RESOLUTION
WHEREAS, a public hearing was held on Monday, April 24, 1972,
in the chambers of the Board of County Commissioners of Weld County,
Colorado, for the purpose of hearing the petition of Eastman Kodak
Company, Windsor, Colorado, requesting a change of zone concerning
three parcels of land and designated on plat as follows, to-wit:
PARCEL A - From "A" Agricultural District to "I"
Industrial District, Planned Unit Development;
PARCEL B - From "I" Industrial District to "S"
Scientific District; and
PARCEL C - From "A" Agricultural District to "S"
Scientific District, and
WHEREAS, the petitioner was present and represented by counsel,
James C. Cunningham and Hugh A. Burns, and
WHEREAS, there was no opposition to the change of zones, and
WHEREAS, the Board of County Commissioners has studied the
request of the petitioner and studied the recommendations of the Weld
County Planning Commission as submitted, and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED BY the Board of County
Commissioners, that the petition of Eastman Kodak Company, for change
of zones concerning the following three parcels of land, to-wit:
PARCEL A - From "A" Agricultural District to "I"
Industrial District, Planned Unit Development;
PARCEL B - From "I" Industrial District to "S"
Scientific District; and
PARCEL C - From "A" Agricultural District to "S"
Scientific District;
said parcels being more particularly described as follows:

The NW4 except the North 500 feet thereof and except
the West 500 feet thereof, the SW4 except the West

1. That any water and sanitation facilities to be installed shall
be approved by the State Health Department.
2. All applicable subdivision regulations and zoning regulations
shall be followed and complied with in accordance with the zoning
resolutions of Weld County, Colorado.
3. That a strip of land along the West boundary 160 feet from
the section line and a strip of land along the North boundary 100 feet
from the section line shall be reserved for highway right of way until
such time as said land is donated or sold as provided above; if sold, the
price shall be that for raw land as established at date of purchase by
Eastman Kodak.

STATEMENT OF PURPOSE OF REQUESTED
REZONING FROM A TO I
The applicant has not yet developed specific plans or
made internal decisions or commitments regarding the develop-
ment of this property. However, the requested rezoning is
necessary and desirable in connection with applicant 's long-
term planning and consideration of alternative sites for further
industrial development.
The development of this property, if and when it occurs ,
will be similar to the development which has occurred to date
and is now being planned on applicant 's adjacent property to
the east. More specifically, the applicant intends to use the
property for the construction of buildings and related facilities
engaged in the manufacture of photographic materials , including
photographic film, photographic paper and lithographic plates ,
and the manufacture or blending of chemicals used in the
manufacture of such products . The contemplated development will
involve the construction of buildings of concrete exterior, some
possibly multistory, which will be adequately spaced, with
suitable parking arrangements .
During the pendency of the Poudre River flood plain
study now underway, the applicant will not construct buildings
within fifty feet from either bank of the Poudre River on the
property involved in this application and will not do so on any
of the rest of the property owned by applicant in adjacent areas .
Further , applicant will not construct buildings within the flood
plain as it is finally determined by the pending study.

Answers to Questions
1. Is it impractical , impossible , or undesirable to
develop the land according to its current zoning classification?
It is undesirable to develop the land according to
its current zoning classification. As suggested by the
Planning Commission in 1969 , at the time the applicant's
initial assemblage of land in the area was rezoned, it
is desirable to surround a major industrial development
with a "buffer" Scientific zone . The "buffer" zone
will help to prevent excessive industrial concentration
in the area of the Kodak plant and will provide the
zoning authorities with more effective zoning control
in the economic development of the region. The applicant
intends to use the Scientific zone for green belt.
2. Would the proposed rezoning benefit the entire County
by allowing a type of development which is needed and cannot
locate in other parts of the County?
Yes . The proposed rezoning will facilitate the
development of the Kodak manufacturing facilities
already underway. This development cannot occur in
other parts of the County because it has already been
commenced at Kodak's present location.
3. Would the proposed rezoning benefit lands adjoining
the area requesting the change?
Yes . It would provide a "buffer" surrounding
Kodak's industrial development and encourage aesthet-
ically attractive green belt landscaping on the
periphery of this industrial area.
4. What features apply to the property requesting rezoning
which make it logical to rezone this tract and not to rezone in
a similar manner surrounding properties which may have like land
use characteristics?
The proposed rezoning is logical for purposes of
providing a buffer zone , as explained above . It is
not practical to rezone surrounding properties because
such properties are not owned by the applicant.
5. Why are other areas in the County already zoned according
to the requested classification, unsuitable for the development
which is proposed?
Because such areas are not owned by the applicant
and are not contiguous to the applicant's present
facilities now in operation.
6. What proof of evidence is available that the original
zoning is faulty or that changing conditions in the area justify
rezoning at this time?
The very extensive construction of manufacturing
and related facilities on the applicant 's adjacent
property in the immediate area shows that the con-
ditions in the immediate area have changed from
agricultural to industrial. The proposed rezoning
to create a scientific "buffer" zone will facilitate
the development of Kodak's industrial site as well
as the economic development of the entire area.
7. Please submit Economic or other evidence that the
area covered by the petition needs additional Commercial or
Business in the area. (To be answered on changes requested
