q RESOLUTION WHEREAS, pursuant to the provisions of the Special District Control Act, Article 18, Chapter 89, C.R. S. '63, as amended a public hearing was held on May 30, 1973, for the purpose of hearing a petition to consider a service plan relative to establishment of the Dacona Area Fire Protection District within a proposed area as in- dicated on Exhibit A, attached herewith, and WHEREAS, the petitioners were present and represented by Leonard H. McCain, counsel for petitioners, and WHEREAS, there was some opposition to request of petitioners for the establishment of said Fire Protection District, and WHEREAS, in accordance with the aforementioned statute, said Fire Protection District may be authorized upon the approval of the Board of County Commissioners of Weld County, Colorado, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioners and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application to establish the Dacona Area Fire Protection District within the boundaries as indicated in Exhibit A attached hereto and made a part hereof by reference, be, and it hereby is approved under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the state health department. 2. That all applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the zoning resolu- tions of Weld County, Colorado. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 20th day of June, 1973. Ai -A- r"- t—N Exhibit A SERVICE PLAN FOR PROPOSED DACONO AREA FIRE PROTECTION DISTRICT The following is the service plan for the proposed Dacono Area Fire Protection District located as shown on the attached map of the area. This Service Plan is filed pursuant to-the requirements of Chapter 89 , Article 18, Colorado Revised Statutes, 1963, as amended. 1. INTRODUCTION: The Petitioners herein state that the proposed Dacono Area Fire Protection District is necessary to give adequate fire protection to the proposed area. In the area there are 31 sections of real estate. In the area is one incorporated Town, the Town of Dacono, which is the main population base for the district. The population of the Town of Dacono is approximately 1,500 people. The balance of the proposed area includes the farm area between the Town of Dacono and the Town of Erie. Surrounding the proposed boundaries of the District are the Longmont Fire Protection District to the Northwest, the Town of Frederick Fire Department to the north, the Fort Lupton Fire Protection District to the east and the Brighton Area Fire Protection District to the south and southeast. The proposed area is without adequate fire protection. It is a growing area with new homes and new residential units consisting of mobile and modular units being constructed at an ever acceler- ating rate. 0.., - 2 - The Dacono Fire Department has recently constructed and completed the financing of a fire house in the Town of Dacono. This unit cannot be supported without the support of a larger fire protection district to share the cost of operating such a fire protection facility. It is proposed that the District complete the payment of the fire house for approximately $18,000.00 , purchase a new 1,000-gallon pumper fire truck for approximately $28,000.00 immediately upon the formation of the District and the develop- ment of a budget during the fall of 1973 leading to the ulti- mate assessment of a mill levy for the year 1974. 2. FINANCIAL: The estimated assessed valuation of the proposed Dacono Area Fire Protection District is approximately $2 ,000 ,000. 00 . This does not include various exempt public utilities or rail- road properties or mine properties. It is proposed that a mill levy of three (3) mills be levied on all property in the dis- trict, thus raising an annual sum of $6,000.00 together with other available funds to be expended initially on capital in- vestments which will include payment on the fire building pre- sently constructed and the purchase of a new 1,000-gallon pumper. In the future a sub-station is proposed for the southwest part of the District which may necessitate an additional mill levy for that purpose. This future facility can only be justified ` \ - 3 - when the population needs of the area demand such a service. It is proposed that no bonded indebtedness be created on the land in the area. All funds budgeted will be by mill levy annually collected together with contract payments from the Town of Dacono and other miscellaneous income. A proposed budget will be created in accordance with the Colorado Local Govern- ment Budget Law and all citizens in the District may partici- pate in the formulation of the budget by attending public hearings for that purpose. 3. ENGINEERING AND CAPITAL IMPROVEMENTS: The Area consists of the Town of Dacono as the main popu- lation base. All the rest of the area consists. of undeveloped farm area. However, the area is immediately adjacent to and is divided by Interstate Highway 25 and is directly in the path of metropolitan growth on the East Slope of the Rockies in a prime development area. Water for residential development is available to some of the area because it is within the boundaries of the Northern Colorado Conservancy District and is now being serviced by the Central Weld County Water District which delivers water to the area. All water used in the system of Fire Pro- tection proposed will come from storage tanks and pressured lines of the Central Weld County Water District system. This is the case except for water used in rural fires and any avail- able water able to be pumped by District pumpers will be used in those instances. - 4 - 4. ARCHITECTURAL AND CONSTRUCTION. A fire house was constructed by D & S Steel Bldgs. Co. , Greeley, Colorado, on a site donated by Emco Development Com- pany to the Town of Dacono. This site is located within the Town of Dacono adjacent to the populated mobile home area of that Town. Financing of that building was arranged by the Dacono Volunteer Fire Department with the Fort Lupton State Bank and providing for a loan of $18,000.00 , with monthly payments of $195. 18 for a period of 10 years with interest at the rate of 6%. This arrangement provided for a lease-purchase agreement between he Town of Dacono and the Builder wherein at the time the lease is paid off the ownership of the building and land will go to the Town of Dacono. It is proposed that the District lease these premises from the Town of Dacono and operate and maintain these fire protec- tion facilities and make a suitable payment to the Town for their use. The proposed annual lease sum is $3,000.00. In addition, a new 1,000-gallon American La France pumper fire truck is proposed to be purchased as soon as money ,is avail- able and this truck will immediately be put to service for the use of the entire area. Presently in service in the Town of Dacono are a fire truck and a 1,000-gallon tanker truck. These facilities will be transferred to the District on a lease and purchase basis as the law will permit and additional capital equipment will be purchased as the needs of the area and the funds of the District will allow. It is proposed that a new sub-station in the Southwest part of the District will be constructed as the needs of the r .-N - 5 - area and funds of the District will provide. This will be accomplished by a similar lease with option to purchase method used in the construction of the existing facility in the Town of Dacono. It is anticipated that such a facility will not be needed for five (5) years. 5. MAP AND AREA OF DISTRICT: The map of the area is attached together with a legal des- cription of the area prepared by Lind Engineering, Inc. , 17 North 12th Avenue, Brighton, Colorado 80601, Consulting Engineers. 6. POPULATION: The estimated population of the total area is approximately 2,500 people divided between residents of the Town of Dacono and rural residents of the surrounding and adjacent area between the Town of Dacono and the Town of Erie. 7. COSTS IN FORMATION AND OPERATION OF DISTRICT: It is estimated that the mill levy of three (3) mills on $2 ,000 ,00O.00 assessed valuation of the area will raise $6,000 .00 a year. This sum, together with other available funds, will fund the following proposed budget: INCOME: Mill levy assessment $ 6,000.00 Contract payment-Town of 3,000.00 Dacono Miscellaneous Bingo and other 4, 800.00 income $13,800.00 r� /"N - 6 - EXPENDITURES : Payment on fire house $ 2,400.00 Payment on fire truck 4,560 .00 Miscellaneous Operational 6, 840 .00 and maintenance expense $13,800.00 8. AGREEMENT WITH TOWN OF DACONO: The proposed District intends to enter into an agreement with the Town of Dacono to provide the following: a. The District will provide the Town of Dacono with all fire protection services required and will lease from the Town the existing fire house and existing equipment to assist in provi6ing that service. b. The Town of Dacono will pay to the District its pro- rata share of the cost of this fire protection, taking into consideration the fact that the Town is in the District and its citizens pay a mill levy to the District. This anticipated sum is $3,000.00 . c. The District will agree to purchase additional capital equipment necessary to provide adequate fire protection service to the Town now and in the future. 9 . CONCLUSION: The plan of the Petitioners is to provide economical and efficient volunteer fire protection for all the inhabitants of the proposed Dacono Area Fire Protection District. The District agrees to provide all necessary fire pro- tection service to the Town and its inhabitants by maintaining standby fire equipment and personnel available as need arises within the Town. 2 . In consideration for said service, Town agrees to pay to District for said service the annual sum of $ payable by July 1 of each year or otherwise as the parties agree. 3. The Town agrees to lease or make available to the Dis- trict existing fire equ4ipment and fire house on terms agree- able to the parties and provided District assumes the monthly payment due on the Deed of Trust which exists on the fire house.
