HomeMy WebLinkAbout730567.tiff LW< '56 r, RESOLUTION WHEREAS, a public hearing was scheduled on August 27, 1973, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of Kenneth Nelson, Johnstown, Colorado, requesting approval of site for a dog kennel oper- ation on the following described property, to-wit: A tract of land located in the South Half of the North- west Quarter (SZNW4) of Section Eight (8), Township Four (4) North, Range Sixty-eight (68) West of the Sixth (6th) P. M. , Weld County, Colorado, and more particularly described as follows: Beginning at the Northwest Corner of said Section 8; thence continuing South along the West line of said Section a distance of 2, 140 feet to a point; thence East and parallel to the North line of said Section 8, a distance of 1, 000 feet to a point; thence South and parallel to the West line of said Section 8 a distance of 500 feet to a point; thence West and parallel to the North line of said Section 8 a distance of 1, 000 feet to a point on the West line of said Section 8; thence North along the West line of said Section 8 a distance of 500 feet to the true point of beginning, containing 11 acres, more or less, and, WHEREAS, petitioner was neither present nor represented by anyone in pursuing his request for location of said dog kennel operation, and WHEREAS, according to Section 3. 3(3) of the Zoning Resolution of Weld County, said dog kennel operation may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that because the applicant, Kenneth Nelson, by his absence, was not sufficiently interested in obtaining a permit to locate a dog kennel operation on the premises indicated above, the Board has no alternative but to deny the application; and consequently, the application is hereby denied. Watson call , the meeting to order . SUBJECT : Group Assembly Ragulations Tape 491 DISCUSSION : Mr . Fortner requested the Planning Commission to give a definition of Group Assemblies . In the present proposed regulation it is defined as an assembly of 500 or more people which continues or is expected to continue for two (2 ) or more consecutive hours . The County Attorney has suggested a figure of an assembly of 25 people for a period of 5 or 10 hours . Also attached to this draft are the standards and regulations set up by the State . Review and vote at next hearing . SUBJECT : Regional Studies , End Reports Tape 491 DISCUSSION : Mr . Fortner handed out copies of the following reports : Functional Water and Sewer Report ; Open Space Report ; Housing Study; Regional Development Plan ; Drainage Study ; Ft . Lupton General Plan ; Platteville General Plan ; Economic Study . Also working on Soil Classifications and update of base maps . The primary goal of these studies is to get the Regional Planning Commission certified to do A-95 reviews . It is not really necessary to vote on these , they are merely for general infor- mation . SUBJECT : Definition of a Farm Use Feed Lot Tape 492 DISCUSSION : Mrs . Lee asked the Planning Commission for a firm defi - nition of what could be considered a farm feed lot . On farm use feedlots , they could possibly skip the Special Use Permit process and just follow Health Department regulations and pollution standards . Mrs . Lee read letter from Mr . Witwer , Mr. Booth ' s attorney , stating that his client will construct a retention pond of an appropriate size , slope and depth to insure that no runoff from the feedlot will reach the creek . Possibly could have a special form for farm use feedlots and refer them to the Health Department for checking . Biggest ob- jection to applying for the S .U . P . Nix presented his field check report . Area directly west of existing feedlot appears to be new site for expansion . Contacted Larimer-Weld people concerning ditch , no objections or problems . Planning staff recommends approval because it agrees with land use policy and it agrees with surrounding land use and zoning . Approval subject to : 1 ) Health Dept . comments ; 2 ) Soil Con- servation comments ; 3 ) Extension Office comments ; 4) Moving south line of the proposed pen north to conform with 660 ' setback From Johnson Steele residence ; and 5 ) Construction beginning within one year ' s time from date of approval and limited to pen size indicdted on the revised plans . Number 4 is because the zoning regulations presently state that com- mercial feedlots must stay bark 660 ' from a residence . It was noted that the structure in question was not a residence . Number 4 stricken From recommendations . Health Dept . comments stated they did recommend approval . Presently has 1 ,400 head , wants to increase it to 3 ,000 total . 914 RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners subject to Planning staff ' s recom- mendations deleting #4 and also written permission from the Ditch Co . Motion by Mr . Weigand , seconded by Mr . Rothe . Hack is actually applying for the permit as he is buying the property from Kenneth Nelson . There is an existing feedlot which Mr . Hack stated would be removed . Building will be utilized as part of the kennel . Would have about 32 dogs . Has verbal approval of neighbors . Buying the 80 acres , but - only requesting the S .U . P . for 11 acres . Legal description needs changing on the map . Planning staff recommends approval because it agrees with land use policy and it agrees with surrounding land use and zoning . Approval subject to : 1 ) Legal approved by the Co . Attorney ; 2 ) Health Dept . comments ; and 3 ) Construction beginning within one year ' s time from date of approval and limited to 32 dogs as stipulated in the appli - cation . Health Dept . recommends approval subject to disposal of dead animals by cremation after obtaining proper permits . RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners subject to Planning staff ' s recom- mendations and Health Dept . recommendations . Motion by Mr . SUBJECT : West Hill -N-Park Tape 492 and 493 APPEARANCE : John Haley and John Benson , NHPQ DISCUSSION : Mr . Haley stated he would like to answer some of the "Subjects to" set out at the June 19th Planning Commission hearing . Referring to Item #1 , Mr . Haley stated that this re- port was received just prior to the Planning Commission ' s last meeting . Also , when the test was taken , the system was only operating at half its capacity . This has since been corrected . The sewage treatment facility is now working at full capacity . Just recently completed and have had approved by all Health officials an expansion of the Hill -N-Park lagoon . It is a 10 ' oxidation pond next to an existing 5 ' oxidation pond . Can operate it as two 5 ' deep oxidation ponds . As soon as they become full , either raise a new pond to a 10 ' level and use second pond as a polishing pond , or continue to operate on the two 5 ' ponds . Whatever the Health Dept . recommends . As soon as the existing facilities are exceeded , next operation will be to hook up and operate two floating aerators on the large ponds . Will also have chlorination facilities . There will be a letter from the Colorado Water Pollution Control signed by Ron Schyler , District Engineer approving this . Referring to Item #2 (a ) , same as Item #1 . Item #2 ( b) , facilities will be installed before they are needed by the increased number of homes . 915 • Item #2 (c ) , The staff has a copy of letter from Arrowhead to Hill -N-Park Corporation that states there are 190 taps available to be used . Also has a letter from Central Weld saying they will serve the area if necessary . Item #2 (d ) , this was submitted to the County Engineer over a month ago . The County Engineer has been too busy to give his approval before this . However, do have his verbal approval of both the variance and drainage plan . Will submit letter of approval as soon as possible . Item #2 (d ) ( 1 ) , has been provided . Item #2 (d ) (2 ) , has been done . Item #2 (e ) , zoning plat was made and corrected according to field measurements . Item #2(f) , this has been accomplished . Item #2 (g ) , needed cost estimate approved by County Engineer . The information was submitted to that office and have verbal ap- proval for the cost estimates from Co . Engineer . Have completed form with them today. Item #2 ( h ) , submitted and approved prior to June 19th hearing . Item #2 ( i ) , owners have committed them- selves to the cost of maintenance of the area until such time as they have sold out their entire interest . At that time , the property owners ' association should and would be created and would create their own bylaws . Item #2 (j ) , have removed four units to increase the open space to 9 . 37 acres for parks and recreation . There are 4 . 67 acres of storage and landscape buffer . Item #2 ( k ) , south along the section line, which is 47th Avenue , cannot get any response from the owner of the land to the west . Do have 30 ' and could condemn the 20 ' if it would be of beneficial use to the public . All the other property owners have given 100 ' right of way . Along 47th Avenue , Hill - N-Park has also designated a 30 ' buffer zone . SUBJECT : Jim Booth - Feedlot MOTION : By Mr. Weigand to have Carol Lee check and if Mr .
