RESOLUTION WHEREAS, a public hearing wa-s held on Monday, June 28, 1971 in the chambers of the Board of County Commissioners of Weld County, Colorado, for the purpose of hearing the petition of Joe Satterfield, Route 2, Box 398, Fort Lupton, Colorado, requesting approval of site for a dog kennel operation on the following described property, to-wit: A parcel of land located in the South Half of the North- east Quarter of*the Southwest Quarter (SzNE1SW�+—) and the North Half of the Southeast Quarter of the Southwest Quarter (N+SE+SW++) of Section Twenty-two (2.2), Town- ship Two (2) North, Range Sixty-six (66) West of the 6th P. M. , Weld County, Colorado, containing 40 acres, more or less, and WHEREAS, the petitioner was present, and WHEREAS, there was no opposition to the request of petitioner for the location of a dog kennel operation, and WHEREAS, the said requested location for a dog kennel operation is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3 (3) of the Zoning Resolution of Weld County, said dog kennel operation may be authorized on the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Joe Satterfield, Route 2, Box 398, Fort Lupton, Colorado, to locate a dog kennel operation on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That said dog kennel operation shall not contain more than two hundred dogs at any one time. 3. That petitioner shall proceed with due diligence to effect said dog kennel operation and that he shall have up to one year from date hereof to begin construction of said dog kennel operation. 4. That all applicable subdivision and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. Dated this 30th day of June , 1971. Lee Sears j DISCUSSION : Mr. Lorenson recommended disapproval because-Of the nearness to a subdivision , namely Aristocrat Ranchettes . Mr . Satterfield stated they., would be back from the road 500 ' . They would be raising greyhounds up to one year and have approximately 200 dogs . Mr . Sears stated Mr . Satterfield has the Ell of the SWq under option which is 80 acres and it is 660 ' to the North 540 of the subdivision . There is perfect drainage and no chance of pollutants . He is presently operating the kennel on leased property . MOTION : By Mr . Heitman to approve the site for a dog kennel . Motion died for the lack of a second . MOTION : By Mr . Watson to take the matter under advisement. Second by Mr . Anderson . A unanimous vote of "Aye" . Motion carried . } Mr. Sears asked if the consideration is negative , would the Planning Commission make an onsight inspection of the existing kennel before rendering a decision . Mr . Nix stated he though C this was a reasonable request . RESOLUTION : Be it therefore resolved to recommend approval to the r. Board of County Commissioners subject to construction to begin within one year of the Commissioner ' s approval and the maximum number of dogs to 200 . Motion by Mr . Watson , second by Mr . Heitman . A vote of "Aye" by Anderson , Heitman , Watson , Nix and Bowles . Motion carried . DISCUSSION : Mr. Lorenson presented a map showing the existing feed lot and a drawing of the proposed expansion which would be to the North.. He recommended approval for the following reasons : it was recommended for approval by the Health Department and the County Agent , it is compatible with the existing land uses , it should be subject to construction within one year of the Commissioner ' s approval and a maximum number to be determined . He felt that no consideration had been given to the water table which is 10 feet below the surface and the soil report indicates it is extremely well drained soil . There are no provisions to monitor this . Mr. Buckley stated there would be 24 additional pens and increase to 5000 head . At the present time they are feeding 12 ,000 head . The expansion would cover 29 . 1 acres . Mr . Bowles expressed concern over the hills that have been bared creating a dust problem , any expansion should be tied to doing something about the west lots . Mr. West stated he lives Vantage Acres which is south of the feedlot. They have lived there since the feedlot has been in existence and has proved to be a problem for the people in that area . In addition to the smell , they have a fly problem. Mrs . Dunker, Mrs . Jackson , Mr . VanDruff, Mrs . Larson , and Mrs . Neuman expressed their opposition to the feedlot expansion and questioned the zoning . Mr. Lorenson checked on the zoning and found it is within an "A-1 " zoning which prohibits commercial feedlots . These people were assured a year ago when Anshutz applied for a mobile home permit, there would be no further expansion . Satterfield has requested this office to furnish you with the — soils information and interpretation for the S% NEI SW3 and NI SRI SW's Sec. 22, T2N, R66W, Weld County, Colorado. The" land in question is going to be used for dog kennels and a homesite with a septic tank filter field for on-site sewage disposal. The soil survey is made on the basis of 40 inch borings , although in most cases the borings are made to depths of 50 to 60 inches. The soil map should be used for general planning and does not exclude the need for on- site investigation for specific engineering purposes. The soil is mapped as 51-B, Vona loamy sand, 1-3 percent slope, 72-X, Valent sand, slope greater than 3 percent and X74-AB, Osgood-Valent sand, 0-3 percent slope. These are deep, coarse to moderately coarse textured soils and are well to excessively well drained. These soils have only slight, if any, limitations for homesites or septic tank absorption fields.
