WHEREAS, it has been determined by the Board of County
Commissioners, Weld County, Colorado, that a certain tract of land,
being the property of Carl Brunk, and more particularly described
as follows, to-wit:
A tract of land situated in the Southeast 1/4 of Section 6,
Township 2 North, Range 68 West of the 6th P. M. , Weld
County, Colorado, and more particularly described as
follows: beginning at a steel pin marking the Southwest
corner of the Southeast 1/4 of said Section 6; thence North
along the West line of the Southeast 1/4 of said Section 6
a distance of 2282. 83 feet to the true point of beginning,
thence South 81°56' East a distance of 206. 52 feet; thence
North 198. 33 feet parallel to the West line of said Southeast
1/4 of Section 6; thence North 81°56' West 206. 52 feet
more or less to the West line of said Southeast 1/4, thence
South 198. 33 feet along said West line of the Southeast 1/4
of said Section 6 to the true point of beginning,
does not come within the purview of the definition of the terms "subdivision"
and "subdivided lands" as set forth in CRS 106-2-33 (a) and (b) 1963, as
amended, and
WHEREAS, the Board of County Commissioners of the County of
Weld, State of Colorado, has studied the request of the petitioner and
studied the recommendations of the Weld County Planning Commission,
and having been fully informed, now desires to exempt this particular
division of land pursuant to its authority under CRS 106-2-33 (d), 1963,
as amended,
NOW, THEREFORE, BE IT RESOLVED, that the hereinabove
described tract of land owned by Carl Brunk be exempted from the
definition of the terms "subdivision" and "subdivided land" as provided
for in the new Weld County Subdivision Regulations at Section 2-1, A. ,
(3) adopted August 30, 1972.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 14thday of June, A. D. ,
1974.

Dear Commissioners:
We represent Carl Brunk, who purchased a tract of land
from Carl F. Vogel and Alvina L. Vogel on May 17th, 1968 under
contract for sale, and which property was deeded to him on March
29th, 1969 . We enclose a copy of this deed and also copies of deeds
granting Mr. Brunk a 30 foot easement south to Highway 119 and conveying
the northernmost portion of his tract back to the Vogels .
Mr. Brunk purchased this land with the intent of dividing
it into three parcels, one each for himself, his daughter and his
son; but at the time of conveyance, his son and duaghter were minors
and thus he did not feel he should deed their parcels to them at
that time. The tract in question was surveyed on June 30th, 1968
by Glen U. Overturf into the three tracts he desired. We enclose
a copy of the survey. It contains a legal description of the northern-
most tract which is to go to Mr. Brunk' s daughter, Sharon Vargason.
Mr. Brunk' s son, Larry Brunk, obtained a building permit
on June 6th, 1968 (Permit No. 347, Receipt No. 782) ; and he has
since built his house on the southernmost of the three surveyed
tracts . Mr. Brunk moved a house onto the middle lot about this
same time; thus leaving the northen lot as the only one vacant of
the three.
These three lots have never been divided by deed although
it has been Mr. Brunk' s intention to do so since 1968 . He desires
to carry out his original plan, which was formulated in mid 1968,
and deed the southern tract to his son, Larry and the northern tract
to his daughter, Sharon. To do so, it is necessary for us to obtain
"Recorded Exemptions" allowing him to make these transfers, and
we respectfully request that they be granted under Section 2 (A) (3)
of the Weld County Subdivision Regulations and C.R.S . 106-2-33 (3) (d)
(1963 as amended) . It also is our desire to obtain a building permit

on the northernmost lot for Mr. Brunk' s daughter, Sharon Vargason--it
being the only unimproved lot.
It should be noted that Mr. Overturf' s survey is in error
in two respects: (1) the first bearing on Sharon's parcel does
not match and should read "thence S . 81°56" E. 206 . 52 feet") ; and
(2) the right of way from Highway 119 north to the Brunk property
is 30 feet wide and not 60 feet.
The copies of the deeds submitted herewith cover all land
transfers concerning the entire tract since March 29th, 1969 . Water
is presently being supplied to the two improved lots by Left Hand
Water Supply Company of Niwot, Colorado. It is purposed that the
same water be used on the unimproved lot. Both of the improved
lots use a septic sewer system and the same would be purposed for
the unimproved lot. The acreage of each lot is approximately 1 acre.
