HomeMy WebLinkAbout20203072.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO WEDNESDAY, OCTOBER 14, 2020 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, October 14, 2020, at the hour of 9:00 a.m. le ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Mike Freeman, Chair Commissioner Steve Moreno, Pro-Tem Commissioner Scott K. James Commissioner Barbara Kirkmeyer Commissioner Kevin D. Ross Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Bri White Controller, Barbara Connolly ILA MINUTES: Commissioner Moreno moved to approve the minutes of the Board of County Commissioners meeting of October 12, 2020, as printed. Commissioner Ross seconded the motion, and it carried unanimously. AMENDMENTS TO AGENDA: There were no amendments to the agenda. CONSENT AGENDA: Commissioner James moved to approve the Consent Agenda, as printed. Commissioner Kirkmeyer seconded the motion, and it carried unanimously. El PUBLIC INPUT: No public input was given. El PROCLAMATIONS: 1) NATIONAL FOSSIL DAY - OCTOBER 14, 2020: Chair Freeman read the proclamation for the record. Joe Sertich, Curator at the Denver Museum of Nature and Science, shared his excitement to further construct the dinosaur fossil known as "Pops" the Triceratops. The Board consecutively thanked Dr. Sertich and Jennifer Finch, Public Information Officer, for educating the Commissioners and staff on "Pops" the Triceratops and for promoting the historic project. ©I fo-1 Minutes, Wednesday, October 14, 2020 Page 1 2020-3072 BC0016 El 2) "POPS" THE TRICERATOPS DAY - OCTOBER 14, 2020: Chair Freeman read the proclamation for the record. Ms. Finch spoke on behalf of the Mappelli family who gifted "Pops" the Triceratops to the County and relayed their appreciation of staff's efforts in gaining community awareness on local history. (Clerk's Note: The group gathered for a photo opportunity). WARRANTS: 1) GENERAL WARRANTS - OCTOBER 13, 2020: Commissioner James moved to approve the General Warrants, as printed. Commissioner Kirkmeyer seconded the motion, and it carried unanimously. El BIDS: 1) APPROVE BID #62000184, ARMORED CAR SERVICES - ACCOUNTING DEPARTMENT AND TREASURER'S OFFICE: Barbara Connolly, Controller, stated staff recommends selecting the lowest bidder who met specifications, Armored Knights, Inc., for a total amount of $39,045.60. Commissioner Ross moved to approve said bid, the motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. El 2) APPROVE BID #B2000177, CONTROLLED ACCESS DOORS FOR THREE (3) COUNTY BUILDINGS - DEPARTMENT OF BUILDINGS AND GROUNDS: Ms. Connolly reviewed staff's recommendation to select Long Building Technologies, Inc., the low bidder meeting specifications, for a total of $140,175.00. Commissioner Moreno moved to approve said bid, the motion was seconded by Commissioner James, and it carried unanimously. IE 3) PRESENT BID #B2000181, JAIL TRAINING ROOMS AUDIO AND VISUAL - DEPARTMENT OF BUILDINGS AND GROUNDS: Ms. Connolly stated staff received eight (8) bids and will make a recommendation on October 28, 2020. IR 4) PRESENT BID #B2000185, FIRE ALARM TESTING - DEPARTMENT OF BUILDINGS AND GROUNDS: Ms. Connolly presented the eight (8) bids received, with two (2) bids rejected, and stated staff will make a recommendation on October 28, 2020. NEW BUSINESS: 1) CONSIDER CONTRACT ID #4145 SUBRECIPIENT PERFORMANCE REPORT AND ASSESSMENT FOR AREA AGENCY ON AGING (AAA) SERVICES AND AUTHORIZE CHAIR TO SIGN: Jamie Ulrich, Director of the Department of Human Services, shared the funding received by AAA provides services to older adults and acknowledged the State requires a Subrecipient Performance Report and Assessment. Commissioner Ross moved to approve said contract and authorize the Chair to sign. The motion was seconded by Commissioner Moreno and it carried unanimously. IR 2) CONSIDER CONTRACT ID #4163 TWO (2) GRANT APPLICATIONS FOR REPLACEMENT OF BRIDGES 60.5/49A AND 34/17A - COLORADO COUNTIES, INC. (CCI): Michael Bedell, Department of Public Works, reviewed the annual applications for bridge replacement grant funds and shared the request for a total allocation of $600,000.00 for Bridge 60.5/49A and the request for an amount of $1,200,000.00 for Bridge 34/17A. Commissioner Kirkmeyer moved to approve said applications. Seconded by Commissioner Ross, the motion carried unanimously. 3) CONSIDER TEMPORARY CLOSURE OF CR 44 BETWEEN CRS 53 AND 55: Amy Mutchie, Department of Public Works, detailed the closure will occur between October 19, 2020, and October 23, 2020, to replace a drainage culvert and noted magnesium chloride will be utilized on all gravel road detour Minutes, Wednesday, October 14, 2020 Page 2 2020-3072 BC0016 routes. In response to Commissioner Kirkmeyer, Ms. Mutchie provided County Roads (CR) 55 and 53 will be the detour routes assigned and she shared rescheduling the matter after harvest season would potentially affect paving if the ground freezes, but no collapsing has been reported. Commissioner Kirkmeyer recommended delaying the project start date to negate any impacts on agricultural production and Commissioner Moreno presented a similar situation where a farmer expressed concerns. Commissioner Kirkmeyer moved to approve said closure, with the modified effective date being November 3, 2020. The motion, which was seconded by Commissioner James, carried unanimously. PLANNING: 1) CONSIDER PARTIAL VACATION OF USE BY SPECIAL REVIEW PERMIT, USR16-0010 - JUSTIN JOHNSON: Michael Hall, Department of Planning Services, summarized the property location and the Use by Special Review Permit, USR16-0010, located on Lot A of Amended Recorded Exemption, AMRE-3340, or case number RECX20-0076. He reviewed the request to partially vacate the USR to decrease the boundary and remove it from Lot A, containing only residential components, so it is only located on Lot B, which contains the permitted commercial business. Mr. Hall shared staff's recommendation for approval, as the partial vacation will satisfy Condition of Approval (COA) #2.A of RECX20-0076. Justin Johnson, applicant, was present to answer any questions. Commissioner Kirkmeyer moved to approve said partial vacation. Commissioner Ross seconded the motion and it carried unanimously. 2) CONSIDER FOUR -LOT RECORDED EXEMPTION, RECX19-0131 — TIMOTHY GITTLEIN: Diana Aungst, Department of Planning Services, detailed the lot location and the proposal for a four -lot Recorded Exemption (RE) on Lot D, which would be the third RE on the property. She presented staff's recommendation for denial due to its evasion of the subdivision requirements for health, safety, and welfare by adding to the existing five (5) RE lots within the same parcel and creating a linear subdivision. Ms. Aungst stated the applicant proposed one shared access point on County Road (CR) 53, an unmaintained gravel road, to meet spacing requirements. Commissioner Kirkmeyer and Ms. Aungst reviewed the RE historical timeline, beginning in 2008. Timothy Gittlein, applicant, thanked the Board for their consideration and summarized the family farm operation, with his brothers owning the adjacent properties. He expressed the lots are no longer irrigated and they do not function well through dryland farming, he assured there will be no new construction on the property, and stated he is preparing the property for his retirement. Commissioners Moreno, Ross, and James stated the proposal has a subdivision layout, reviewed the intent of the RE process enables family or agricultural employees to reside on the property, and recommended the applicant apply for a Rural Land Division (RLD) in five (5) years to meet the subdivision requirements. Responding to Mr. Gittlein, Commissioner Kirkmeyer stated applying for a two -lot RE instead of a four -lot RE would not resolve the evasion of the subdivision requirements. Commissioner Moreno moved to deny said recorded exemption for the reasons presented by staff. The motion was seconded by Commissioner Ross and it carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
