ARCHIVE BOX MISSING AS OF 12/ 19/2017 RESOLUTION WHEREAS, a hearing was held on Monday, May 22, 1972, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of Conrad Herbst Jr. , Route 1, Box 209, Kersey, Colorado, requesting permission to locate a dairy operation on the following described property, to-wit: The Southwest Quarter of the Northwest Quarter (SW-NW+) and the Northwest Quarter of the Southwest Quarter (NWkSWj'--) of Section 27, Township 4 North, Range 64 West of the 6th P. M. , Weld County, Colorado, and WHEREAS, the petitioner was present, and WHEREAS, there was no opposition to the request of petitioner to locate said dairy operation on the above described premises, and WHEREAS, the said requested dairy operation is located in an Agricultural Zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(3)(c) of the Zoning Resolution of Weld County, said dairy operation or any expansion thereof may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Conrad Herbst Jr.,, Route 1, Box 209, Kersey, Colorado, to locate a dairy farm operation on the premises indicated above be, and it hereby is granted under the conditions -following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department, 2. That said dairy operation shall not exceed 150 head of milk cows at any one time. 3. That all applicable subdivision and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. Mr. Sitzman stated Hilltop Subdivision will be included in the project . This will be from 52nd Avenue east and include everything that is not served by the Highland Hills Sanitation District. Cunningham, Hugh Burns , Clay Turk and Pete Jungst DISCUSSION : Mr. Cunningham presented the proposed Planned Unit Develop- ment. Mr. Cunningham stated the company' s position was that the exact location of the rights-of-way in question is not known at this time and in order for the company to evaluate what the State and the County would want to do , to impose it on the PUD at this time , they didn ' t feel that the timing is right, Until they see how everyone else along the line will be regarding the respective ROW , the Company has agreed to sell this ROW at their cost. The Company has agreed to limit it ' s accesses to one access per half mile at locations agreeable to the Highway Department. In respect to the other items , the Company has gone along way in areas where straight industrial zoning would certainly not have had to make any commitment with respect to it. In respect to flood plain areas , they have agreed not to build structures within the 100 year flood plain area and at this point they do not know what that is . There is a gravel pit on the property and the Company has agreed to re- habilitate that area and will not be used for a commercial gravel pit. Other provisions of the PUD were reviewed by Mr. Cunningham. Mr . Bowles asked why would Eastman Kodak not be willing to dedicate the additional ROW that would be required of any other developer if there are no plans to move highway 257? Mr. Cunningham stated in meeting with the highway department there was no mention of it being moved. There was some discussion of an interchange of some kind . There was discussion regarding the railroad in the area . Mr. Deyoe stated more than likely it would remain . MOTION : By Mr . Watson to take the matter under advisement. Second by Mr. Anderson. Mr. Deyoe explained the PUD is zoning case Z-193 , basically Z-194 and Z-195 were generally approved . However , there is a letter of objection on Z-194 , where the zoning is from " I " to 760 "S" on the eastern edge . Letter was read by Mr. Deyoe from Mr . Walter Powers who owns property to the east stating they felt the zoning would materialy affect the value of their land and the use of their property would be more restricted .
