REV. STAT. ANN. Sec. 150-5-31, (1963) as amended) , and the Court having examined all of the motions , petitions , and pleadings herein and after having heard the testimony and examined the exhibits and other evidence and after hearing counsel DOTH FIND : 1. The Court has full and complete jurisdiction in this proceeding for the inclusion of an additional area within the District, and of the parties to this petition, and the subject matter of this petition. 2 . The petition in this cause for the inclusion of an additional area of land within Central Colorado Water Conser- vancy District was filed in the office of the Clerk of the District Court in and for the County of Weld on the 14th day of December, 1972 , together with a bond sufficient to pay all expenses connected with the proceedings in case said inclusion of additional lands within the District be not effected,. On December 15 , 1972 , this Court by order approved the bond, fixed March 7 , 1973 , at the hour of 9 :30 A.M. as the time, and the District Court in and for the County of Weld, State of Colorado , as the place for hearing of said petition, and directed the Clerk of this Court to give notice by registered mail and by publication as required by COLO. REV. STAT. ANN. Secs. 150-5-6 , 150-5-31 (e) , and 150-5-2 . 3. The Clerk of this Court, pursuant to such Order dated December 15 , 1972 , did cause notice of the pendency of the petition and notice of the time and place of hearing thereon to be given by publication once each week for three successive weeks in "The Greeley Daily Tribune and The,Greeley Republican" a legal newspaper of general circulation in the County of Weld; once each week for three successive weeks in "The Brighton Blade" , a legal newspaper of general circulation in the County of Adams , and once each week for three successive weeks in "The Fort Morgan Times." , a legal newspaper of general circulation in the County of Morgan, all in the State of Colorado. The publication was made in each of the newspapers in the manner required by law. The Clerk of this Court further caused a copy of notice of pendency of the petition and hearing thereon to be mailed by registered mail to the Board of County Commissioners of the Counties of Morgan and Weld, State of Colorado. 4 . The petition sets forth all matters required by COLO. REV. STAT. ANN. Sec. 150-5-31 (1963) . 5. There is no city or city and county having a population of more than 25 ,000 as determined by the last United States Census to be included within the additional area to be included within the boundaries of the district. 6 . The petition in all respects complies with, and conforms to, the requirements of Sec. 150-5-31 of the Water Conservancy Act . The petition has been signed by not fewer than twenty-five percent of the owners of irrigated land of an assessed value of not less than one thousand dollars and and by not fewer than five percent of the owners of non-irrigated land or lands embraced in the incorporated limits of a city or town of an assessed value of not less than one thousand dollars . The allegations of said petition are true and said petition in its form and content thereof are approved by the Court. ' Said petition is signed by more than the required number of -2- landowners. 7 . That all petitions filed herein by any owner of irrigated land for exclusion of his irrigated lands filed as provided by COLO. REV. STAT. ANN. Sec. 150-5-31 (3) (m) have been granted. 8. That the lands of all protesting petitioners have been excluded upon motion of the petitioners. 9. That under the proposed plans of the petitioner a motion was filed herein for the exclusion of all dry lands included in the petitions for exclusion from the area to be included and all such lands were thereupon excluded from lands sought to be included in the District. 10. That through the oversight of petitioners some lands were sought to be included within the District that were within the boundaries of the Kiowa-Bijou Ground Water Management District. Said lands could not be benefited by any of the proposed works of the District. The Petitioner moved to exclude said lands from the area proposed to be included and the Court thereupon ordered said lands excluded. 11. That as of the date of these Findings and Decree no protestants, objectors or petitioners for exclusion are before the Court, since all lands described in each of said petitions have been excluded from the area described in the petition filed December 14 , 1972 . 12 . The property sought to be included within Central Colorado Water Conservancy District (a) will be benefited by the accomplishment of the purposes for which the original District was formed, (b) participation in the acquisition of water rights and the benefits of all of the filings , statements , applications for water rights now pending in the Water Courts of Water Divisions 1, 2 , 4 and 5 under the Water Right Determination and Administration Act of 1969 , and the petition for adjudications in Water Districts 36 , 37 , 51 and 52 under the Adjudication Act of 1943 , (c) an interest -3- in a conditional decree to Narrows Reservoir awarded by the District Court in and for the County of Weld and State of Colorado, and such other applications for water rights , aug- mentation, exchange and water management as said Conservancy District may determine. 13. That under the Water Conservancy Act of Colorado (COLO. REV. STAT. ANN. Sec. 150-5 (1963) , as amended and particularly Sec. 150-5-31 (3) (m) thereof) this Court has the right to exclude lands from the petition both irrigated and non-irrigated. 14. That the lands described in "Exhibit A" attached hereto should be included within the boundaries of Central Colorado Water Conservancy District. WHEREFORE, it is by the Court ordered, adjudged and de- clared and decreed that the territory described in "Exhibit A" attached hereto and made a part hereof by reference as fully as if set forth herein, be and the same is hereby included within the boundaries of Central Colorado Water Conservancy District, whose office and principal place of business is Hudson, Colorado, 80642 , Weld County, Colorado. REV. STAT. ANN. , 1963 , upon the petition to the Honorable District Court sitting in and for Weld County , State of Colorado, for the establishment of a subdistrict of "Central Colorado Water Conservancy District" , created in the above entitled Civil Action No. 16834 in the District Court in and for the County of Weld and State of Colorado. The Court having read and examined the petition for organi- zation of a Ground Water Management Subdistrict of Central Colorado Water Conservancy District, as well as the petitions for exclusion , protests , motions and other pleadings and after having heard the testimony, read and examined the exhibits and other evidence adduced herein, and after having heard counsel appearing DOTH FIND: 1. The Court has full and complete jurisdiction in this proceeding for the creation of a Ground Water Management Sub- district of Central Colorado Water Conservancy District, and of the subject matter of this petition and of the parties to the petition. 2 . The petition in this cause for the organization of a Ground Water Management Subdistrict of Central Colorado Water Conservancy District was filed in the office of the Clerk of this District Court in and for the County of Weld, State of Colorado, on the 14th day of December, 1972 , together with a bond sufficient to pay all expenses connected with the proceedings in case the organization of the ground water management subdistrict be not effected. On December 15 , 1973 , this Court by order approved the bond, fixed March 7 , 1973 , at the hour of 9 :30 A.M. as the time and the District Court in and for the County of Weld and State of Colorado as the place for the hearing of said petition and directed the Clerk of this Court to give notice by registered mail and by publication as required by COLO. REV. STAT. ANN. , Secs. 150-5-2 , 150-5-6 and 150-5-15 (1963) as amended. 3. The Clerk of this Court, pursuant to such Order dated December 15 , 1972 , did cause notice of the pendency of the petition and notice of the time and place of hearing thereon to be given by publication once each week for three successive weeks in "The Greeley Daily Tribune and The Greeley Republican" , a legal newspaper of general circulation in the County o£ Weld; once each week for three successive weeks in "The Brighton Blade" , a legal newspaper of general circulation in the County of Adams , and once each week for three successive weeks in "The Fort Morgan Times" , a legal newspaper of general circulation in the County of Morgan, all in the State of Colorado. The publication was made in each of the newspapers in the manner required by law. The Clerk of this Court further caused a copy of notice of pendency of the petition and hearing thereon to be mailed by registered mail to the Board of County Commissioners of the Counties of Morgan and Weld, State of Colorado. 4. The petition sets forth all matters required by COLO. REV. STAT. ANN. Sec. 150-5-15 (1963) , and all other applicable sections of the Water Conservancy Act of Colorado. 5 . There is no city or city and county having a population of more than 25 ,000 as determined by the last United States Census -2 •- Management Subdistrict of Central Colorado Water Conservancy District. 6. The petition in all respects complies with, and conforms to, the requirements of Sec. 150-5-15 and all other applicable sections of the Water Conservancy Act of Colorado. The petition has been signed by not fewer than twenty-five percent of the owners of irrigated land of an assessed value of not less than one thousand dollars and by not fewer than five percent o£ the owners of non-irrigated land or •lands embraced in the incorporated limits of a city or town of an assessed value of not less than one thousand dollars. The allegations of said petition are true and said petition in its form and content thereof are approved by the Court. Said petition is signed by more than the required number of landowners. 7 . That' Central Colorado Water Conservancy District , acting by and through its Board of Directors, has granted its verified consent to the creation of the Ground Water Management Subdistrict of Central Colorado Water Conservancy District and has granted to said subdistrict perpetual use of water under the conditional decree granted to said District in the amount of seven thousand five hundred (7 ,500) acre feet of water out of Narrows Reservoir and has further granted to the said Ground Water Management Sub- District of Central Colorado Water Conservancy District the per- petual right to apply for and receive an allotment from any water rights acquired by the District .as set forth in amendments SEVENTH, EIGHTH, NINTH, TENTH, ELEVENTH, TWELFTH, THIRTEENTH and FOURTEENTH to the Petition herein as filed in this matter on the 6th day of March, 1973. 8. That Central Colorado Water Conservancy District gives its verified consent to furnish such perpetual use of water which may be acquired by the District to the subdistrict only on condition that all lands within the subdistrict shall likewise be within the boundaries of Central Colorado Water Conservancy District. -3- 9. That all petitions filed herein by any owners of irrigated or non-irrigated land for exclusion thereof have been granted. 10. That the lands of all protesting petitioners have been excluded upon motion of the petitioners herein. 11. That under the proposed plans of the petitioner, a motion was filed herein for the exclusion of all dry lands included in the petition for exclusion from the area to be included and all such lands were thereupon excluded from lands sought to be included in the Ground Water Management Subdistrict of Central Colorado Water Conservancy District. 12 . That through the oversight of petitioner some lands were sought to be included in the Ground Water Management Sub- district of Central Colorado Water Conservancy District that were within the boundaries of the North Kiowa-Bijou Ground Water Manage- ment District. Said District could not be benefited by any of the proposed works of the proposed Ground Water Management Subdistrict of Central Colorado Water Conservancy District. The Petitioner moved to exclude said lands from the area proposed to be included in the Ground Water Management Subdistrict of Central Colorado Water Conservancy District and the Court thereupon ordered said lands excluded. 13. That as of the date of these Findings and Decree no protestants , objectors or petitioners for exclusion are before the Court, since all thereof have been excluded from the area des- cribed in the petition filed December 14 , 1972 , herein. 14 . That the Ground Water Management Subdistrict of Central Colorado Water Conservancy District will be benefited by the 7,500 acre feet of conditional decree of Narrows Reservoir awarded to Central Colorado Water Conservancy District and allotted by said District to the Ground Water Management Subdistrict of Central Colorado Water Conservancy District and will further be benefited by eligibility for application for an allotment of any -4- water rights which may be granted to the District which can be economically used for ground water recharge. 15. That the Ground Water Management Subdistrict of Central Colorado Water Conservancy District will be benefited by the accomplishment of the plans of augmentation, exchange , and diversion as set forth in the petition for the organization of said Ground Water Management Subdistrict o£ Central Colorado Water Conservancy District. 16 . That the lands described in "Exhibit B" attached hereto should be organized into the "Ground Water Management Subdistrict of Central Colorado Water Conservancy District" . WHEREFORE, it is by the Court ordered, adjudged, declared and decreed that the territory described in "Exhibit B" attached hereto and made a part hereof by reference as fully as if set forth herein is hereby organized, constituted, created and established as the "Ground Water Management Subdistrict of Central Colorado Water Conservancy District" , whose post office address and principal place of business is Hudson, Colorado, 80642 , Weld County, Colorado. The Board of Directors of Central Colorado Water Conservancy District shall be and constitute the Board of Directors of the "Ground Water Management Subdistrict of Central Colorado Water Conservancy District" .
