M. , Weld County, Colorado, and WHEREAS, upon appeal from the decision of the Board of County Commissioners, Weld County, Colorado, by N. J. M. , and Section 3, Township 2 North, Range 61 West of the Sixth P. M. , all in Weld County, Colorado, came on for hearing March 22, 1971 at 2:00 o'clock P. M. in the chambers of the Board of County Commissioners of Weld County, Colorado, and the Board of County Commissioners of the County of Weld, State of Colorado, having heard the testimony and evidence adduced upon said hearing, and having heard the testimony, evidence, petitions and remonstrances filed with said Board, and having carefully weighed the same, now makes the following findings: 1. The evidence and investigation shows that said hearing, petition for zone change, is more in the nature of petition requesting approval of site for disposal of sludge and/or sewage products. 2. The evidence and investigation shows that the inhabitants of the immediate vicinity of the area whereat said sludge deposit facility is sought to be installed, are unanimously opposed to the installation of such facility. 3. The evidence and investigation shows that the location of such sludge deposit facility would be a source of pollution of the underground water supply in the area. 4. That each of the preceding findings in and of themselves and independent of each other constitutes a separate and individual ground for denial of the change of zone, or in the alternative, a denial of location as a site for sludge and/or sewage disposal facility. M., with the following members present: MARSHALL H. ANDERSON COMMISSIONER GLENN K. BILLINGS COMMISSIONER HARRY S. ASHLEY COMMISSIONER ANN SPOMER COUNTY CLERK SAMUEL S. TELEP COUNTY ATTORNEY The minutes of the 7th instant were read, and there being no corrections or objections thereto, same were ordered approved. The following resolutions were presented: RESOLUTION WHEREAS, the Colorado State Department of Social Services, in Civil Action No. 21492, in the District Court in and for the County of Weld, State of Colorado, has filed an action against the Board of County Commissioners, Weld County, Colorado, seeking: 1. Judicial enforcement of July 1, 1971 order of the State Department of Social Services (copy of findings and order attached for ready reference). 2. For temporary restraining order restraining defendant, Weld County, from not complying with the order of tv� plaintiff (State Department of Social Services). 3. For a declaratory judgment interpreting state statutes in question, and WHEREAS, the statutory mill levy rate for welfare purposes in Weld County is 3 mills of its real property valuation, and WHEREAS, Weld County, for the calendar year 1971, did levy for welfare purposes in Weld County a levy of 3 mills on all of the real property in Weld County pursuant to 119-3-6, C. R. S. 1963, and WHEREAS, funds derived from said 3 mill levy will be exhausted by the end of July, 1971, and WHEREAS, Weld County did not request authorization for a levy in excess of the mill levy rate as set forth in 119-3-6(4), C. R. S. 1963, and WHEREAS, Weld County is of the opinion that it cannot legally be ordered to exceed its statutory limit of 3 mills for welfare purposes in the County, and that to do so will be illegal and in violation of the law, and WHEREAS, most of the counties in the State of Colorado are in the same or similar circumstances as is Weld County with respect to their welfare problems, and WHEREAS, decision in the pending lawsuit against Weld County will affect every county in the State of Colorado. NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, Weld County, Colorado, and it hereby respectfully requests the State Association of County Commissioners direct its legal counsel, J. County Attorney BOARD OF COUNTY COMMISSIONERS TO CONVENE AS THE BOARD OF EQUALIZATION: WHEREAS, as provided by Colorado Revised Statutes, 1963, Chapter 137, Article 8,the Board of County Commissioners shall constitute a Board of Equalization for the adjustment and equalization of assessments among the several taxpayers of Weld County, and to hear appeals from the determination of said assessments fixed and made by the County Assessor, and WHEREAS, said Board of Equalization shall convene on the second Monday in July, and thereafter convene and adjourn on each day following to end on the last business day of July.
