Home My WebLink About730535.tiff i i' / • RESOLUTION WHEREAS, a public hearing was held on October 23, 1973 in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of Adolph Coors, Golden, Colorado, requesting approval of site for the construction of a compressor station and related transmission facilities on the following described property, to-wit: A parcel of land situated in Section 14, Township 2 North, Range 64 West of the 6th P. M. , Weld County, Colorado, more particularly described as follows: Beginning at the Southeast corner of Section 14, Township 2 North, Range 64 West of the 6th P. M. , then North 660 feet, then West 660 feet, then South 660 feet, then East along the South Section Line 660 feet to the true point of beginning, containing ten (10) acres, more or less, and, WHEREAS, the petitioner was present, being represented by Mr. Lyle Bush and by counsel, Walker Miller, of Greeley, Colorado, and WHEREAS, there was no opposition to the request of petitioner for the location of said compressor station and related transmission facilities, and WHEREAS, the said requested location for said compressor station and related transmission facilities is located in an Agricultural Zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(2) of the Zoning Resolution of Weld County, said location for said compressor station and related transmission facilities may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Adolph Coors, Golden, Colorado, to locate a compressor station and related transmission facilities on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That petitioner shall proceed with due diligence to effect said construction of a compressor station and related transmission facilities and that it shall have up to one year from date hereof to begin the con- struction of such facilities; otherwise, the Board may, for good cause shown, on its own motion, revoke the permit herein granted. That such compressor station and related transmission facilities shall be limited to the items as shown on plans as submitted and attached hereto and made a part hereof by reference. 4. That all applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. Karner read the summary statement of application . There are 497 acres to be developed into single-family resi - c: _nces , a private air port , three business lots , two park sites and one airplane maintenance shop . They have a letter from Central Weld Water District stating they will serve the development . Planning staff recommends denial as the pro- posed use does not agree with the land use policy and al - though the proposed use is unusual , it is felt that it does not outweigh the land use policy ; does not agree with the surrounding zoning and agricultural uses ; and Health Dept . recommends denial on septic tanks . Also received two letters today ( 9-4-73 ) from Frederick and Dacono . Also a petition opposed to the development from current area residents (44 signatures ) . Dacono was concerned about several items in- cluding police and fire protection and proposed water supply line from Central Weld . Frederick was concerned about fire protection . Would like to visit with developers to discuss the matter. Opposition present included Mr . Eldon Kurtenbach , Ed Heim and Mrs . Osborne - main complaint being noise pollution , insufficient bussing , overcrowding of schools . Mr . Stern , representing Gordon Turkey Farms , also questioned their ability to continue raising poultry if an airport were allowed . Hand count showed three (3 ) present in favor ; and 14 opposed . There are two subdivisions located fairly close to the proposed development - Casa Grande and Enchanted Hills . MOTION : By Mr . Anderson , To take this matter under advisement . Second by Mr . Nix . A vote of "Aye" by Watson , Nix , Anderson , Heitman and Clark . Motion carried . DISCUSSION : Health Dept . will not approve the individual septic tanks . Possibly would put in an aereation system that the Health Dept . would approve . The FAA gave the Planning staff some forms to be filled out by any developers of an air park . Soils are sandy but sort of tight . It was felt the area had quite a few homes . The Tri -Town area was really not in favor of this .
