance conditions.
3. All off-street loading and unloading and parking areas shall
be surfaced with either gravel, asphalt or concrete, and
shall be maintained to alleviate dust and to prevent drainage
problems.
4. The applicant shall provide and maintain a water source
capable of generating 500 gallons per minute for fire
protection.
5. All construction on the property shall be in accordance with
the requirements of the Weld County Building Code Ordinance.
6. The property owner or operator shall be responsible for
complying with the Design standards of Section 24.5 of the
Weld County Zoning Ordinance.
7. The property owner or operator shall be responsible for
complying with the Operation Standards of Section 24.6 of the
Weld County Zoning Ordinance.
8. Personnel from the Weld County -Health Department, Platteville
Fire Protection District, and the Weld County Department of
Planning Services shall be granted access onto the property
at any reasonable time in order to insure the activities
carried out on the property comply with the Development
Standards stated herein and all applicable Weld County
Regulations.
9. The Use by Special Review area shall be limited to the plans
shown herein and governed by the foregoing Standards and all
applicable Weld County Regulations. Any material deviations
from the plans or Standards as shown or stated shall require
the approval of an amendment of the Permit by the Weld County
Planning Commission and the Board of County Commissioners
before such changes from the plans or Standards are
permitted. Any other changes shall be filed in the office of
the Department of Planning Services.

10. The property owner or operator shall be responsible for
complying with all of the foregoing Standards. Noncompliance
with any of the foregoing Standards may be reason for
revocation of the Permit by the Board of County
Commissioners.
