HomeMy WebLinkAbout20213471.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MONDAY, DECEMBER 20, 2021 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, December 20, 2021, at the hour of 9:00 a.m. El ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Steve Moreno, Chair Commissioner Scott K. James, Pro-Tem Commissioner Perry L. Buck— EXCUSED Commissioner Mike Freeman Commissioner Lori Saine Also present: Assistant County Attorney, Bob Choate Acting Clerk to the Board, Houstan Aragon Controller, Chris D'Ovidio MINUTES: Commissioner James moved to approve the Minutes of the Board of County Commissioners meeting of December 6, 2021, as printed. Commissioner Saine seconded the motion, and it carried unanimously. El READ ORDINANCE BY AUDIO: Commissioner James moved to read Code Ordinances#2022-01 and #2022-02 by audio. The motion was seconded by Commissioner Saine, and it carried unanimously. El PUBLIC INPUT: No public input was given. RUE AMENDMENTS TO AGENDA: There were no amendments to the agenda. El CONSENT AGENDA: Commissioner James moved to approve the Consent Agenda, as printed. Commissioner Saine seconded the motion, and it carried unanimously. l COMMISSIONER COORDINATOR REPORTS: Commissioner James thanked the departments of Weld County for the stellar work that is done and wished all a Merry Christmas. Commissioner Saine also wished everyone a Merry Christmas. El WARRANTS: 1) GENERAL WARRANTS — DECEMBER 16, AND 17, 2021: Commissioner Saine moved to approve the General Warrants, as printed. Commissioner James seconded the motion, and it carried unanimously. Minutes, Monday, December 20, 2021 2021-3471 /27 Page 1 BC0016 BIDS: 1) APPROVE BID #B2100137, CRS 80 AND 37 INTERSECTION PROJECT — DEPARTMENT OF PUBLIC WORKS: Christie Peters, Purchasing Department, stated ten (10) suppliers downloaded the specifications, but only one (1) bid was received and staff recommends approval to Structures, Inc., for a total amount not to exceed $5,368,771.65, which is within the budget for this project, with partial funds of$1,000,000.00 per a grant from the Department of Local Affairs (DOLA). Commissioner James moved to approve said bid. The motion was seconded by Commissioner Freeman and it carried unanimously. 2) APPROVE BID #B2100142, WORKFORCE INNOVATION GRANT PROGRAM — DEPARTMENT OF HUMAN SERVICES, WORKFORCE DEVELOPMENT BOARD: Ms. Peters stated six (6) bids were received and the Workforce Development Board reviewed and recommends three (3) entities to receive Innovation Grant Funds: 1) Colorado Bioscience Institute at St. Vrain Valley Schools, for the total amount of $435,200.00 to create a highly trained and diverse bioscience workforce of Weld County students, 2) Jobs of Hope, Inc., for the total amount of $46,257.94 for the House of Hope Project, which teaches leadership and other job-related skills, and 3) Northern Colordo Veteran Resource Center, for the total amount of $130,935.00 to provide employment assistance and new technology to help the reintegration of veterans into civilian life. Commissioner Freeman moved to approve said bid. The motion was seconded by Commissioner James and it carried unanimously. NEW BUSINESS: 1) CONSIDER STANDARD FORM FOR CHILD PROTECTION AGREEMENT FOR SERVICES BETWEEN DEPARTMENT OF HUMAN SERVICES AND VARIOUS PROVIDERS AND AUTHORIZE CHAIR TO SIGN AGREEMENTS CONSISTENT WITH SAID FORM: Jaime Ulrich, Director of the Department of Human Services, stated the agreement has been updated to reflect current terms and processes to be used in the 2022 Child Welfare Services Request For Proposal (RFP) template. Commissioner James moved to approve said standard form and authorize the Chair to sign agreements consistent with said form. The motion was seconded by Commissioner Saine and it carried unanimously. 2) CONSIDER CONTRACT ID #5445 TASK ORDER CONTRACT FOR THRIVING WELD HOUSING AND LAND USE PROJECT AND AUTHORIZE CHAIR TO SIGN AND SUBMIT ELECTRONICALLY: Mark Lawley, Director of the Department of Public Health and Environment, stated the primary goal of the contract is to increase afforabable housing for individuals with low- to moderate- income in Weld County and the department is to receive funding in the total amount of $128,544.00 for the first six (6) month period of 2022 and a total amount of $800,548.00 over the next four (4) years to allow for one new hired staff member to work with United Way for deliverables. Commissioner Freeman moved to approve said contract and authorize the Chair to sign and submit electronically. The motion was seconded by Commissioner James and it carried unanimously. EA 3) CONSIDER REAPPOINTMENT TO NORTH FRONT RANGE WATER QUALITY BOARD: Commissioner James moved to approve said reappointment to the North Front Range Water Quality Board. The motion was seconded by Commissioner Freeman and it carried unanimously. 4) FIRST READING OF CODE ORDINANCE #2022-01, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 21 AREAS AND ACTIVITIES OF STATE INTEREST AND CHAPTER 23 ZONING OF THE WELD COUNTY CODE (OGED LAP CODE): Jason Maxey, Director of the Department of Oil and Gas Energy, gave an overview of the Location Assessment for Pipelines (LAP) Code, and stated he sent updated language to the Colorado Oil and Gas Association (COGA) for the complete repeal of the former LAP language from Chapter 23 and it's relocation to Chapter 21, Article XI, of the Weld County Code. Mr. Maxey further discussed administrative updates to Minutes, Monday, December 20, 2021 2021-3471 Page 2 BC0016 definitions and explained there was no reduction of pipeline size requirements, no additional mapping requirements, and no threshold requirement for easement acquisition prior to application submittal. He also discussed the industry inclusion of Division 3 LAP Development Standards for construction and maintenance of oil pipelines with leak detection technology. In response to Chair Moreno, Mr. Maxey stated the County is in good standing right now,and if there are any industry comments made, he will relay said information. In response to Commissioner James, Mr. Maxey confirmed the stakeholders are currently pleased with the revisions. There was no public comment given concerning this matter. Commissioner Saine moved to approve Code Ordinance #2022-01 on First Reading. The motion was seconded by Commissioner James and it carried unanimously. 1 5) FIRST READING OF CODE ORDINANCE #2022-02, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 20 IMPACT FEES OF THE WELD COUNTY CODE: Elizabeth Relford, Deputy Director of the Department of Public Works, gave an explanation of the amendments to Section 21-1-80, Independent Fee Analysis, of the Weld County Code, in reference to the approved Chapter 20 Fee Schedule Ordinance, effective November 22, 2021. In response to Chair Moreno, Ms. Relford stated she has received no public or stakeholder comment. Commissioner James clarified he left a message for comment from Steve Wells, but has yet to hear back and requested staff contact Mr. Wells. Commissioner Saine commented that it might be beneficial to give more emphasis to obtaining stakeholder and community input prior to the Second and Third Readings of this ordinance. Commissioner Freeman commented this Ordinance is not about fees; rather, it allows flexibility depending on land use and potential impact. Tom Parko, Director of the Department of Planning Services, clarified a revision regarding traffic studies, which require an engineer, versus a traffic analysis or narrative that can be prepared by the land owner. There was no public comment given concerning this matter. Commissioner James moved to approve said Code Ordinance #2022-02 on First Reading. The motion was seconded by Commissioner Freeman and it carried unanimously. 6) FINAL READING OF CODE ORDINANCE #2021-19, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 5 REVENUE AND FINANCE OF THE WELD COUNTY CODE (ANNUAL FEES): Commissioner Freeman moved to read Code Ordinance #2021-19 by title only. Commissoner James seconded the motion and it carried unanimously. Bob Choate, Assistant County Attorney, read the title for the record. Jennifer Oftelie, Budget Manager, stated there have been no changes since the Second Reading of this ordinance. There was no public comment given concerning this matter. Commissioner James moved to approve Code Ordinance #2021-19 of Final Reading. The motion was seconded by Commissioner Freeman and upon a roll call vote, the motion passed three (3) to one (1), with Commissioner Saine opposed. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. Code Ordinances#2022-01 and #2022-02 were approved on First Reading, and Code Ordinance#2021-19 was approved on Final Reading. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
