The following resolution was unanimously passed and adopted to-wit:-- WHEREAS, James J. Cahill, Daniel F. Carmichael and Edward T. Kelm of Denver, Colorado, are about to organize a corporation with power to construct and operate between the cities of Denvefand Greeley, in the State of Colorado, and particularly within the County of Weld, in the State of Colorado, an electric railway line or lines, to transport passengers and freight and thereby promote the public welfare; and WHEREAS, the said parties propose to build a line or 1i es of electric railway between said cities of Denver and Greeley in the State of Colorado; and WHEREAS, it is necessary that they be granted, by the Board of County Commissioners of the County of Weld, the rights privileges and franchises, herein below specified, to be by them in due time assigned and transferred to said corporation, when organized; and wiiEREAS, This Board believes the successful prosecution of said enterprise will materially increase the taxable property of the County of Weld, and be. for the general advantage of its citizens and taxpayers, and therefore desire to encourage the same; NOW, THEREFORE, Be it resolved by the Board of County Commissioners of Weld County, State of Colorado, that for the Considerations aforesaid, and subject to the several Con- dit ions below stated, this, the Board of County Commissioners of Weld County, State of Colo- rado, does hereby grant to said James J. Cahill, Daniel F. Carmichael and Edward T. Keim, , and their assigns, the necessary rights of way, easements and privileges to construct, operate and maintain, a line or lines, of electric railway, and they are hereby permitted to use , electricity, gas, compressed air, or any mechanical motive power now known of,or which may hereafter be discovered, for the operation of the said railway, with all rails, switches, turnouts, poles, wires, cars and other appliances, reasonably necessary in connection there— with, for the transportation of passengers and freight over, along and across the following named and deseribed public roads and highways, in the County of Weld and State of Colorado, to-wit: Beginning at a point on the south boundary line of Weld County, upon the highway most convenient, connecting with the town of Brighton in Adams county, extending thence in a northerly direction to the south city limits of the city of Greeley, following such highways as shall be found most convenient, direct and feasible; also starting from such point as may_ be desired on some highway leading out to the north or east of Greeley, thence extending in a northeasterly direction, to a point hereafter to be selected on the most direct line con- necting with that railroad, extending from Sterling to Cheyenne, commonly known as the "Burlington"; also the right to use the public highways and construct a branch line over the south line of Wed County just north of Brighton and West of the Platte river, in. a north- westerly direction to the vicinity of the Northwest corner of section twelve, township one, north, range sixty-eight west, all of which lines shall be hereafter specifically selected and shall be shown by a plat filed as hereinafter provided. The conditions to which said grant is hereby expressly made subjest are the following:-. 1. The rights, privileges and license herein granted shall be subject, always, to the 57 rights in said highways, and of rights of owners of land, whose lands are subjected to additional burden by reason of the construction or operation of said electric road. 2. That no steam engines or locomotives shall ever be used for moving cars upon said rail- road or any portion thereof within the boundaries ofiteld county, except during the construction of the said railway. 3. On or prior to the thirty-first day Of October, 1904, said grantees or their assigns must_ file with the County Clerk and recorder of Weld County' a map with a verified statement attached designating the particular road or public highways, and the side thereof, on which, withil; three (3 ) years after filing said map a line or lines of electric railway shall be constructed and in actual operation, and all roads not designated on said map shall be thereafter exempted from this grant. A failure to comply with any of these provisions shall operate as a forfeiture of all rights on or over the public roads designated in said map not actually occupied by said line of railway. Said rights of way and the privileges hereby granted shall extend to a proper crossing at grade of all public highways, and to the right to use a strip of land on one side of the highway where said railway shall be constructed, not to exceed fifteen (15) feet in width where the public highway is sixty (60) feet in width, and ten (10) feet where said highway is less than sixty (60) feet in width; but in no case shall any such road be constructed upon any highway in such manner as to reduce the width of the road reserved for the use of the public to less than forty (40) feet; except in cases of switches or turnouts. In all eases where turnouts, tracks, or switches are constructed in the highway, they shall be so laid that the top of the rail shall be on a level with the road, and the ties shall be covered, and said turnout and switch tracks shall be so placed as they may be utilized as a portion of the public highway. The owner thereof shall construct the same along one side of said highway and adjacent to the adjoining lands, and all poles and appliances for the operation of said road shall be placed upon the exterior line of said highway, excepting at the turnouts and switches. Said railway shall be so constructed as not to interfere with the grade of travelled portion of said road or :with any ditches constructed for irrigation or drainage or with the natural drainage of said road. In case the travelled portion of any portion of a highway is on the side of the road selected for said electric road, then in such case whoever shall construct sal,, electric road shall so grade and construct the public highway at such point as to leave the high- way in as good condition as it now is for a width of thirty (3 0) feet or more beyond tracks of said electric road in condition for public use as a highway. Said electric road shall be con- structed without any cut to exceed two feet in depth or fills to exceed two feet in elevation, along any highway, and proper crossings at grade shall be made at all cross high-ways and at all private roads and entrances on private grounds. No county Bridge shall be used by said electric road except with the consent of the County Commissioners of said Weld County but the owner of said road shall at their or its own expense construct and maintain all necessary bridges. In tbD case the construction of said railroad shall require the alteration of the grade of travelled portion of any road, such change shall be made at the expense of the owner of said road under the direction of the Board of County Commissioners and to their satisfaction. The said James J. Cahill, Daniel F. Carmichael and Edward T. Kelm, and their assigns, owning V 4 I 5S or to own, or operating said electric railway shall save harmless the Board of County Commissioners of the County of Weld, and all officers thereof, from and against any and all claims, if any be made, by or on account of any persons or corporations, by reason of the construction, maintenance or operation of said electric railway on public highways, or any matter in connection therewith, including all expenses, costs and counsel fees arising from any litigation on account thereof. It is understood said grantees or licensees hereunder shall, when so advised be at liberty to employ counsel to defend suits against said County or any of its officers, if any there be on account of any such claims and that the county officials defendant will at the instance of said Grantees and licensees execute any necessary appeal bonds with sureties arranged for by said grantees and licensees. In event any judgement against the County of Weld, this Board, or any county officials, be obtained, in any suit, and shall not be appealed from at instance of said grantees, or licensees hereunder, or if appealed from shall be affirmed or such appeal be dis- missed) and the owner of said electric railway shall not within sixty days thereafter pay such judgment in full with all costs attending, and otherwise comply with the provisions thereof, then all rights of way, privileges and franchises herein granted shall, at the option of the Board of county Commissioners) be forfeited and forthwith cease and determine. As a further consideration to the exercise of the privileges herein granted, said grantees and their assigns shall before commencing the work of construction upon any highway, file his or its acceptance in writing of all the provisions of this resolution and shall file with the Board a bond with sureties sufficient, to be approved by said Board in the Pena: sum of Ten Thousand ($10) 000. ) dollars, conditioned to faithfully comply with all the terms of this resolution and to save said Weld County, its Board of County Commissioners, and all officials of said county, harm- less) by reason of said grant and all things done thereunder, and to pay, settle, and discharge all claims for damages or otherwise arising out of said grant or the construction, maintenance and operation of said road. The following resolution was unanimously passed and adopted, to-wit:-- WHEREAS, It appears to the Board that on November 12, 1902, by proper order entered of record, among other proceedings, and in compliance with the law thereof, the following de- / rJO scribed line of road was granted, and damages awarded to the owners of the land abutting P'(; same, viz: Commencing at the S.W. corner of Sec. 33, Tp. 5, R. 67 and running from thence due north f mile to N.W. corner of S.W.* Sec. 33, being a strip 30 feet wide off of the West side of S.W.+* Sec. 33--5--67. (The Strip 30 feet wide off of East side of the S.E.* of. said sec. 32--5--67 being already given by Quit Claim Deed as per order of the Board entered of record in the minutes of the proceedings held October 7 1902 being recorded on Page 525 of Commissioners Record No. 9) Then commencing again at tie S.E. The petition for said road having been filed May 16, 1902 and viewers appointed same day, and WHEREAS, It further appearing that one Alfred Crebbin has made objection to the opening of said road and refuses to accept the damages awarded, ($75.00),upon the ground that it will 1 ( ;2 be a detriment to his property. The following resolution wigs unanimously passed and adopted, viz :-- WHEREAS, It appearing to the Board that it will be necessary to appoint one of the Commissioners as General Overseer of the Greeley Hospital with Power to act in the absence of the Board, and WHEREAS, It being the wish or the Board, for the protection of said Hospital, to ad- mit no person unless a guarantee of same nature be given to insure the payment for his or her care while in said Hospital; NOW TIFREFORE, Be It Resolved py the Board of County Commissioners of Weld County, Colo- rado) that Commissioner C. H. Rea, be and he is hereby appointed and constituted a special Commissioner with full power and authority to act in the absence of the Board; that his au- ties will be to carefully investigate into the financial standing of all persons admitted to }0S said Hospital and procure a guarantee of some nature that will insure said Hospital all payments justly due to same. Said appointments to date from January 7th, 1904 to January 7, 1905 unless sooner removed by the Bo .r 4. /7 IN THE MATTER OF FURNISHING ROOMS IN GREELEY HOSPITAL C BY LO JL.J AND OTHER ORDERS. The following resolution was unanimously passed and adopted, viz : WHE7EAS� It appearing to the Board that certain lodges and orders of the city have sug- gested that they be allowed to furnish one room each in the New Greeley Hospital Building, tO be used by the members of their respective lodge or order whenever needed, and WHEREAS) It further appearing to the Board that by sail Lodges or orders furnishing said rooms it will be an advantage and saving to the County, NOW THEREFORE, Be It Resolved by the Board of County Commissioners that this privilege be and the same is hereby granted under the following conditions, viz:-- 1st. Furniture for said rooms shall be satisfactory to and subject to the approval of the Board, and be placed in said room on or before February 10� 1904. 2nd. Thereafter so long as said furniture remains in said room it is understood that patients) not members of said Lodge or Order requiring Hospital accommodations shall not be placed in .said room in case where their needs can be supplied by using otter rooms in said Hospital nJt furnished by any lodge of any Benefit Order. 3rd. When the needs and demands of patients not members of any lodge furnishing a room in said Hospital must be supplied by using some room furnished by the C o_.a0.aE- or any such cRDE:4, such needs so far as practicable shall be apportioned fairly by using alternately the different rooms so furnished; the intention being that the room furnished by any lodge shall not be used for the general patients more than that of any other room furnished by any other lodge. 4th. Whensoever practicable a member of any lodge desires the use of the room so furn- ished by said lodge on regular rates of compensation he shall be given the preference in being permitted to use said room. If in such case a general patient is using said room and can be moved with safety to some other room then available, such change and removal shall be e 'fected whenever practicable to enable a member of said lodge or order to occupy said room.
