HomeMy WebLinkAbout720363.tiff 1 - 1 � , RESOLUTION WHEREAS, a public hearing was held on October 16, 1972 in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of William R. Koehler, Route 1, Box 48, Greeley, Colorado, requesting permission for ex- pansion of an existing cattle feed lot operation on the following described property, to-wit: I The East Half of the East Half of the Northeast Quarter of the Southeast Quarter (EZEzNE4SE4) of Section Twenty-eight (28), Township Six (6) North, Range Sixty-five (65) West of the 6th P. M. , Weld County, Colorado, and WHEREAS, the petitioner was present, and WHEREAS, there was no opposition to the request of petitioner for the expansion of said cattle feed lot operation, and WHEREAS, the said requested cattle feed lot operation is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(3)(c) of the Zoning Resolution of Weld County, said cattle feed lot operation or any expansion thereof may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner, and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of William R. Koehler, Route 1, Box 48, Greeley, Colorado, for expansion of an existing cattle feed lot operation on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That petitioner shall proceed with due diligence to expand said cattle feed lot operation and shall have up to one year from date hereof to begin construction for the expansion thereof. 3. That when expansion of said cattle feed lot operation is completed, same shall contain, in addition to the present facilities, four additional cattle pens, all as shown on plat as submitted and made a part hereof by reference. 4. That petitioner shall construct sealed lagoon or lagoons as proposed. 5. All applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the zoning resolutions of Weld County, Colorado. Burrous DISCUSSION : Mr. Burrous presented the plans of the proposed feedlot operation . The holding ponds will be constructed according to the A. C . S . office . A letter from the North Weld Water Assoc . regarding the availability of water is on file . Mr . Lorenson stated the staff' s recommendations are for approval , it agrees with the land use policy , is compatible with surrounding land use and zoning , it has Health Dept. approval and water is avail - able from North Weld Water District . If approved it should be subject to : a sealed lagoon as recommended by SCS and increas- ing the size to a total of 9 . 7 acre feet to meet the Colo . Water Pollution standards as recommended by the Extension office . The lagoons to be located at least 400 ft . from the West bank of the Lone Tree Creek and a line installed to pump the waste up to the walking sprirler as required by the Health Dept. Construction tai begin within 1 year of approval by the County Commissioners and limited to the pen size as indicated by the submitted plans . There should be screening along the entire south boundary peri - meter adjacent to the road for vegetation . Mr. Burrous questioned the 400 ft . requirement, stating they wanted to use the •natural depressions . Mr. Woods voiced objections to locating the screen- ing 20 ' inside the property line, or 50 ' from the center of the road . Mr. Lorenson stated a dike could be built in lieu the 400' set-back for the lagoons from the creek . 824 • RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners subject to the recommendations of the Planning staff and and 50 ' ROW dedication with the trees being planted 20' inside the property line . APPLICANT': Little Thompson Water District CASE NUMBER : SUP #177 ' tape 456 SUBJECT : Water storage reservoir LOCATION : NE4 Sec 4 T4 R68 APPEARANCE : Dale Olhausen DISCUSSION : Mr. Olhausen presented the proposed plans for the storage tank to increase their facilities . Stated there will be no habitation and is strictly a tank site . Height will be approx- imately 30 ft . Mr. Lorenson stated he recommended approval as additional water storage is needed to provide service to the water district , and should be subject to screen planting around the perimeter . Mr . Olhausen stated they have already agreed to the planting . RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners subject to the screening request. APPLICANT : Amoco Production Company CASE NUMBER : SUP #180 tape 456 SUBJECT : Spindle field facility LOCATION : SW4 Sec 34 T2 R67 APPEARANCE : Lou Gaskins and John Lange DISCUSSION : Mr. Gaskins explained the necessity of the spindle field facility to take care of about 40 wells . Mr. Lorenson stated he is recommending approval of the application as it agrees with the land use policy and is compatible with surrounding land use and zoning . Mr . Lorenson .stated the Health Department may have some requirements . Mr . Paul stated they will need to get a per- mit to operate from the Pollution office and the State Pollution Control . Mr . Lange stated the items they will have on this are exempt under existing air pollution statutes and they have applied to the State Air Pollution Commission and they were granted an exemption . Mr. Lorenson recommended a planted screen around the perimeter and construction to begin within one year of approval by the Board of County Commissioners and limited to the items shown on the submitted plan . Mr. Gaskins voiced some ob- jection to the screening requested . RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners subject to Mr . The staff recommends approval as it agrees with the land use policy, is compatible with surrounding land useeand zoning , the design is judged adequate by the Extension agent . If approved it should be subject to any conditions required by the Health Dept. , construction of a lagoon as proposed , construction to begin within 1 year of approval by the Board of County Commissioners and limited to the pen size (159,000 sq . ft. ) and facilities as shown on the submitted plan . Mr. Miller stated according to his interpretation of the zoning regu- lations , dog kennels are a permitted use in an "A" zone. The kennel would be several hundred feet in all directions from any other house and a half-mile from the chicken oper- ation . Mr. Bailey was questionaWhether he will dwell on the property. SUBJECT: Utility Installatton Agreement DISCUSSION : Miss Telep stated that after reviewing the proposed agreement , she felt it should be considered at some other level., and perhaps a public hearing held . Mr. Anderson stated he felt it is something that could, be handled by the utilities themselves . MOTION : By Mr . Heitman to reject the proposal that the Utilities Installation Agreement be handled through the Planning Commission . After further discussion , Mr. Heitman withdrew his motion . MOTION : By Mr. Clark that no action be taken at this time and it is immature at this time . Second by Mr. Watson . A vote of "Aye" by Anderson , Clark , Heitman , Nix , Rothe and Watson . Motion carried . SUBJECT: Model Subdivision Ordinance for Incorporated Towns . DISCUSSION : Mr . Ohi presented the Model Subdivision Ordinance that would allow the incorporated towns to adopt . by reference. The ordinance is based on the Weld County Subdivision Resolution so that subdivision regulations will be as uniform as possible \ 826 throughout the county. The model ordinance should be approved by both the Weld County Planning Commission and Board of County Commissioners as an official publication of Weld County to en- able towns in the county to adopt it by reference . . Miss Telep stated she would like to reView the ordinance, RESOLUTION : tape 457 Be it therefore resolved to recommend approval subject to to the legality of such ordinance being approved by Miss Telep . SUBJECT : Letter from Jerry Bigbee DISCUSSION : Each member had received a letter from Mr. Bigbee asking review of .single family housing tracts in place of the proposed mobile home park which he has previously submitted . The Com- mission instructed Mr. Lorenson to inform Mr. Bigbee in order to appear before the Planning Commission , an application and plat in the proper form would have to be submitted . APPLICANT : David Bailey - con ' t. DISCUSSION : There was further discussion regarding the location of the dog kennel applied for. It was agreed there should be a condition that the owner live on the property. RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commission subject to the permit be issued for the kennel after Mr. Bailey ' s home is constructed and occupied . Motion by Mr. Watson , second by Mr. Clark . A vote of "Aye" by Anderson , Clark , Heitman , Rothe and Watson . Abstain by Nix . Motion carried. Eastman stated it has been approved by the Health Dept. There was discussion regarding the proposed private road and seepage in the area . Mr. Lorenson explained the lots are small but are planned in conjunction with the pasture areas . It was suggested a water table study be made. Mr. Lorenson suggested this type of .thing might serve as a buffer area between the growth of the town of Eaton and the intense agricultural uses , such as feedlots , etc. It was noted all the percolation tests were made in the pasture areas and should be in the area where the resi- dents would be built . MOTION : By Mr. Heitman to table the matter until percolation tests are made in this area and refer it back to the Health Dept. Mr. Eastman stated there should be adequate covenants covering the open space , batns etc . Mr. Heitman withdrew his motion . RESOLUTION: Be it therefore resolved to recommend denial to the Board of County Commissioners due to the seepage in the area, the perc- olation tests are not in the area of the homes and the proposed private road. Motion by Mr. Heitman, second by Mr. Nix. A vote of "Aye" by Anderson , Heitman , Nix and Watson. Motion carried . APPLICANT: Interladco , Inc . CASE NUMBER : S-97 tape 449 SUBJECT: Final plat of Indianhead Subdivision LOCATION : NE4 Sec 18 T5 R67 DISCUSSION : Mr. Ohi stated the planning staff recommends denial of the plat . Reasons for denial were read . A letter from the ditch company had been received and there are still problems to be worked out. They have refused to dedicate ROW for highway 34 . On the preliminary plat was shown a dedication for 100 ' of ROW. . . inaudible . , there was discussion regarding the proposed sewage facility and the maintenance of the plant. Letters have been received from adjacent farmers stating they are concerned about the run-off and possible seepage. . 815 - - V. • RESOLUTION : • Be it therefore resolved to recommend denial to the Board of County Commissioners based upon existing regulations and conformance to them. Motion carried. , ' SUBJECT: Existing regulation regarding 660 ' set-back from State Highways DISCUSSION : There was• discussion regarding the set-back from State highways for feeding operations . • SUBJECT: Planning Contract with Windsor DISCUSSION : Mr. Anderson stated the Windsor Planning Commission . approved an extension of the contract with the Planning staff • .for a planning consultant for Windsor subject to the approval of the County Commissioners . This was a three month contract and they feel they need more time to evaluate the cost for the Plan- ning Services . A discussion followed regarding request for exempt- tion of filing a minor subdivision application in this instance . It was agreed parcels for public utilities where no water or sewer is required , should be exempt and .each stand on its own merit. This type of use will requite a special use permit and observe the proper set-backs . Mr, Eastman presented the material submitted for the Special Use Permit. The facility,-will have to have FAA and FCC approVal . There are 6 lots in the proposed subaH division. Mr. Ohl read the recommendations of the planning staff: Utility Board has approved the plat, a variance for the 2" water line and for overhead powerlines was requested. Gas will be by propane tanks and all lots will be served from existing County road . The area is proposed for agricultural use in the Greeley Compre- hensive Plan which is presently zoned "E" Estates . The proposed subdivision meets the lot area and lot width requirements for an • "E" zone. Existing structures in proposed lots 1 and 2 dp not meet minimum setback requirements . Centerline of Bliss Lateral . should be shown on plat. Bliss Laterial is requesting a 25' ease- , • ment along east ROW and access easements at both ends of tract. Mr. Houtchens stated Mr. Vornholt is secretary of- the ditch company and he is representing the ditch company. Mr. Houtchens stated the ditch abuts the back end of the lots and questioned how to make the ditch and residential units compatible. The Aitch company is requesting the easement in order to properly maintain the ditch. Mr. Freese felt the request was excessive of what would be nec- essary to maintain the ditch. A letter has been received from the County Engineer approving the drainage plan . Olhausen read a letter regarding the comments presented by Mr. Ohi ht the ': previous meeting. Mr. Chotvacs stated in. regards to the. dedication Mr. Capron of the .Highway Department still feels that the Highway' Department. would request that the 150 ' be dedicated for highway improvement, however they would be amenable to any proposal that they could make and be willing to take it into consideration . He thought consideration should be to the highways . Mr. Chotvacs stated that 34 is a major thoroughfare and access should be con- trolled by some means . Mr. Stobbe stated there is no way they can afford to dedicate the ROW because of economics . Mr. Hammond • stated they would ,agree to a designation on the plat and not :. platted into lots and they are ,not trying to increase the value of this designated area. There was discussion regarding substandard : lots with less than required lot frontage. These would require . excessive front yard set-back to meet the minimum required lot . frontage . Mr. Shupe stated they have a meeting scheduled with • the ditch company to' work out the details of an agreement with . them. A letter from Wm. Southard , attorney for the ditch company, was read, Cindy Telep read a note from John Hovtchens , attorney for Ray Amen , who objects to the development as it will result in comments from the inhabitants .of the development regarding his cattle feeding operation to the south ofthe area.
