Re: Support for the Polis' Administration's Position on Senate Bill 21-200
Dear Governor Polis:
The Weld County Board of County Commissioners ("Weld County") is writing to express our support for your
Administration's position on Senate Bill 21-200("Bill").
Weld County shares your concerns regarding the disproportionate power the Bill affords to the Air Quality Control
Commission("AQCC"). To address emission reduction,we believe it is best for the State of Colorado to pursue a
deliberative,data-based, and inclusive"whole-state"approach. However,by consolidating control of the issue into
one non-elected body and mandating a truncated timeline for promulgating rules, Weld County is concerned the
AQCC's resulting rules will not be carefully crafted nor will they adequately take into account the spectrum of affected
interests. Relatedly, by empowering the AQCC to re-allocate sector specific reduction targets established by the
Greenhouse Gas Roadmap ("Roadmap"), the Bill creates significant uncertainty, particularly in the near-term, for
impacted industries and may result in certain sectors and regions of the State bearing a disproportionate burden and
costs.
Weld County also appreciates and recognizes the effort put forth in crafting the Roadmap. We believe the Bill
prematurely deviates from the process laid out in the Roadmap and eliminates the Roadmap's inherent flexibility with
hard caps on emissions. The hard caps are particularly problematic given current limitations in the availability and
accuracy of emission data. Hard caps on emissions reduce the flexibility necessary to address updated data and allow
for mid-course correction,as noted in our prior Roadmap comments.
Weld County supports your Administration's willingness to oppose this Bill and supports efforts to continue to
proceed with the process outlined in the Roadmap.Thank you for your consideration.
