Home My WebLink About740583.tiff RESOLUTION WHEREAS, heretofore and on May 30, 1974, by Resolution, the Board of County Commissioners, Weld County, Colorado, did authorize the execution of a contract and agreement with OMER WESLEY BOX for the lease-purchase of the new Weld County Welfare Building including all exhibits attached and pertaining thereto; and WHEREAS, heretofore, May 31, 1974, by Resolution, the Board did authorize the execution of an amendment to aforementioned lease-purchase agreement in accordance with all exhibits attached thereto and made a part thereof, and WHEREAS, now OMER WESLEY BOX as lessor of said building, has submitted a second amendment to the aforementioned lease-purchase agree- ment, and WHEREAS, the Board has determined that it would be in the best in- terest of the County to accept the second amendment as submitted and as it amends the aforementioned lease-purchase agreement of May 30, 1973, all as contained therein and made a part thereof by reference. NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, Weld County, Colorado, that the second amendment to the lease-purchase agreement of May 30, 1973, herein above mentioned and made a part hereof by reference be accepted and the same hereby is ordered to be made a part of the lease-purchase agreement heretofore mentioned and entered into between Weld County and OMER WESLEY BOX. NOW, THEREFORE, in consideration of the mutual covenants of the parties hereto, it is agreed that the above described Indenture of Lease shall be and the same hereby is amended effective as of the effective date thereof in the following respects: A. Article 4 RENT thereof is amended so as to read as follows: 4. RENT. Lessee agrees to pay to Lessor, as rent for said premises, for the full term aforesaid: (i) The total sum of Eight Hundred Eighty-five Thousand Five Hundred Six Dollars and Forty Cents ($885,506.40), payable at the rate of Seven Thousand Three Hundred Seventy-nine Dollars and Twenty-one Cents ($7,379.21) per month, payable in advance on the first day of each and every calendar month during said term, at Lessor's office, and (ii) Such additional amount, if any, as may become payable because of increased taxes and/or assessments under Section 23 hereof. Except as herein amended, the above Indenture of Lease, as amended, is expressly ratified and confirmed.
