SUBDIVISIONS AND HISTORIC TOWNSITES IN THE A (AGRICULTURAL) ZONE
DISTRICT — FAITH LUTHERAN CHURCH OF EATON
A public hearing was conducted on March 31, 2021, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated February 22, 2021, and duly published
February 24, 2021, in the Greeley Tribune, a public hearing was conducted to consider the
request of Faith Lutheran Church of Eaton, for a Site Specific Development Plan and Use by
Special Review Permit, USR20-0033, for a Child Care Center and associated signage exceeding
the Weld County Sign Code standards outside of subdivisions and historic townsites in the
A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of
record.
Michael Hall, Department of Planning Services, presented a brief summary of the proposal
and clarified the property has included a continuously operated Preschool since 1981, and seeks
to increase the number of children from 28 to 45. Mr. Hall described the site and the location of
the Preschool itself, which is a secondary component of the property, with the primary use being
the existing Faith Lutheran Church, constructed in 1966. He relayed the Preschool is operated by
In the Beginning Infant Toddler Center, c/o Maria Kieler, which is a privately owned organization
under lease from the Church. He stated the Preschool operates independently of the Church, and
described its hours of operation, staffing and licensing requirements. Mr. Hall stated the property
is served by the North Weld County Water District and the Town of Eaton for sewer. He described
the 32 -square -foot, free-standing sign, which is also a portion of this request, and the playground.
He explained the site is located within the Town of Ault and Town of Eaton's three (3) mile referral
areas, as well as the Coordinated Planning Agreement boundaries; however, neither municipality
expressed any concerns with the request. Mr. Hall described the surrounding land uses, entered
the favorable recommendation of the Planning Commission into the record as written, and

displayed images of the site and surrounding views. In response to Commissioner James, Mr. Hall
described the sign.
Melissa King, Department of Public Works (PW), stated the Child Care Center has one
existing, unpermitted access onto County Road (CR) 37, which is a paved local road, the latest
average daily traffic counted 1,004 vehicles per day with 7% trucks, and the 85th percentile speed
is 35 mph. She further stated the traffic information submitted with the application materials
indicated there will be a maximum of 48 daily passenger vehicle round trips, 65% of the traffic will
head south and 35% will head north. Ms. King stated the PW is requesting a Road Maintenance
Agreement, and a Drainage Narrative has been submitted stating the site meets a detention
exception.
e Lauren Light, Department of Public Health and Environment (EH), stated water is provided
by the North Weld Water District and sewer is provided by the Town of Eaton. She indicated the
Development Standards (DS) include retail food regulations and childcare facilities regulations,
specific to the childcare center, which do not affect the operations of the church. Ms. Light stated
DS #13 — 19 address EH items and they have no outstanding issues with the request.
e Dick Leffler, Church Council member, represented the applicant, stated there will be no
changes to the physical property, and explained the demands of the community and increased
population justify expansion of the daycare center. He requested the requirement for a Road
Maintenance Agreement be waived, as the site is fully paved, and stated they will apply for, and
obtain, an access permit.
e No public testimony was offered concerning this matter.
• In response to Chair Moreno, Mr. Leffler indicated they have reviewed, and agreed to abide
by, the Conditions of Approval (COA) and Development Standards (DS), requesting the Road
Maintenance Agreement be waived.
e The Board discussed deletion of COA #1.A (Road Maintenance Agreement), DS #25 (Road
Maintenance Agreement), and Ms. King suggested deletion of DS #24 (Compliance with the Road
Maintenance Agreement). The Board agreed to all of the aforementioned changes. In response
to Commissioner Freeman, Mr. Hall stated DS #1 is the request for the Child Care Center and
associated signage exceeding the Weld County Sign Code.
e In response to Chair Moreno, Mr. Leffler reiterated their agreement to abide by the Conditions
of Approval and Development Standards, as amended.
e No public testimony was offered regarding changes made to the Conditions of Approval and
Development Standards.
El Commissioner James moved to approve the request of Faith Lutheran Church of Eaton for a
Site Specific Development Plan and Use by Special Review Permit, USR20-0033, for a Child
Care Center and associated signage exceeding the Weld County Sign Code standards outside

of subdivisions and historic townsites in the A (Agricultural) Zone District, based on the
recommendations of Planning staff and the Planning Commission, with the Conditions of
Approval and Development Standards, as amended. The motion was seconded by
Commissioner Freeman, and it carried unanimously. There being no further discussion, the
hearing was completed at 10:27 a.m.
This Certification was approved on the 5th day of April, 2021.
