Staff comments made during this phase of the application process may not be all-inclusive , as other issues may arise during the remaining application process . COMMENTS GENERAL PROJECT INFORMATION/LOCATION Project description : A Site Specific Development Plan and Use by Special Review for open mining (sand , gravel , and stone) and processing of minerals , an asphalt plant, including the importing of materials associated with an asphalt batch plant, recycling of asphalt, mine office/scale house and scale, a fueling/lubricating station , portable generators , mobile mining equipment parking and storage and employee and vendor parking the A (Agricultural) Zone District This project is north of CR 54 and is east of CR 13 Colorado Boulevard Parcel number 095719400002 , 095719300061 . Access is from CR 13 . ACCESS Weld County Public Works has reviewed the application materials related to access . The applicant has proposed one access on to County Road 13 (Colorado Boulevard ) approximately 603 feet north of the intersection of County Road 13 and County Road 54. The applicant currently has a permitted access (APOG20-0037) at this location . This access on to County Road 13 crosses parcel 095719300060 owned by Weld County. No access was requested for the portion of the parcel (095719400002) east of the Big Thompson River that is not accessible from the existing permitted access on to County Road 13 . Applicant shall review this portion of the parcel and request access on to County Road 54 that meets minimum spacing as specified in Table 1 below and provides safe horizontal and vertical sight distances per Weld County Engineering and Construction Criteria Chapter 6. 5. ACCESS Sec. 8- 14-30 . Per Sec. 8- 14-30 B . Any person . . . changing the use of any existing access . . . must first be issued an Access Permit . . . . We strongly encourage you to discuss your access with Public Works prior to laying out your site plan to ensure the approved accesses are compatible with your layout. Per Sec. 24-8-40, when feasible, there shall be no net increase in the number of accesses to a public road . Minimum access spacing are shown in Weld County Code, Sec. 8- 14-30 Table 1 . Please refer to Chapter 8 of the Weld County Code for more information regarding access . ROADS AND RIGHTS -OF -WAY Colorado Boulevard County Road 13 is a paved road and is designated on the Weld County Functional Classification Map (Code Ordinance 2017-01 ) as an arterial road , which requires 140 feet of right-of-way. The applicant shall delineate and label on the site map or plat the future and existing right-of-way (along with the documents creating the existing right-of-way) and the physical location of the road . If the right-of- way cannot be verified it shall be dedicated . Pursuant to the definition of setback in the Weld County Code, Sec. 23- 1 - 90, the required setback is measured from the future right-of-way line . Be aware that physical roadways may not be centered in the right-of-way. This road is maintained by Weld County. County Road 54 is a paved road and is designated on the Weld County Functional Classification Map (Code Ordinance 2017-01 ) as an arterial road , which requires 140 feet of right-of-way. The applicant shall delineate and label on the site map or plat the future and existing right-of-way (along with the documents creating the existing right-of-way) and the physical location of the road . B , a Weld County Right-of-Way Use Permit is required for any project that will be occupying , constructing or excavating facilities within , and/or encroaching upon , any County rights-of-way or easement. Right-of-Way Use Permit instructions and application can be found at https ://www.weldgov .comidepartments/publicworks/permits/ . Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate existing utilities within the County right-of-way. TRAFFIC Latest (2018) ADT on CR 13 Colorado Boulevard counted 1332 vehicles per day with 26% trucks . The 85th percentile speed is 59 mph . Latest (2017) ADT on CR 54 counted 5668 vehicles per day with 14% trucks . The 85th percentile speed is 62 mph . Submit a final Traffic Impact Study that is prepared , stamped , and signed by a registered professional engineer licensed in the State of Colorado. The Study shall consider and discuss county traffic information , including 85th percentile speeds (i . e. 59 mph on CR 13 and 62 mph on CR 54) and ADT on County Roads 13 and 54; sight distances at all access locations ; loading and condition of existing bridges (CR 13 and CR 54) over Big Thompson River; specific information about travel routes to Stroh Pit; and the traffic associated with the mining of Cell 1 in that there are no internal access roads/bridges over Big Thompson River from the eastern side of parcel 095719400002 (i . e . traffic will be using CR 54 to access production/processing portion off CR 13) . TRACKING CONTROL Tracking control is required to prevent tracking from the site onto public roadways . For access to paved roads , tracking control devices can be double cattle guards with 100 ft. of asphalt or 300 ft of asphalt. For access to gravel roads , tracking control devices must be either double cattle guards with 100 ft. of road base, or road base on all driving surfaces . Temporary Tracking Control shall be used during construction unless permanent tracking control is installed ahead of construction activities . Recycled concrete is not allowed in County right-of-way. Tracking control for unmaintained public right-of-way is required just prior to entering publicly maintained roadways . A variance request for alternatives to the tracking control requirement can be submitted to Public Works for review and consideration . This site requires double cattle guards and 100 ft. of asphalt or 300 ft. of asphalt. IMPROVEMENTS AND ROAD MAINTENANCE AGREEMENT WITH UP-FRONT IMPROVEMENTS Public Works is requesting an Improvements and Road Maintenance Agreement for dust control , damage repairs to specified haul routes , triggered off-site improvements and up-front off-site improvements . Improvements/Road Maintenance Agreement: An example agreement is available at: https ://www.weldgov .com/UserFiles/Servers/Server 6/File/Departments/Public%20Works/DevelopmentR eview/USR-SPR- Permits%20lmprovements% 20Agreement% 20Template. pdf. It will detail the approved haul route(s), outline the required up-front off-site improvements , designate when other off-site improvements will be triggered , and include a maintenance agreement for the haul routes . DRAINAGE REQUIREMENTS This area IS within a Non- Urbanizing Drainage Area : Non-Urbanizing Drainage Areas typically require detention of runoff from the 1 -hour, 100-year, storm falling on the developed site and release of the detained water at the historic runoff rate of the 1 -hour, 10-year storm falling on the undeveloped site for NON- URBANIZING areas . Detention Pond summarized in a Drainage Report: The applicant has submitted a preliminary drainage report. A final drainage report and detention pond design completed by a Colorado Licensed Professional Engineer is required prior to recording the USR map . The drainage report must include a certification of compliance stamped and signed by the PE . A Certification of Compliance form can be found on the Public Works Development Review website . General drainage report checklist is available on the engineering website. More complete checklists are available upon request. Historic Flows : The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from the property. GRADING PERMIT A Weld County Grading Permit will be required if disturbing more than 1 acre . Grading Permit applications are accepted after the planning process is complete (plan recorded) . An Early Release Request Form may be entertained only after the applicant , Public Works and Planning Department have reviewed the referral and surrounding property owner comments . The Early Release Request may or may not be granted depending on referral comments and surrounding property owner concerns . Contact an Engineering representative from the Public Works for more information . A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre . Sand and Gravel Mining and Processing Combined Discharges General Permit (COG500000) with the State may also be required . Contact: Colorado Department of Public Health and Environment, Water Quality Control Division, 303-692-3575. If more than 1 acre is to be disturbed for construction of non-gravel pit items such as structures , parking lots , laydown yards etc . . . , a Weld County grading permit will be required prior to the start of construction . Grading Permit applications are accepted after the planning process is complete (plan recorded) . An Early Release Request Form may be entertained only after the applicant, Public Works and Planning Department have reviewed the referral and surrounding property owner comments . The Early Release Request may or may not be granted depending on referral comments and surrounding property owner concerns . Contact an Engineering representative from the Public Works for more information . CONDITIONS OF APPROVAL A. The applicant shall address the concerns of the Public Works Referral relating to the proposed County Road 13 and County Road 54 access locations . (Department of Public Works) B . The applicant shall submit a final Traffic Impact Study, prepared , stamped , and signed by a registered professional engineer licensed in the State of Colorado, that addresses the concerns of the Public Works review. (Department of Public Works) C . An Improvements and Road Maintenance Agreement is required for off-site improvements at this location . Road maintenance includes , but is not limited to, dust control and damage repair to specified haul routes . The Agreement shall include provisions addressing engineering requirements , submission of collateral , and testing and approval of completed improvements . ( Department of Public Works) D . A Final Drainage Report and Certification of Compliance stamped and signed by a Professional Engineer registered in the State of Colorado is required . (Department of Public Works ) E . The applicant shall submit a recorded copy of any agreement signed by all of the owners of the property crossed by the access on to County Road 13. The access shall be for ingress , egress , utilities and shall be referenced on the USR map by the Weld County Clerk and Recorder's Reception number. (Department of Public Works) F . All access roads from sand and gravel operations to public highways , roads or streets , or to adjoining residential structures , shall be paved or otherwise treated to minimize dust conditions on all parts of such access roads which are located within one -fourth (1/4) mile of the public highway, road , street or adjoining residential structure. ( Department of Public Works ) C . The plan shall be amended to delineate the following : 1 . The applicant shall delineate and label on the site map or plat the future and existing right-of-way (along with the documents creating the existing right-of-way) and the physical location of the road . All setbacks shall be measured from the edge of right-of-way. This road is maintained by Weld County. (Department of Public Works) 3. Show and label the approved access locations on to County Road 13 and on to County Road 54 , approved access width and the appropriate turning radii (60) on the site plan . The applicant must obtain an access permit in the approved locations prior to construction . (Department of Public Works) 4. Show and label the approved tracking control on the site plan . ( Department of Public Works ) 5. Show and label the entrance gate if applicable . An access approach that is gated shall be designed so that the longest vehicle (including trailers) using the access can completely clear the traveled way when the gate is closed . In no event, shall the distance from the gate to the edge of the traveled surface be less than 35 feet. ( Department of Public Works) 6. Show and label a 30-foot minimum access and utility easement to provide legal access from County Road 13 to the parcel (095719300061 ) on the site plan . ( Department of Public Works) 7. Show and label the accepted drainage features . Stormwater ponds should be labeled as ``Stormwater Detention , No-Build or Storage Area" and shall include the calculated volume. Show and label the parking and traffic circulation flow arrows showing how the traffic moves around the property. ( Department of Public Works) Prior to Construction : A. The approved access and tracking control shall be constructed prior to on-site construction . (Department of Public Works) B . If more than one ( 1 ) acre is to be disturbed for construction outside of the sand and gravel mining area , a Weld County grading permit will be required . (Department of Public Works ) C . The applicant shall notify Public Works of the anticipated start date and schedule a stormwater inspection . If construction has commenced without contacting Public Works , the site will be in violation , a stop work order will be issued , and further enforcement actions may be pursued . ( Department of Public Works ) During Construction A. Public Works shall be allowed to enter the premises to inspect temporary control measures ( BMPs) for proper installation and maintenance as detailed in the site's Grading Permit. Inspections occur to ensure adequate measures are taken to protect the landowner, neighboring properties , adjacent roadways and nearby waterways from the potentially adverse effects of stormwater runoff. Inspections shall occur at a frequency determined by the site's compliance, with higher inspection frequencies for non-compliance . (Department of Public Works) Prior to Operation : A. Accepted construction drawings and construction of the off-site roadway improvements , as required , shall be submitted prior to operation . (Department of Public Works ) Prior to Certificate of Occupancy : A. The applicant shall submit an As- Built Drawing of each permanent control measure , signed and stamped by a Professional Engineer registered in the State of Colorado. After the submittal , Public Works shall be allowed to enter the premises to inspect the permanent control measure(s) to confirm proper installation , as detailed in the drawing . ( Department of Public Works) DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN) 1 . The property owner or operator shall be responsible for controlling noxious weeds on the site , pursuant to Chapter 15, Article I and II , of the Weld County Code. (Department of Public Works) 2 . The access to the site shall be maintained to mitigate any impacts to the public road , including damages and/or off-site tracking . (Department of Public Works) 3. There shall be no parking or staging of vehicles on public roads . On-site parking shall be utilized . (Department of Public Works) 4. Any work that may occupy and or encroach upon any County rights-of-way or easement shall acquire an approved Right-of-Way Use Permit prior to commencement. ( Department of Public Works) 5. The Property Owner shall comply with all requirements provided in the executed Improvements Agreement. (Department of Public Works) 6. The Improvements Agreement for this site may be reviewed on an annual basis , including a site visit and possible updates . (Department of Public Works) 7. The Property Owner shall comply with all requirements provided in the executed Road Maintenance Agreement. (Department of Public Works) 8. The historical flow patterns and runoff amounts on the site will be maintained . (Department of Public Works) 10 . Weld County is not responsible for the maintenance of onsite drainage related features . (Department of Public Works) 11 . Once the permanent control measure has passed final inspection by Public Works , the site shall be routinely inspected at a frequency determined by Public Works , usually on an annual basis unless otherwise noted , for the life of the control measure . Inspections occur to ensure the permanent control measure remains fully operational and is being adequately maintained according to the site's Operation and Maintenance Plan . Upon sale of the property, the responsibility of maintaining permanent control measures shall be transferred to the new owner. Environmental Health Services has reviewed this proposal for a Site-Specific Development Plan and Special Review Permit for Open Mining (sand , gravel and stone) and processing of minerals, an asphalt plant, including the importing of materials associated with an asphalt batch plant, recycling of asphalt , mine office/scale house and scale , a fueling/lubricating station , portable generators , mobile mining equipment parking and storage and employee and vendor parking in the A (Agricultural ) Zone District . As mining is considered a temporary use , portable toilets and bottled water are acceptable for sanitary uses in accordance with EH policy . Portable toilets are required to be screened . Noise is restricted to the level allowed in the industrial zone district. The application contains a noise analysis completed by Hankard Environmental . The analysis indicates the industrial limit can be met 25 feet off the property line and the residential limit can be met at adjacent residences as long as the following noise mitigation requirements are complied with as stipulated in the noise analysis . " Provided that all following conditions below are followed , noise from the construction and operation of the proposed Project is predicted to be in compliance with CRS §25- 12 limits , . Full simultaneous operation of the Hot Mix Asphalt plant, aggregate processing plant , and mining activities should take place during daytime hours only (7 : 00 am to 7 : 00 pm ) . 2 . Noise emission factors should not exceed those listed in Table 2 . If louder equipment is used , then additional analysis or mitigation may be necessary . A 20-foot-tall stockpile should be maintained on the north side of the aggregate processing plant to block the noise from propagating to the nearest residences to the north . 4 . The use of ambient-controlled broadband back-up alarms is required for all Coulson Excavating equipment . Backing up by contractor vehicles not outfitted with these types of alarms should be minimized , particularly at night. 5 . Good communication with all surrounding residents is recommended , including a 24-hour telephone `hot-line? A waste handling plan was submitted which states waste will be stored in a covered dumpster and will be collected on a monthly basis . Petroleum products including engine waste oil , hydraulic fluid etc. generated from equipment servicing will be hauled offsite by Coulson Excavating Co . service trucks to their main facility where Tristate picks up for recycling or disposal . A dust abatement was submitted which indicates the site will utilize water trucks , conveyors , paving to the asphalt plant and graveling interior roads . Air emission permitting through the State is required and the application indicates they have submitted an APEN to the State . There will be fuel storage tanks on site which require permitting through the State along with secondary containment and an SPCC plan . We recommend that the following requirements be incorporated into the permit as development standards : 1 . All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30 -20- 100 . 5 , c. F . S . ) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination . 2 . No permanent disposal of wastes shall be permitted at this site . This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act , 30 -20 - 100 . 5 , C. R . S . Waste materials shall be handled , stored , and disposed in a manner that controls fugitive dust, fugitive particulate emissions , blowing debris , and other potential nuisance conditions . The facility shall operate in accordance with Chapter 14 , Article 'I of the Weld County Code and the accepted waste handling plan . 4 . Fugitive dust should attempt to be confined on the property. Uses on the property shall comply with the Colorado Air Quality Commission 's air quality regulations and the accepted dust abatement plan . 5 . The operation shall submit an Air Pollution Emission Notice (A. P . E . N . ) and Emissions Permit Application and obtain a permit from the Air Pollution Control Division , Colorado Department of Public Health and Environment, as applicable . 6 . The facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in 25- 12 - 103 C . R . S . The facility shall operate in accordance with the accepted noise analysis . 7 . The operation shall remove , handle, and stockpile overburden , sand , soil and gravel from the facility area in a manner that prevents nuisance conditions . 8 . Adequate drinking , hand washing , and toilet facilities shall be provided for employees and patrons of the facility, at all times . Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to On -Site Wastewater Treatment System Systems . 9 . Portable toilets and bottled water are acceptable to provide drinking and sanitary services to the site . Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment . Portable toilets shall be serviced by a cleaner licensed in Weld County, contain hand sanitizers and be screened from existing adjacent residential properties and public rights-of-way. 19 . Any vehicle or equipment washing areas shall capture all effluent and prevent discharges in accordance with the Rules and Regulations of the Water Quality Control Commission , and the Environmental Protection Agency. 11 . If applicable , the operation shall obtain a stormwater or other discharge permits from the Colorado Department of Public Health & Environment, Water Quality Control Division . 12 . The facility shall comply with all provisions of the State Underground and Above Ground Storage Tank Regulations . 13 . All All chemicals must be handled in a safe manner in accordance with product labeling . All chemicals must be stored secure , on an impervious surface , and in accordance with manufacturer's recommendations . 14 . The The operation shall comply with all applicable rules and regulations of the Colorado Division of Reclamation Mining and Safety . 15 . In general , no issues with the proposal BUT they need to keep in mind that there is copper cables north side AND and an IOF fiber run . The IOF is inneroffice facility - it is the fiber communication between Loveland to Greeley Parkview and I think it may be in a Mountain State Telephone and Telegraph easement. The lineage of that easement extends to the successors USWest, Qwest and finally Centurylink today. A section of this fiber cable is being relocated for weld county at 54 and 17 a mile or so east of here . It's a big deal and carries the heavy traffic between those towns, CTL has nothing on CO RD 13 ( due to the river ) and really nothing of concern on 15 as well . The proposed mining operations will occur predominantly below the groundwater table and will impact groundwater hydraulically connected to the Big Thompson River. The site is proposed to be dry mined using dewatering trenches that will be constructed around the perimeter of each mining area and will be discharged to settling ponds and then to the Big Thompson River . Consumptive use of water at the site will result from evaporative loss in dewatering trenches and settling ponds , water retained in any mined product, and water used for dust control . According to the request submitted to our office for the approval of a substitute water supply plan , the estimated annual amount of water to be consumed during the first approval period is 21 .08 acre-feet . The operation may not expose or consume groundwater prior to the approval of the pending substitute water supply plan and associated gravel pit well permit. The site is anticipated to have up to twelve employees on site , with additional visits by material haul truck drivers and other site users . Ranslem , Thank you for the opportunity to comment on the Coulson Excavating Co . open mining and asphalt processing plant project. The mission of Colorado Parks and Wildlife ( CPW ) is to perpetuate the wildlife resources of the state , to provide a quality state parks system , and to provide enjoyable and sustainable outdoor recreation opportunities that educate and inspire current and future generations to serve as active stewards of Colorado ' s natural resources. Our goal in responding to land use proposals such as this is to provide complete, consistent, and timely information to all entities who request comment on matters within our statutory authority . CPW has received the proposal and is familiar with the site . If the project proceeds as described in the proposed documents , the CPW recommends the following . Aquatic Habitat Recovery and Conservation Waters Aquatic habitat recovery and conservation waters are defined as lakes, ponds, and river segments that contain species under management for population conservation and recovery . This section of the Big Thompson River provides valuable aquatic habitat for many small bodied native aquatic species . These species include : Creek Chub , Fathead Minnow, Iowa Darter (Tier II SWAP Species) , Johnny Darter , Longnose Dace , Sand Shiner , and Central Stoneroller . Protection of aquatic habitat is critical to the continued success of these species . CPW discourages any mining or related activity both within the river channel and associated sandbars , as impacts to the stream or riparian and wetland vegetation could occur, as does the increased potential for water contamination . CPW recommends limiting mining operations to upland areas away from drainages by incorporating a minimum buffer of 300 ft extending from the outermost limit of the riparian vegetation zone . Old mining ponds generally end up providing habitat for non - native warmwater aquatic species that migrate into the river during floods and negatively impact native aquatic species . Maintaining a larger buffer helps minimize these future risks . Potential Raptor Nesting Habitats There are mature trees within these parcels - primarily located along the riparian drainages . Therefore , if the initial site disturbances are going to occur between February 1 and July 15 , CPW recommends that the operator perform active raptor nest surveys to document new and / or unmapped active raptor nests . If active raptor nests are observed , then please notify CPW of the exact active nest locations , and we recommend that the appropriate species - specific buffers and timing stipulations are implemented around these nests . Bald Eagle Winter Concentration Area Bald eagle winter concentration areas are defined as existing winter range where eagles concentrate between November 15 and March 15 . Bald eagle winter movements are highly variable as they are influenced by changes in weather and prey availability. Therefore , bald eagle distribution and abundance may change quickly during the winter and between winters . If initial construction activities must occur between November 15 and March 15 , CPW recommends daily bald eagle night roost surveys and monitoring to avoid disturbing bald eagles during construction . Tree Replacement There is no specific information within the application plans of direct impacts to trees and shrubs from construction activities . If tree and / or shrub removal will occur, CPW recommends trees and shrubs be replaced at a 3 : 1 ratio . If onsite mitigation of trees and shrubs cannot be achieved onsite , CPW would like to coordinate off- site mitigation for those losses . Noxious Weeds Equipment should be cleaned periodically to remove weed seeds even if no weeds are recognized . It is recommended that noxious weeds are actively eradicated . A working weed management and disturbed area reclamation plan should be developed and implemented throughout mining, and until all disturbed areas are property re-vegetated to prevent erosion and invasion by weeds . The applicant may want to contact the Weld County Weed Inspector to facilitate development of reclamation and weed management plans for the project . During mining operations CPW recommends the removal or leveling of any large piles of dirt . Barren mounds of dirt are of little value to wildlife , can be an eyesore on the landscape, and contribute to the spread of noxious weeds . CPW recommends any piles of dirt on this site to be leveled or landscaped to match the surrounding contour of the land . This barren ground should then be reseeded with native, drought resistant plant species to provide quality habitat for wildlife and to prevent the spread of noxious weeds . Wildlife Escape Ramps Curing open pit or open trench mining operations, CPW recommends backfilling escape ramps in areas where steep slopes occur . Escape ramps will allow wildlife to safety exit an open pit or trench if they become entrapped . Post Mining Reclamation once mining is complete , all ponds created by reclamation efforts could potentially have significant value to wildlife . To maximize this benefit, the CPW recommends that ponds be designed to include irregular shorelines , irregular pond bottom bathymetry, and one or more islands to provide cover, shelter, and nesting areas for migratory birds. Irregular bottom bathymetry will provide heterogeneity in habitat for fish , if fish are introduced into the pond after post mining reclamation . Islands should be at least 15 ' x 25 ' in size for every two surface acres of water in the pond . Shoreline and island slopes should be graded to a ratio of 4 horizontal feet to every 1 vertical foot of distance , with some areas having slopes no steeper than 8 horizontal feet to every 1 vertical foot of distance . Such shallow areas wilt allow for the establishment of a variety of aquatic vegetation and invertebrate prey for waterfowl and shorebirds . Shallow vegetated areas will also provide valuable habitat and structure for fish species, if fish are introduced to the ponds . Shorelines should be re- vegetated with native aquatic vegetation .
