CONCERNING LOT SIZE VARIANCE REQUEST
PETITION OF MRS. GEORGE HOBBS
The Petition of Mrs. George Hobbs, Route 5, Box 5352, Nampa,
Idaho, requesting lot size variance under Section 9-4A (6) of the Weld County
Subdivision Regulations of a parcel of land more particularly described as
follows, to-wit:
That portion of the South Half of the Northwest Quarter of
Section 19, in Township 3 North, Range 68 West of the 6th
P. M. Weld County, Colorado and located East of the West
bank of the existing North-South drainage ditch, containing
40. 14 acres, more or less,
came on for hearing on December 24th 1974, and the Board of County
Commissioners of the County of Weld, State of Colorado, having heard the
testimony and evidence adduced upon said hearing and having considered the
testimony, evidence, remonstrances and recommendations of the Weld County
Planning Commission filed with said Board, and having carefully weighed the
same, now makes the following findings:
1. The evidence discloses that the applicant failed to sustain the
burden of proof as to the need for a lot size variance, and that good cause
has not been shown why such a variance should be granted as required by
Section 9. 4 A (6) of the Weld County Subdivision Regulations.
2. The evidence discloses that the proposed land division is not in
conformance with the intent of the recorded exemption procedure which is
defined as "a means whereby nonproductive agricultural lands may be de-
veloped for higher or more productive uses, insofar as such uses are com-
patible with surrounding agricultural uses in areas where such land divisions
are proposed".
3. The evidence and investigation show that the property in question
is composed of class III and class IV, irrigated agricultural lands.
4. The evidence discloses that the proposed land division does not
conform to the Weld County Comprehensive Plan in that it promotes non-
agricultural use of agricultural land.
5. That each of the preceding findings in and of themselves and
independent of each other constitutes a separate and individual ground for
denial of a lot size variance under Section 9-4 A (6) of the Weld County
Subdivision Regulations.
RESOLUTION
WHEREAS, the Board of County Commissioners of the County of Weld,
State of Colorado, has heard the application of Mrs. George Hobbs, Route 5,
Box 5352, Nampa, Idaho, for a lot size variance under Section 9-4 A(6) of
the Weld County Subdivision Regulations, of a parcel of land as hereinabove
recited and made a part hereof by reference, and
WHEREAS, said Board has made its findings on the evidence and
testimony submitted to it, which findings precede this Resolution and by
reference are incorporated herein and made a part hereof, and

WHEREAS, the Board has carefully considered the Petition, the
evidence, testimony and remonstrances and the recommendations of the
Weld County Planning Commission and have given the same such weight as
in its discretion deems proper, and is now fully advised in the premises.
NOW, THEREFORE, BE IT RESOLVED, that the petition of Mrs.
George Hobbs, Route 5, Box 5352, Nampa, Idaho, requesting a lot size
variance under Section 9-4A (6) of the Weld County Subdivision Regulations,
of a parcel of land indicated above be, and it hereby is denied on each of the
grounds set forth in the Board's findings therein.

Dear Sirs:
The enclosed letter is a request, by Mr. and Mrs. George Hobbs, for a Lot
Size Variance so they can apply for a Recorded Exemption. According to
the Weld County Subdivision Regulations, Section 9-4A.(6), the following
is required:
"That the original tract or parcel of land to be divided under
this Section meets the minimum lot size requirements established
by the Weld County Zoning Resolution; variance from this re-
quirement being allowed only upon good cause being shown to
the Board of County Commissioners or where said tract or parcel
of land lies within the comprehensive plan area of an existing
incorporated town of Weld County (Rev. 4/17/74)."
Based upon the information and Weld County Regulations, the planning staff
recommends the request be denied for the following reasons:
1 . The proposed split is not in conformance with the Intent clause,
Section 9-2, of the Weld County Subdivision Regulations and the
Weld County Comprehensive Plan in that the agricultural lands
would be developed.
2. Variance to allow a recorded exemption, and therefore an
additional building site, would not be in conformance with
the Weld County Zoning Resolution regarding density schedule
in agricultural zoned property.

3. The proposed split is interpreted to be an evasion from
the definition of subdivision or subdivided land, Section 2-lA
of the Subdivision Regulations, in that the major use would
be residential .

Dear Sirs :
I would like to request a recorded exemption on our 40 acres
and home located in Weld County. The legal aescription is
attached.
We live in Idaho and while in Colorado in August, I met with
Mr. Fortner and explained our reasons for wanting to sell the
house and 5 acres.
We are finding it difficult to sell the 40 acres and home in
one parcel since most interested parties would prefer to buy
the land (35 acres ) and build their own nicer and larger home.
We currently have the house rented but the renters will be
moving soon--it is difficult to manage a property when we are
so far away. We feel we will have a better chance selling
if we can sell the home and 5 acres and 35 acres separately.
There is adequate utilities and septic tanks aren' t a problasm.
We weren' t aware of the deadline for filing a recorded exemp-
tion since living out of state.
Please consider this request.
