FOR EXPANSION OF A COMMERCIAL CATTLE FEED LOT OPERATION The petition of Boice Bros. , Route 2, Box 209, Greeley, Colorado, for expansion of an existing commercial cattle feed lot operation on the following described property, to-wit: The Northwest Quarter of the Southeast Quarter (NW-SE-1-) of Section Twenty-eight (28), Township Six (6) North, Range Sixty-six (66) West of the 6th P. M. , Weld County, Colorado, containing approximately 40 acres, more or less, came on for hearing on September 25, 1972, and the Board of County Commissioners of the County of Weld, having heard the testimony and evidence adduced upon said hearing, and having considered the testimony, evidence and statements and recommendations of the Weld County Planning Commission filed with said Board, and having made physical inspection of the above-described premises, and having carefully weighed the same, now makes the following findings: 1. The evidence and investigation shows that the inhabitants of the immediate vicinity and of the surrounding area are predominately opposed to having further expansion of an existing commercial cattle feed lot operation at the location of subject property. 2. The evidence and investigation shows that the expansion of said commercial cattle feed lot operation lies in a potential growth area and same would be too visible and unsightly and not indicative of good planning. 3. The evidence and investigation shows that the prevailing winds are from the northwest and expansion of said commercial cattle feed lot operation would materially add to air and odor pollution which presently is obnoxious and would become more obnoxious to the surrounding inhabitants, including the inhabitants downwind and immediately to the southeast of subject property in the Greeley area. 4. The evidence and investigation shows that there is a need for a study and development of a comprehensive plan for the greater Greeley area which would include the area in which said commercial cattle feed lot operation is located, and, therefore, any expansion of said existing commercial cattle feed lot operation at this time would not be in the best interest of good planning. 5. That each of the preceeding findings in and of themselves and independent of each other constitutes a separate and individual ground for denial of the request for expansion of said commercial cattle feed lot operation. PL0717 720346 r RESOLUTION WHEREAS, the Board of County Commissioners of the County of Weld has heard the application of Boice Bros. for permission to expand an existing commercial cattle feed yard operation upon a tract of land as hereinabove recited, and WHEREAS, said Board has made its findings on the evidence and testimony submitted to it, including independent investigation by the Board, which findings precede this Resolution and by reference are incorporated herein and made a part hereof, and WHEREAS, the said Board has carefully considered the petition, evidence and testimony and the recommendations of the Weld County Planning Commission, and has given the same such weight as it in its discretion deems proper, and is now fully advised in the premises; NOW, THEREFORE, BE IT RESOLVED, that the petition of Boice Bros. , Route 2, Box 209, Greeley, Colorado, for permission to expand an existing commercial cattle feed lot operation on the land indicated above be, and it hereby is denied on each of the grounds set forth in the Board's findings therein. The above and foregoing findings and resolution was, on motion duly made and seconded, adopted by the following vote on the 4th day of October, 1972. Burrous DISCUSSION : Mr. Burrous presented the plans of the proposed feedlot operation . The holding ponds will be constructed according to the A. C . S . office . A letter from the North Weld Water Assoc . regarding the availability of water is on file . Mr. Lorenson stated the staff' s recommendations are for approval , it agrees with the land use policy , is compatible with surrounding land use and zoning , it has Health Dept. approval and water is avail - able from North Weld Water District . If approved it should be subject to : a sealed lagoon as recommended by SCS and increas- ing the size to a total of 9. 7 acre feet to meet the Colo. Water Pollution standards as recommended by the Extension office . The lagoons to be located at least 400 ft . from the West bank of the Lone Tree Creek and a line installed to pump the waste up to the walking sprirller as required by the Health Dept. Construction to begin within 1 year of approval by the County Commissioners and limited to the pen size as indicated by the submitted plans . There should be screening along the entire south boundary peri - meter adjacent to the road for vegetation . Mr. Burrous questioned the 400 ft. requirement, stating they wanted to use the 'natural depressions . Mr. Woods voiced objections to Locating the screen- ing 20 ' inside the property line, or 50 ' from the center of the road . Mr. Lorenson stated a dike could be built in lieu the 400 ' set-back for the lagoons from the creek. 824 RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners subject to the recommendations of the Planning staff and and 50 ' ROW dedication with the trees being planted 20 ` inside the property line. Olhausen presented the proposed plans for the storage tank to increase their facilities . Stated there will be no habitation and is strictly a tank site . Height will be approx- imately 30 ft . Mr. Lorenson stated he recommended approval as additional water storage is needed to provide service to the water district , and should be subject to screen planting around the perimeter . Mr . Olhausen stated they have already agreed to the planting . RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners subject to the screening request . APPLICANT : Amoco Production Company CASE NUMBER : SUP #180 . tape 456 SUBJECT : Spindle field facility LOCATION : SW4 Sec 34 T2 R67 APPEARANCE : Lou Gaskins and John Lange DISCUSSION : Mr. Gaskins explained the necessity of the spindle field facility to take care of about 40 wells . Mr . Lorenson stated he is recommending approval of the application as it agrees with the land use policy and is compatible with surrounding land use • and zoning . Mr. Lorenson stated the Health Department may have some requirements . Mr . Paul stated they will need to get a per- mit to operate from the Pollution office and the State Pollution Control . Mr . Lange stated the items they will have on this are exempt under existing air pollution statutes and they have applied to the State Air Pollution Commission and they were granted an exemption . Mr. Lorenson recommended a planted screen around the perimeter and construction to begin within one year of approval by the Board of County Commissioners and limited to the items shown on the submitted plan . Mr. Gaskins voiced some ob- jection to the screening requested . RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners subject to Mr . Lorenson stated a letter from the North Weld Water District of their intent to serve water to this dairy. The • staff recommends approval as it agrees with the land use policy, • is compatible with surrounding land use 'and zoning , the design is judged adequate by the Extension agent. If approved it should be subject to any conditions required by the Health Dept. , construction of a lagoon as proposed , construction to begin within 1 year of approval by the Board of County Commissioners and limited to the pen size (159 ,000 sq . ft. ) and facilities as shown on the submitted plan . . Mr. Miller . stated according to his interpretation of the zoning regu- lations , dog kennels art a permitted use in an "A" zone . The kennel would be several hundred feet in all directions from any other house and a half-mile from the chicken oper- ation. Mr. Bailey was questionfwhether he will dwell on • the property. SUBJECT : Utility Installation Agreement DISCUSSION : Miss Telep stated that after revtewing the proposed agreement , she felt it should be considered at some other level., and perhaps a public hearing held . Mr. Anderson stated he felt it is something that could. be handled by the utilities themselves . MOTION : By Mr . Heitman to reject the proposal that the Utilities Installation Agreement be handled through the Planning Commission . After further discussion , Mr, Heitman withdrew his motion . MOTION : By Mr. Clark that no action be taken at this time and it is immature at this time . Second by Mr. Watson . A vote of "Aye" by Anderson , Clark , Heitman , Nix , Rothe and Watson . Motion carried . SUBJECT: Model Subdivision Ordinance for Incorporated Towns . DISCUSSION : Mr . Ohi presented the Model Subdivision Ordinance that would allow the incorporated towns to adopt .by, reference . The ordinance is based on the Weld County Subdivision Resolution so that subdivision regulations will be as Uniform as possible • 826 throughout the county. The model ordinance should be approved by both the Weld County Planning Commission and Board of County Commissioners as an official publication of Weld County to en- able towns in the county to adopt it by reference. . Miss Telep stated she would like to review the ordinance. RESOLUTION : tape 457 Be it therefore resolved to recommend approval subject to to the legality of such ordinance being approved by Miss Telep . Motion by Mr. Nix , second by Mr. Clark. SUBJECT : Letter from Jerry Bigbee DISCUSSION : Each member had received a letter from Mr. Bigbee asking review of single family housing tracts in place of the proposed mobile home park which he has previously submitted . The Com- mission instructed Mr. Lorenson to inform Mr. Bigbee in order to appear before the Planning Commission , an application and plat in the proper form would have to be submitted . APPLICANT : David Bailey - con ' t. DISCUSSION: There was further discussion regarding the location of the dog kennel applied for. It was agreed there should be a condition that the owner live on the property. RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commission subject to the permit be issued for the kennel after Mr. Bailey' s home is constructed and occupied . Motion by Mr. Watson , second by Mr. Clark. A vote of "Aye" by Anderson , Clark , Heitman , Rothe and Watson . Abstain by Nix . Motion carried. Barrell DISCUSSION : Mr. Barrell stated they have requested a variance for 803 the block lengths that are in excess of 1200' which he has dis- cussed with Mr . Lorenson . Central Weld is supplying the water. Mr. Ohi stated they have corrected all of the problems except for the block lengths . Stated a letter from the town of Fire- stone had been received expressing concern over this develop- ment. Improvements Agreement has been submitted and is subject to the approval of the County Engineer, also his approval of the street profile and drainage structures . The Utility Coordinating Board requested easements on several lots be changed from 10 ' to 15 ' , otherwise the Board approved the plat . This should be done before approval . The linen for the final plat has not been submitted . Mr. Ewing stated street profiles and drainage struct- ures meet specifications but a letter hadn ' t been submitted to the Planning Commission . CASE NUMBER: S-97 tape . 443 and 444 SUBJECT : Final plat of Indianhead Subdivision LOCATION : NEa Sec 18 T5 R67 APPEARANCE : Dale 0lhausen , David Shupe , Lynn Hammond , Warren Stobbe , Mr. Wilburn and Mr. Johnson DISCUSSION; 'Ir. Olhausen stated Water will be furnished by Little Thompson District, a letter is on file to this effect. The sewer has been approved by the State and local health Departments . There are two ditches running through the area and the owners have agreed to do what the ditch companies have requested . They had originally dedicated for use , a strip along U . S. 34. The high- way department had requested for expansion of 200' . Upon review, the owners wanted it to be designatd and not dedicated. They are 1 acre lots and will be served by a treatment facility. There has been some design around• a gas line that runs through the prop- erty. They have requested a variance on some of the lot frontages that are on a curve so they have shown the set-back. Jim Ohi read the recommendations of the staff: all items required for final plat have been submitted , sewage plan approved by Health Department, Subdivision Improvements Agreement and financial statement submitted , approved by the Utility Board subject to • cla•ification of provision of ROW for U .S . 34. On the plat the ROW is "designated" and not "dedicated" . Highway Dewtment has requested dedication which is required in Subdivisions Regulations Section 5 . 1 (3) . Section 3. 7 requires that arrangement for transfe of title of areas reserved for public areas be agreed upon prior to approval of the final plat. The amended plat was submitted after staff review and conference with subdividers and after dead line for submission of final plat for hearing date . Mr. Ohi read a: 15st of lots that are substandard . A variance has been request for Lot 1 , Blk 7 which is a through lot and prohibited by Subdivi sion Regulations , also on lot width for Lot 9 Blk 6. The easemen for the Greeley-Loveland Ditch Company has been removed south of Hopi Trail on amended plat. School District Re-5J has requested provision of 5 contiguous acres for future school site to accomo date the anticipated load of school children living in the area . 804 A letter of approval by the Farmer ' s Ditch Company has not been received. Reluctant approval of the plat has been given by the Greeley-Loveland Ditch Company. A list of requirements pertain- ing to drainage was read. Screening of sewage treatment pond and facilities should be provided . The FHA has declined to part- icipate in financing of the subdivision because in their opinion it is "rural , remote and premature". Mr. Hammond reviewed how they have reached this point for the benefit of some new members on the Commission . He took exception to the requests of the staff and felt the developers were beinn treated unfairly. Regarding the ROW on U. S. 34 , they are not willing to provide ROW without due compensation at un-subdivided land costs.. There was some discussion regarding the proper school district the parcel lies in. Mr. Howard Schwalm stated he is the owner of adjoining property and this was referred to the proper district, and that he is a former school board member. Mr. Schwalm voiced concern about the the future if this development is approved . He felt there would be opposition by the people living in the development when he spreads manure and has his crops dusted or there is a. problem with the sewage treatment , who in the development is going to be responsible to solve these problems . Mr. Anderson stated the engineers and Mr. Ohi should be able to meet and resolve most of the problems listed. Mr . Hammond stated they will be glad to meet with the Planning staff and try to re- solve the problems but they expect a decision within 30 days . No action was taken. APPLICANT : Russell A. Mr . Ohi read the staff' s com- ments that the request be denied . The proposal is not consistent with the Planning Commission ' s development policy. The present zoning is complementary to the surrounding area , and this would be spot zoning . Two temporary mobile home permits were issued to use during construction of two modulars for which building permits were issued . SUBJECT : Report submitted to the Regional Planning Commission DISCUSSION : Susan Shermack of Alan Voorhees Company reported on material that had been submitted to the Regional Planning Com- mission : Housing Inventory which covered housing conditions and housing needs ; Model Subdivision Regulations and Model Zoning Regulations . A three-year work program has been drawn up from 1972 to 1975 , also 22 future development plans for the municipalities in the County , 20 for Weld County and 2 for Larimer County and the Regional Development plan . The Regional Development plan is basi- cally a policy statement, goals and objectives directed toward those areas of concern to both Counties , such things as control . All •of these things are general in the extent that they do not apply to a single section of land or a specific use in a specific area . That was not the purpose of the plan . It is directed to- ward such things as a agricultural land and use as opposed to 806 development , the rural development , the urban development or whatever. At the Regional Planning Commission there were several things brought out as to what might be wrong or misleading type statements . These things are subject to negotitation. The State is fairly well satisfied with the work that has been done and feels that the Larimer-Weld Regional Planning Commission is in step with their goals . . This leads to official adoption of this plan that can then enable the Planning Commission to say to such proposals as Indianhead "your location does liot conform with our -Regional plan , it does' not conform .to our policies that have been legally adopted as document of the Planning Commission . There was discussion regarding the contract which started with the County but due to State financing , it was changed to a regional plan . Mr. Ohi stated the town plans will be certified by the Regional Planning Commission so that these towns can qualify for Federal funding for various projects. The current study is largely , concerned with developing tools to aid in the implementation of the Weld County policy in regard to agricultural land use , analysis of programs in other states aimed at protecting agricultural lands , analysis of land use policy in Weld County in reference to the policies of the State , collection and analysis of Agricultural Census data for the County. Creation of a system of maps to be used in decisions on land use . SUBJECT : Regional Work Program assignments DISCUSSION : Mr . Cruce stated .the State Planning Office would like to create a planning staff on the regional level . They felt that one man from the Larimer office and one from the Weld county office rather than having several work on the scope of services required by HUD. Mr . Cruce stated that both counties have well developed planning staffs and felt the work program could be implemented by staff members of, the two counties . SUBJECT : Letter from Ag Council DISCUSSION: A letter from Norman Carlson , President of the Agriculture Council regarding possible air pollution created by the approved location of Monfort' s to the dairies in the area , No action taken . SUBJECT : Building inspections for Keenesburg DISCUSSION : Mr. Lorenson read a recommendation from Jim Ohi regarding a contract and implementation of providing building inspections for the Town of Keenesburg , also other incorporated towns . Mr. Lorenson recommended that the legal council draw up a model contract under the guide lines set forth by Mr. Ohi for providing building inspect- ions . RESOLUTION: Be it therefore resolved to recommend to the Board of County Commissioners to adopt the proposed contract. Motion by Mr. Andersor second by Mr. Nix. SUBJECT : Revised Regional Work Program (A-95 review) TAPE 438 DISCUSSION : Ben Cruce reported the Regional Planning Commission has been allowed an extra $20 ,000 through HUD. This will be on the Regional Planning Commission agenda through an A-95 review. The additional money will be used for a study on sewer planning and comprehensive planning , plus adding to several projects already planned. It will help the planning staffs in upgrading the comprehensive plans for the small towns . Mr. Cruce stated he and Mr . Lorenson and Mr. Whitney have met with the State Planning Office and revised the work program. They added to open space , to drainage , sewer treatment planning . An item in the budget will be for the County to aid the small towns by providing building inspections . In kind services will be through the county offices , such as salaries ,equipment , etc . Each town after July 1 , 1972 to make an application for HUD money must have must have a Comprehensive Plan and pro- bably will have to have a work program. MOTION : By Mr. Clark to approve the additional funding and the work program attached to it. Second by Mr. Anderson . A unanimous vote of "Aye" Motion carried . SUBJECT : Highway TOPICS Program tape439 APPEARANCE : Al Chotvacs and Mike Majia DISCUSSION : Mr . Chotvacs explained the Highway "TOPICS" program, the Traffic Operations Program to Increase Capacity and Safety. The program consists of making traffic operation improvements and miscellaneous kinds of work that are considered minor items on regular urban highway construction projects . Mr. Chotvacs explained the types of projects the county can apply for. A map was presented showing the urban boundaries which can be ex- panded . The only expense to the County would be the plan draw- ing and the engineering . The State does the paper work , submits the plan , lets the bid , controls the construction and turns the road back to the County for maintenance. This program only applies to small projects and cannot extend for a long distance . Mr. Majia explained the County could take the the projects that fall in the list of items that can be covered and make it a TOPICS project and put priorities on them and the Highway Commission will act upon them . Various problem areas were dis- cussed . Mr. Lorenson appointed Mr. Watson to serve on a com- mittee with the County Engineer and the Highway Department to determine the problem areas to submit as a TOPICS project . Meeting adjourned . I am at a loss to understand any contemplation by the Planning Commission as to why such permit should be approved. From an environmental aspect, such permit should be and is totally unacceptable to resi- dents of the City of Greeley who, for at least three-fourths of the year, will be the re- cipients of the odors created by such a feedlot. It would indeed be ironical if the announced contemplated removal of the Monfort Lots from an area that adversely affects the residents of the City of Greeley, should be replaced in part by the present application. It should be noted that three of the major feedlot operators in this area, namely Monforts, Farrs and Websters, have seen fit to move either their entire operation or to expand their present operations to areas substantially east of the City of Greeley in order to minimize if not totally eliminate the objectional features of large quantities of cattle being fed in commercial lots. Granting the Application would be the equivalent of performing a great disservice to the residents of Greeley and its immediately surrounding communities and residential areas. I strongly urge you to deny the request. The Board of Realtors, more than any other organization, realizes . the tremendous importance of agriculture and the cattle feeding industry to the economy of Weld County and the nation, but we believe a shift of feed lot locations in the Weld County area has become evident in recent months, and we are of the opinion the area chosen will, because of pre- vailing winds, sparse population, water and soil conditions, be a much more desirable area in future years. It is hard for the Board of Realtors to comprehend the thinking of the Weld County Planning Commission and their recommendations to approve this feed lot, since the last two years have been spent in planning and zoning meetings to help correct poor planning and pollution; plus the fact that new zoning regulations have just this year been passed by the State of Colorado and the Weld County Commisioners to protect the en- vironment and provide protection for the citizens. Now they approve a feed lot in the midst of one of the most rapidly growing areas in the State of Colorado. We hope you will see fit to abide by the majority of the citizens' wishes in your decision, and see that the trend in feed lot location continues to the east and southeast of the metropolitan area of Weld County. Our reasons are as follows: • 1. Environmentally, the location is very poor due to a concentration of homes and small farms in the immediate area, as -well -as the close proximity to the residential growth pattern of Greeley. 2. Economically, this type of commercial feedlot would deter - any proposed industries which might be interested in the Greeley-Windsor area in the future. It would also decrease the value of the land in the area--some of which has been owned by family farmers for many years and who are relying on land appreciation for retirement. 3. Another factor involved is safety. Since Eastman Kodak has come into the area, the primary road is heavily travelled by commuters. The addition of cattle and feed trucks would create additional traffic hazards. CONCLUSION: At a time when so much public emphasis has been placed on ecology and the environment, there should be very serious consideration given to long-range as well as present dis- advantages. The Greeley area will have a very significant improvement with the move of the Monfort Feedlots--why turn right around and have the exact problem three miles away? The existing Boyce Bros. feedlot at Farmers Spur has been very negligent in its dust and odor control methods, which indicates a lack of water and feedlot housekeeping. Consequently, any additional cattle would compound this problem. Dear Mr. Lorenson: I have read with considerable interest the news article which appeared on the front page of the Greeley Daily Tribune on Monday, August 14, 1972 relating to the joint breakfast meeting of the Weld County Planning Commission and the City Planning Commission relating to the application of Boice Bros. to construct a feedlot in the area North of Farmers Spur. In view of what appears to be an erroneous item appearing in this news article I deem it necessary to take this opportunity to correct this matter. The news article states that you, as the County Planning Director, stated as follows: "Burman Lorenson, county planning director, explained that the feedlot, which is planned eventually to cover 75 acres and hold 10,000 cattle, would be located about 14 miles south- west of Seeley Lake and directly north of Farmers Spur. " As you will recall, at the time of the Planning Commission hearing on Wednesday, August 9, 1972, I specifically remarked that any statements relating to the area covering 75 acres appearing in material previously submitted was erroneous and that the feedlot area as planned would encompass only 40 acres and not 75 acres . It would appear from an examination of the maps that the proposed feedlot is located approximately 24 miles South and not merely 12 miles South of Seeley Lake. According to information provided to me the proposed feedlot will be over three (3) miles from the present city limits of the City of Greeley. In order that there will be no confusion concerning this matter, the present feedlot facilities operated by K-Bar Corporation, d/b/a M & M Feedlots in which Boice Mr. Burman Lorenson -2- August 16, 1972 Bros. are the principal stockholders, consists of 36 acres . The present feedlot of 36 acres consists of 26 feeding pens and 6 sick and holding pens, or a total of 32 pens with capacity of 8,000 cattle. The newly proposed feedlot for which application has been made by Boice Bros . will be constructed, if the application is granted, in the NW* of the SE* of Section 28, Township 6 North, Range 66 West of the 6th P.M. in an area com- prising 40 acres. The proposed feedlot will be located in an area 1200 feet by 1200 feet. The proposed feedlot will consist of 27 feeding pens and 6 sick and holding pens, with a capacity of 10,000 cattle. As presently designed and in accordance with the plans submitted to the Commission, the livestock corrals are 200 feet by 200 feet. The feedlot area will include, in addition to the pens, livestock scales, dipping vats and loading chutes . As indicated at the time of the recent hearing, each of the 27 feeding pens will have cement slabs next to the feed bunks and each of the pens will have an underground sprinkling system for purposes of dust control as well as an underground tile system to provide for runoff to the lagoon. Each of the alleyways will be paved and all of the feed bunks will be of cement construction. The lagoon which has been designed as an intregal part of the feedlot operation will be located approximately in the center of the feedlot area and the drainage from all of the pens will be into the lagoon area. The lagoon as designed will be approximately 1200 feet in length lying North and South, 80 feet in width and 8 feet in depth. The plans of the feedlot have been approved by the Weld County Health Department and the soil content of the area involved has been examined and approved by the Soil Conservation Service. As you and other members of the Planning Commission are fully aware, dust control problems are as great a concern to feedlot operators as they are to nearby residents. Boice Bros. has spent a great deal of time examining the ecological and environmental factors involved in the construction of this feed- lot and they have attempted to provide for sound, comprehensive planning in that regard, including the underground sprinkler system, the underground tile system, cement slabs, paved alleyways and concrete feed bunks, as well as a sealed lagoon system. It is also necessary to call to your attention that no ditches, streams or rivers intercept either the 40 acres of the proposed feedlot or the balance of the 120 acres which comprises the remainder of the farm. I also call your attention to the fact that the remaining 120 acres of the farm will be devoted to irrigated farming practices . As you are also fully aware, there are numerous dairying and feedlot operations now located in the area lying North and West of the City of Greeley in addition Mr. Burman Lorenson -3- August 16, 1972 to the Monfort operation. The area of the proposed feedlot involved in this application is located in an A-Agricultural zone. Numerous other dairying operations and feedlot operations in the immediate vicinity are engaged in similar livestock practices, but in many instances without the care and at- tention to the ecological factors designed into this proposed feedlot. It is quite apparent from an examination of the area that the proposed feedlot is fully compatable with existing and surrounding land use. Weld County is justifably proud of its agricultural heritage and livestock as a mainstay of its agricultural base. There are definite indications that more and more feeding operations will move to our region of the country with its favorable climatic conditions. It is the task of local government in Weld County to insure that the decisions made in regard to eco- nomic operations in the county consider a wide range of alternatives and make decisions which reflect fair solutions to both private in- terests and the general welfare of the inhabitants of the county. Good decisions require good information upon which to base decisions. As a result 8f previous public concern around the charac- teristics of feedlot operations, information has been gathered to be utilized by public decision-makers. Odor Control is at times a serious problem with cattle feedlot operations. The odor generated from the anaerobic decomposition of manure which usually occurs on the inside of manure piles is un- pleasant to most people. When piles are disturbed, odors are severe. The occurrence and intensity of odors at a location are the result of a number of factors. The most important are the sources of odors, the area topography, and the meteorological factors of wind direction, wind speed, temperature and humidity. - Meteorological conditions most directly influence the effects of odor emissions. Wind direction determines odor travel, wind speed determines dispersion rate and pattern, and temperature affects rate of detection. At low Wind speeds odors may be more concentrated, due to stagnation. Turbulent mixing will disperse odors over relatively ' short distances or result in "skips" with odorants traveling at vary- ing elevations then return to ground level some distance from the source. In order to predict the consequences of the operation of a feedlot at a specific location, data must be collected which applies • -2- to the location. Dr. Glen Cobb, a meteorologist at the University of Northern Colorado, has collected meteorological data for the city of Greeley and surrounding area. His findings will be heavily relied upon..in this study. In addition, other. persons and organi- zations have provided inputs. The report is a compilation of the information provided by a number of sources familiar with the local problems of feedlot operation. Information on winds, topography, temperatures, local - meteorological patterns, and air pollution problems was provided by a number of experts at both the University of Northern Colorado . and Colorado State University. Further information was supplied by various State and local agencies. Prevailing Winds • The data used in this presentation was originally prepared from instruments located at 23rd Avenue, Greeley, Colorado, from September 1968 to August 1970. "Prevailing Winds" in the extreme do not exist in this area. The months of February, March, May, and June are the most extreme in terms of the wind blowing from one direction. Even in those months, however, the winds blow from no one direction more than 30% of the time. Applying Dr. Cobb's data to the proposed location.. of the feed- ing operation in Section 28, the following would .result in regard to .wind direction and air pollution in Greeley: Month of the Year Air Pollution in Greeley January Bad February Bad March Good* April Bad • May Good June Relatively Good July Relatively Good August Relatively Good September Relatively Good October Bad November Bad December Bad - . * When air pollution conditions in terms of prevailing wind are good for Greeley, however, they will be very bad for the populated areas around Windsor and the Eastman Kodak operation. -4- Drainage Winds - Topographical conditions drastically effect movements of air. Cooler air will move or "tumble" from higher .elevations to lower (in this case from Section ,28 down to the Poudre River). As the cooler air moves southward, it will carry the pollution with it. (This phenomenon explains the extremely cold temperatures which characterize Fraser, Colorado. Fraser is located in Middle Park in the base -of a large mountain valley. Temperatures in daylight hours may approximate those recorded in communities near Fraser's location. Temperatures recorded at night in Fraser are drastically different. As the sun goes down and temperatures cool, the cooling air in the valley, which is heavier than warmer air, "tumbles" down the sides of the mountains, and comes to rest in the lower regions of the valley. ) Tile the site of the proposed feedlot and the river bed occupy less drastic differentials in elevation, the same . tumbling air movements will characterize the situation. These conditions will be accentuated by the "yo-yo effect" of winds. moving along the river basin in an easterly direction (toward Greeley) in the mornings and westward (toward Windsor and •Eastman Kodak) in the afternoons. For light wind conditions (3-4 miles per hour) any air pollution in the air will move along a course paralleling the Poudre River. Light wind conditions normally pre- vail in this area. • Inversion Conditions The inversion conditions which result from Greeley's location • " in .a topographical basin will apply to any feedlot located in the basin area. Inversions develop when cold air is trapped beneath warm, an equilibrium develops, the characteristic "mixing of air currents cannot take place, and pollution stagnation results. In- . versions commonly develop in the Greeley area in the winter months. The prevailing winds data previously discussed indicates that the winter months will be the worst in terms of air pollution in Greeley from the proposed feedlot. It follows, then, that conditions of air pollution will become very severe during the winter months when -5- prevailing winds come from the North and Northwest, and inversions develop which trap the polluted air over Greeley. In terms of relative comparison, if the operation in Section 28 enlarged to—a 30,000 head capacity, the air pollution that resulted would be as bad as the current Monfort operation's effect upon Greeley. Conclusion Meteorological data indicates that, from the standpoint of air pollution, the proposed feeding operation in Section 28, along the north bank of the Poudre River, would have adverse effects upon air pollution conditions among the citizens of Greeley and Windsor. The decision to allow or not allow the proposed facility must be based upon not only air pollution data, but other criteria including drainage information, economic considerations, and a view of the alternatives available to the private interests involved. The fairness of the decision should be interpreted in relation to the public's welfare, and the economic and environmental •future of Weld County. I have not talked with any of the County Planning Board members to inquire into their reasons for approving the feedlot, but in my judgment there seems to be so many reasons, for the long—term benefit of the county, to oppose the feedlot in that location that I surely do not understand their decision. We are so fortunate that Mr. Monfort, by his own decision has chosen to move his feedlot further from Greeley that it would be a terrible shame to turn right around and approve another. I certainly don't feel we should try to displace anyone in the cattle-feeding business, but I strongly feel we should not permit any new operations or expansion of existing operations so close to Greeley. The new feedlot would be right in the line of growth between Greeley and Windsor and if we are to believe the meteorologists, one city or the other will - be in the prevailing wind direction bringing the feedlot odor almost all of the time. I spent most of my summers as I grew up working on my Grandfather's farm east of Greeley, and do not find ordinary barnyard odors offensive, but I surely do find the concentrated odors from a feedlot offensive and we cannot ignore the fact that most other people feel the same way. This fact has prevented many people and many businesses from settling around Greeley in the past, and if we allow this new feedlot to locate north—west of Greeley, we are going to be hurt economically in the long run.
