HomeMy WebLinkAbout740791 RESOLUTION WHEREAS, a public hearing was held on July 29, 1974, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose'of hearing the petition of David E. Howard (Vessels Gas Processing Ltd. ) Rural Route 1, Brighton, Colorado, requesting approval of site for the construction of a gas processing plant and supporting facilities on the following described property, to wit: Description of a portion of the SE4 of Section 28, Township 1 North, Range 67 West of the 6th P.M. , wherein the East line of the SE4 of said Section 28 is assumed to bear N00°00'00" E. , and all subsequent bearings being deflected from said East line of said SE4. Beginning at a point on the East line of the.SE4 of Section 28, Township 1 North, Range 67 West of the 6th P. M. --said point being N00°00'00" E. , 361. 50 feet from the Southeast corner of said Section 28; Thence N89°34'00" W. , 361. 50 feet parallel to the South line of the SE4 of said Section 28; Thence S00°00loo" E. , 361. 50 feet parallel to the East line of the SE4 of said Section 28 to the South line of the SE4 of said Section 28; Thence N89°34'00" W. , 245. 36 feet along the South line of the SE4 of said Section 28; Thence N00°47'24" E. , 538. 46 feet; Thence N13°41'24" E. , 48. 38 feet; Thence N31°46'00" E. , 103. 08 feet; Thence N41°22'00" W. , 200. 52 feet; Thence N73°32'00" W. , 60. 00 feet; Thence N06°17'00" W. , 237. 50 feet; Thence N85°43'12" W. , 104. 43 feet; Thence N00°00'12" W. , 373. 79 feet; Thence S89°34'00" E. , 853. 93 feet parallel to the South line of the SE4 of said Section 28 to the East line of the SE4 of said Section 28; Thence S00°00'00" W. , 1, 094. 84 feet along the East line of the SE4 of said Section 28 to the Point of Beginning, f. Excepting the South 30 feet North of the South line of the SE4 of said Section 28 and the East 30 feet lying West of the East line of the SE4 of said Section 28 for County Road Right-of-Way purposes. The above tract contains 20. 000 gross acres, more or less, and WHEREAS, the petitioner was present, and WHEREAS, there was no opposition to the request of petitioner for • the location of said gas processing plant and supporting facilities, and WHEREAS, said requested location for said gas processing plant and supporting facilities is•located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(2) of the Zoning Resolution of Weld County, said location for said gas processing plant and supporting facilities may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the 1971-OTU testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; ) NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of David E. Howard (Vessels Gas Processing Ltd. ) Rural Route 1, Brighton, Colorado, to locate a gas processing plant and supporting facilities on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That petitioner shall proceed with due diligence to effect said construction of said gas processing plant and supporting facilities and that it shall have up to one year from date hereof to begin the construction of same; otherwise, the Board may, for good cause shown, on its own motion, revoke the permit herein granted. 3. That such gas processing plant and supporting facilities shall be limited to the items as shown on plans as submitted and attached hereto and made a part hereof by reference. 4. That petitioner comply with agreement for the dedication of an additional 20' of Right-of-Way on County Road #19 if and when there is a future expansion of said arterial road as provided for in letter of June 5,• 1974, to Mr. Thomas G. Vessels from David E. Howard, et ux. , said letter being recorded in Book 717, under reception #1639230, Weld County Records, wherein it is specifically agreed that both lessors and lessees and their re- spective assigns will deed the additional 20' of Right-of-Way to the County for road purposes at such time as the Right-of-Way may be needed by the County. 5. That all structures erected upon said premises be removed within one year from the time that said gas processing plant and supporting facilities cease to operate and are closed. 6. That all applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado.
