RESOLUTION 'G '% e ./,7q fG' y WHEREAS, it has been determined by the Board of County Commissioners, Weld County, Colorado, that a proposed sale of a tract of land more particularly described as follows, to-wits ,„ . A tract of land located in the WI. of Section 22, Township 6 North, Range 67 West of the 6th P.M. , Weld County, Colorado, being more particularly described as follows: Considering the North Line of said Section 22 as bearing N85°1.8'54"E, and with all bearing contained herein relative thereto: Commencing at the Ne corner of said Section 22, thence 555°11'29" W, 2209.70 feet to a point designated by a PK nail, said point being the intersection of the Great Western Railroad and the Colorado and Southern Railroad; thence, along the centerline of said Colorado and Southern Railroad S71°03'00" E, 55 .37 feet; thence departing the said Colorado and Southern Railroad, N12°21'00"E, 21.00 feet to a point on the North right-of-way of the said Colorado and Southern Railroad, and the East right-of-way of the said Great Western Railroad; thence, along the said East right-of-way of the Great Western Railroad on the arc of a curve to the right whose radius is 921.6 feet and whose long chord bears N13°15'38"E 29.29 feet to the True Point of Beginning; thence, along the said East right-of-way of the Great Western Railroad on the arc of a curve to the right whose radius is 921.6 feet and whose long chord bears N23°49'10"E, 308.93 feet; thence, N66°43'08" E, 118.04 feet; thence, SO3°09'45" E, 417.89 feet; thence, N71°03'00" W, 270.93 feet to the True Point of Beginning. The above described tract contains 1.55 acres and is subject to all easements and rights-of-way now on record or indicated on the attached plat, to the Town of Windsor, Weld County, Colorado for the purpose of a storage facility for machinery and equipment belonging to the Town of Windsor does not come within the purview of the definitions of the terms "Subdivision" and "subdivided land" as set forth in CRS 106-2-33, (3) (a) and (b) 1963, as amended, and WHEREAS, the Board of County Commissionersof Weld County, Colorado, desires to exempt this particular division of land for the aforesaid reasons pursuant to its authority under CRS 106-2-33 (d) , 1963, as amended, NOW, THEREFORE, BE IT RESOLVED, that the proposed sale of the hereinabove described tract of land to the Town of Windsor for the sole purpose of a storage facility for machinery and equipment belonging to the Town of Windsor, be exempted from the definition of the terms "Subdivision" and "subdivided land" as provided for in the riew Weld County Subdivision Regulations at Section 2-1, A. , (3) , adopted August 30, 1972. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 28th day of March , 1973. The Great Western Railroad right-of-way forms the western boundary for both tracts. The 1.55 acre tract to the north will be retained by the Town as a storage facility for the machinery and equipment belonging to the Town of Windsor. The one acre tract to the south will be conveyed to the Public Service Company of Colorado as the site for relocation of it's present sub-station in the Town of Windsor. Plats of these tracts are included herewith for your files. For these purposes, we reauest an exemption from Section 2-1 of the Weld County Subdivision Regulation and any other pertinent sections.
