HomeMy WebLinkAbout740350.tiff RESOLUTION WHEREAS, a public hearing was held on May 13, 1974, and the chambers of the Board of County Commissioners of Weld County, Colorado, for the purpose of hearing the petition of Edgar Trow, 6922 Magnolia Street, Commerce City, Colorado, requesting approval of site for a dog kennel operation on the following described property, to-wit: A tract of land located in the Southwest Quarter (SW4) of Section Twenty-Eight (28), Township Two (2) North Range Sixty-Seven (67) West of the Sixth P.M., Weld County, Colorado, and more particularly described as follows: Beginning at the Southwest Corner of said Section Twenty- Eight (28), thence east along the South line of said Sec- tion 28, a distance of 1293. 53 feet to the true point of beginning; thence continuing east along the south line of said Section 28, a distance of 661. 11 feet to a point; thence north 00° 17' east a distance of 1314. 73 feet to a point; thence south 89° 55' 58" west a distance of 625. 20 feet to a point; thence south 24° 17' 07" west a distance of 103. 12 feet to a point; thence south and parallel to the west line of said Section 28, a distance of 1219. 99 feet to the south line of said Section 28, which is the true point of beginning, containing 20 acres, more or less, and WHEREAS, the petitioner was present, and WHEREAS, there was no opposition to the request of petitioner for the location of a dog kennel operation, and WHEREAS, the said requested location for a dog kennel opera- tion is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(3) of the Zoning Resolution of Weld County, said dog kennel operation may be authorized on the ap- proval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioners and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Edgar Trow, 6922 Magnolia Street, Commerce City, Colorado, to locate a dog kennel operation on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That said dog kennel operation shall contain not more than Seventy-Five (75) dogs at any one time. 3. That petitioners shall proceed with due diligence to effect PL0783 740 357 N said dog kennel operation and they they, shall have up to one year from date hereof to begin construction of said dog kennel operation. 4. Water Conservancy District Glen Paul , Weld County Sanitarian SUBJECT : State Feedlot Regulations Tape 527 DISCUSSION : Mr. Fortner handed out proposed regulations for the members to look over . One particular point to be brought out is the definition of state waters . Definition takes in all water (except what is in a sewer system ) , even what is in a barrow ditch . The State will have to enforce the regu- lations on existing lots , and the regulations we have now for special use permits will enforce it on new or expanded operations . Need to check the lots after they have been ap- proved to make sure they are observing the setbacks , mainly those from streams , etc . Also make sure they are adhering to the plans submitted and approved . Mr . Weigand stated that since the meeting at Monforts on Monday , March 11 , there has been an amendment to the size , which states a number of animals being confined ; and not just any animals being con- fined . There will be a public hearing on April 1 that Mr . Weigand felt was quite important . It was discussed that possibly a few representatives from the Planning Commission should attend the meeting . Could possibly change the busi - ness meeting to April 2 for the Planning Commission . There is no term that actually describes Agricultural runoff on all farms . EPA regulations state 10 , 000 acres all under one owner ; these regulations state no acreage . SUBJECT : Brighton Planning Commission DISCUSSION : Mr . Heitman stated that the Brighton Planning Commis- sion is very receptive to have a meeting with our Planning Commission at the earliest possible meeting . It has been 1002 set for April 1 (Monday ) at 6 : 00 P .M . in the Ebony Room of the American Legion , Greeley . There is about a mile and a half of Weld County that will be in Brighton ' s Comprehensive Plan and some coordination between the two counties needs to be discussed . SUBJECT : County Information System Progress Tape 527 DISCUSSION : Mr . Jost introduced Mr . Hansen , Dr . Duff and Jack Freese . He then briefly explained the information system. One of the prime motivating factors was the Larimer-Weld Regional Planning Commission Housing Study. Another of the reasons is that the needs of the Planning Commission and the Assessor are becoming large enough and sophisticated enough that we need to think about using a computer to help with the problem . There are about 44 ,000 parcels of land in Weld County and there is a large amount of information gath^red about each one of these parcels by several different agencies . This system should collate the information into an easily accessible source . The four terms used regarding this sys- tem are data base , file , record and field . A record is like the information contained on the assessor ' s card . There are 40 , 000 of these records in a file . There will be three different files : one will contain much of the information on the appraisal card ; another will con- tain the information on the real estate record card (which is derived from part of the assessor ' s card ) ; and last one will contain planning information that will have information being put into it by ourselves concerning subdivisions , zoning , etc . , geographic areas like census tracts . A field is an individual piece of information on a file . The data bank is just the total of the files that will be in the system. Each file will have the parcel identification code number. Also in the different files will be tax areas , names and addresses of property owners , address of the property , land value , building value , square footage , census tracts , enumer- ation districts , special use permit information , land use coding , traffic zones , police districts , school districts , etc . Once the system is set up and running , studies in time comparison could be made . Hopefully , from this information , forecasts and predictions about housing trends could be made . It will also be used in the Regional Housing Monitoring Sys- tem . Financing will be $7500 from the Regional Work Budget 1973- 74 fiscal year and $10 ,000 for the next fiscal year . If we had to start from ground zero , the cost for the developing of this system could not be justified in terms of information retrieval . The key punching will probably be done by the Accounting Office . The University is mainly involved for two reasons . First , as a public service ; and secondly , they 1003 try to encourage local kinds of research for Doctoral students as a justification in terms of the Unviersity and faculty kinds of research . The planning kinds of information are also useful for business planning , government planning , etc. The Weld County Planning Commission held their regular meeting Tuesday , March 19 , 1974 at 2 : 30 P . Postponed voting until next meeting . SUBJECT : Western Hills Fire Protection District Tape 528 APPEARANCE : Howard Rice DISCUSSION : Mr . Rice briefly went over the District ' s plans . Intentions are to incorporate all the areas that are not now covered by another fire district . There are a few small minor changes in the boundaries being worked out by the • Assessor ' s Office . The station to be located on the west side of the proposed district will be at 51st Avenue and 20th Street ; one on the east side of town is now proposed to be located at the corner of Hwy 34 and Chestnut Street , as sug- gested by the Planning Commission . One concern was the possi - ble danger in putting a fire station on a corner . However , they will have unlimited view in either direction before entering the highway ; and possibly in the future , an emergency signal could be placed at the intersection . Planning staff recommends approval for the following reasons : (1 ) The re- quired service plan and its elements have been submitted in accordance with 89-18-4 CRS , the Special District Control Act ; ( 2 ) The service plan appears to be workable ; (3 ) The financial statement has been checked and found accurate by the County Finance Officer ; and (4 ) It is the judgement of the staff that fire protection is desireable and further, it compliments the Weld County Comprehensive Plan in that 1 004 t it provides fire protection to areas that are proposed for growth . SUBJECT TO : Relocating proposed east fire station further east to at least the vicinity of Lynn Grove Cemetary (which has been accomplished ) . Schaffer DISCUSSION : Mr . Freese stated this development is located on approximately 15 acres on the south side of the Platte River . They have submitted development standards and re- habilitation standards complying with Weld County Regula- tions . Mr. Freese stated that they have talked with the Town of LaSalle and have made provisions to keep their limits of the excavation further than is required in order to stay away from undermining the LaSalle lagoons . Town has no other objections . The Latham Ditch Co . has verbally given their approval for Mr . Ikenouye to build a bridge over their ditch . Planning staff recommends approval for the following reasons : ( 1 ) Agrees with the Comprehensive Plan in the access and protection of our mineral resources . Also agrees with H . B . 1529 , 92-36-5 , "Preservation of com- mercial mineral deposits for extraction" . "After July 1 , 1973 , no board of county commissioners , governing body of any city and county , city or town , or other governmental authority which has control over zoning shall , by zoning , rezoning , granting a variance , or other official action or inaction , permit the use of any area known to contain a commercial mineral deposit in a manner which would interfere with the present or future extraction of such deposit by an extractor . " ; (2 ) LaSalle expresses no objections . SUBJECT TO : ( 1 ) Not undermining the LaSalle Lagoons ; ( 2 ) Bridge being improved to handle truck traffic ; (3 ) Construction be- ginning within one years time from date of approval by Board of County Commissioners and limited to plans submitted ; and (4 ) A fee being paid for the Planned Unit Development upon approval of this application ; such fee to be established on March 27 , 1974 . Item No . 4 was put in because this is going through an agricultural unit development and the question of fees was raised based on the planned unit development , this topic is to be discussed on March 27 in conjunction with the State . Will have a maximum of 75 dogs . A Recorded Exemption has been obtained on this property. Mr . Paul stated that the Health Department had no objections . About a month ago the Church of God approached them and talked about locating their church on land located in Chalet West . The utilities are all in to the first filing and was not feasible to replat an acre in that filing for the church . Utility Board has recommended approval . Easements have been put in complying with the Utility Board ' s request . The church will put in a temporary access (off of 35th Street ) , that access to be maintained by 1006 the church at their expense . Then , as the property is developed , the road will be finished to County specifications . Mrs . Lee stated that they have been granted a temporary access off of 35th Avenue (granted by Byron Ewing and ap- proved by the County Commissioners ) until such time as 35th Street at which time access approval on 35th Avenue will be revoked . The Preliminary Plat was approved in 1971 . They are to be served by Central Weld Water and Hill -N-Park for the sanitation . Utility Clearance Record and Installation Agreement have been submitted . Still needs legal approval from the County Attorney . Have met all necessary regu- lations . The land is located approximately a mile north and a mile west of Gill . All of the violations are south of the ditch (Madison farm ) . Would like this sent to the County Commissioners for further legal action . There is a 10-acre parcel (divided off and sold to Milford Hart ) and there were two 17-acre parces sold to Gerald Libsack , Roger Libsack and Don Walters , from Butcher . Gerald and Roger Libsack and Don Walters sold two 17-acre parcels to Ronald Quick . It was sold to him as two building sites . In violation of Senate Bill 35 . RESOLUTION : Be it therefore resolved to recommend to the Board of County Commissioners that legal action be taken in this matter . Motion by Mr . Heitman , seconded by Mr . Nix . Watson read two letters regarding mobile home violations . One is on property owned by Henry Clift de- scribed as Lots 5 thru 10 , Block 23 , Gill , Colorado . The second on is on property owned by Joseph Kutcher described as Lots 14 and 18 Block 8 , Gill , Colorado . Both owners were sent violation letters , and no action has been taken . It is requested that these be submitted to the Board of County Commissioners for further legal action . The Farmers Reservoir and Irrigation Company • as not served with Sermons in that case, but the day after the Stockholders Meeting the City of Thornton dismissed the Petition w ich it had theretofore filed and filed a new identical Petition nu tiered Civil Action No. 43042- Div. 4. The Farmers Company was erved with Seamans and Petition in condemnation in this new Thorn on case on November 2'0, 1973. • It is, of course, the i2 tention of the Farmers Company to defend against the Thornton conde nation proceedings. The next development is that on Friday, November 16, 1973, the City of Westminster also file a condemnation Petition involving the Standley Lake Division in the District Court of Jefferson County, being CiVi l Action No. 43056- Div 3, and caused Summons and copy of Petition to be served on the Farmers Company on that day. Westminster has not made any offe to purchase in any stated amount, as did Thornton. In the Westminster suit not only is the Farmers Commpany named as a Respondent, but there ire also named all the record stock- holders of the Fanners Reservoir znd Irrigation Company in the Standley Lake Division. I unders+ and that most of the Standley Lake Division Stockholders have alreadi been served with Summons in the Westminster case and that others rot heretofore served will, no doubt, be served shortly. The Sermons s( rued. on the Farmers Company, as well as the Sum-cons served upon t} e individual Stockholders, requires each Respondent to file an Answer within Twenty (20) days from the date of service (30 days if copy of the Petition was not also served. It is the intention of the Farmers Company, through its attorneys to defend against the Westminster suit the same as against the Thornton suit. Every Stockholder who has been served with Summons in this Westminster case is, of course, entitled to secure his own attorney to represent him in the case. - With 160 to 200 named Stockholders in the Summons, however, (assuming they are all served) it will he most confusing if individual Stockholders in any number secure separate attorneys. The Company attorneys are Akolt, Dick and Akolt, 1510 Lincoln Center Building, 1660 Lincoln Street, Denver, Colorado 80203, (telephone number 892-5664) . John P. Akolt, Sr. , and John P. Akolt 111, are presently handling the case for their firm. Robert A. Dick will also participate in the defense. Our attorneys have told us that they are arranging to secure an extension of time for the Farmers Company to answer the condemnation Petition in the Westminster case. In order to protect the individual Stock- holders who have been served with Summons, we have asked our attorneys to appear for all of the individual Stockholders who have been served or will he served and to include them in any Stipulation for extension of time or any answer or objections to he filed in the condemnation proceedings. They have entered into a Stipulation with the attorneys for Westminster granting the Farmers Company and the individual Stockholders, unless otherwise notified to and including March 1, 1974, (which may be accellerated on (30) days notice) within which to' file answers, objections, motions, etc. , to the condemnation Petition. While there may be same additional expense to the Company in having the Company attorneys represent the individual Stockholders, at this time our attorneys do not believe that that additional expense will be too substantial. If the City of Thornton shall decide, or be required, in its condemnation proceeding to name the individual Stockholders under Standley as parties respondent (there are rumors that it may do so) , then we will ask the Company attorneys also to represent them so as to prevent any default. All of the above is with the understanding that each individual Stockholder who has been named in either of these cases as a party res- pondent does have the right to select his own attorney to represent him if he so desires. However, at this time it would seem that most, if not all, of the.grounds for contesting the condemnation attempt will he common to The Farmers Reservoir and Irrigation Company as a corporation and the Stockholders. If it should later develop that there is any conflict of interest as between the Company as a corporation and any individual Stock- holder or any conflict of interest as between the Stockholders of the different Divisions of the Company, then it may he proper for the company's attorneys to withdraw as attorneys for the individual Stockholders and for the individual Stockholders to secure their own attorneys. -2- I request that each Stamtley Lake Division Stockholder who has been served shall promptly notify Mrs. Beatrice F. Evaluation is to determine the suitability of the area for a homesite with septic( tank filter field for on-site sewage disposal. The entire area is mapped as Olney fine sandy loan. This is a deep, well drained, moderately coarse textured soil with only slight limitations for both homesites and septic tank filter fields. The area is not subject to flooding. The soil survey is made on the basis of 50 to 60 inch borings.
