MEMORANDUM TO: Diana Aungst, Planning Services 1861 FROM: Melissa J King, PE, Public Works DATE: March 6, 2020 _ Qu_NTY SUBJECT: COZ20-0002 Laramore The Weld County Department of Public Works has reviewed this proposal. Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: Parcel(s): 080319300013, 080319300014, 080319300015 The project proposes to: Change of Zone from the A(Agriculture)Zone District to the 1-2 (Medium Industrial) Zone District ACCESS: Weld County Public Works has reviewed the application materials related to access. Access for the properties is currently being provided by two permitted existing accesses on to AA Street (both permitted as AP17-00261). No new accesses are requested. Current existing proposed accesses are residential. With the proposed change of zone, the applicant shall apply for new access permits in that there will be a change of use. The access to the property shall be adequate in size to meet the requirements of the proposed zone district. Per Sec. 8-14-30, an Access Permit is required for access to Weld County maintained roadways. We strongly encourage you to discuss your access location with Public Works prior to laying out your site plan. All"preliminarily approved" accesses are subject to change during the access permitting process. Per Sec. 24-8-40, when feasible,there shall be no net increase in the number of accesses to a public road. Minimum access spacing widths are shown in Weld County Code Sec. 8-14-30. For shared, Public Works strongly recommends the property owner establish an access road maintenance agreement so future owner of the properties will be aware of their requirements for shared maintenance of the access road. This is not a requirement for the recorded exemption but is recommended to avoid property owner conflicts in the future. Please refer to Chapter 8 of the Weld County Code for more information regarding access. ROADS AND RIGHT-OF-WAY: AA Street is a paved road and is designated on the Weld County Functional Classification Map (Code Ordinance 2017-01)as a collector road,which requires 80 feet of right-of-way. The applicant shall delineate on the plat the future and existing right-of-way and the physical location of the road. If the right-of-way cannot be verified it shall be dedicated. Pursuant to the definition of setback in the Weld County Code Sec. 23-1-90, the required setback is measured from the future right-of-way line. Be aware that physical roadways may not be centered in the right-of-way. This road is maintained by Weld County. The Colorado Department of Transportation (CDOT) has completed a US 85 Planning and Environmental Linkages (PEL) Study. The objective of the US 85 PEL Study is to develop a strategic vision for US 85 between 1-76 and the Town of Nunn. Please review the US 85 PEL Study to ensure you are in compliance with the requirements. More information about this study can be accessed at: https://www.codot.gov/projects/us85pe1. Per Chapter 8, Article 13, Section 8-13-30, a Weld County Right-of-Way Use Permit is required for any project that will be occupying, constructing or excavating facilities within, and or encroaching upon, any County rights-of-way or easement. Right-of-Way Use Permit instructions and application can be found at https://www.weldgov.com/departments/public works/permits/. Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate existing utilities within the County right-of-way. IMPROVEMENTS AND ROAD MAINTENANCE AGREEMENT WITH UP-FRONT IMPROVEMENTS When internal/external street/road or highway facilities which provide access to the parcels are not adequate to meet the requirements of the proposed zone district, the applicant shall supply information which demonstrates willingness and financial capability to upgrade the internal/external street/road or highway facilities in conformance with the Transportation Plan. Public Works is requesting an Improvements Agreement or contract guaranteeing installation of improvements by the applicant made in conformance with the County policy on collateral for improvements. Improvements/Road Maintenance Agreement: An example agreement is available at: https://www.weldgov.com/UserFiles/Servers/Server 6/File/Departments/Public%20Works/DevelopmentR eview/USR-SPR-Permits%201mprovements%20Agreement%20Template.pdf. It will detail the approved haul route(s), outline the required up-front on-site/off-site improvements, designate when other on-site/off- site improvements will be triggered, and include a maintenance agreement for the haul routes. CONDITIONS OF APPROVAL: A. The applicant shall address the concerns of the Public Works Referral relating to the proposed parcels' access permits. (Department of Public Works) B. An Improvements Agreement is required for on-site/off-site improvements at this location. The Improvements Agreement shall include, but is not limited to, information which demonstrates the applicant's willingness and financial capability to upgrade the internal/external street/road or highway facilities in conformance with the Transportation Plan. (Department of Public Works) C. The plat shall be amended to delineate the following: 1. AA Street is a paved road and is designated on the Weld County Functional Classification Map (Code Ordinance 2017-01) as a collector road, which requires 80 feet of right-of-way at full buildout. The applicant shall delineate and label on the plat the future and existing right-of-way (along with the documents creating the existing right-of-way) and the physical location of the road. Show and label a 30-ft. minimum access and utility easement to provide legal access to the parcel on the plat. (Department of Public Works) DEVELOPMENT STANDARDS (NOTES ON THE PLAT) 1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant to Chapter 15, Article I and II, of the Weld County Code. (Department of Public Works) 2. Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate existing utilities within the existing County right-of-way. (Department of Public Works) 3. All access and utility easements are dedicated for the benefit of all owners of lots depicted on this plat, including owners of future lots created therefrom, regardless of lot configuration or number of users, and without limitation of the use or intensity of the use of such easements. No lot owner may install a gate or otherwise impede the use of such easements without the approval of all persons with rights of use of such easements. (Department of Public Works) 4. Access on the site shall be maintained to mitigate any impacts to the public road including damages and/or offsite tracking. (Department of Public Works) 5. Prior to the release of building permits,the applicant shall be required to submit a complete access application for a "preliminarily approved" access location as shown on this plat.
