'-'1- '-' 'J `, RESOLUTION WHEREAS, a public hearing was held on November 26, 1973, in the chambers of the Board of County Commissioners of Weld County, Colorado, for the purpose of hearing the petition of Kitayama Bros. , Route 1, Box 169, Brighton, Colorado, requesting approval of site for the erection of two oil storage tanks on the following described property, to-wit: Beginning at the Southwest Corner of Section 29, Township 1 North, Range 66 West, which is the True Point of Beginning; thence east along the South line of Section 29 a distance of 700' to a point; thence North parallel to the West line of Section 29 a distance of 570' to a point; thence West parallel to the South line of Section 29 a distance of 700' to a point on the West line of Section 29; thence South along the West line of Section 29 a distance of 570' to the True Point of Beginning, and WHEREAS, the petitioner was present and represented by Ray Kitayama, and WHEREAS, there was no opposition to the request of petitioner for the location of the said two oil storage tanks, and WHEREAS, the said requested location for the said two oil storage tanks is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(2) of the Zoning Resolution of Weld County, said location for said two oil storage tanks may be autho- rized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testi- mony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Kitayama Bros. , Route 1, Box 169, Brighton, Colorado, to locate two oil storage tanks on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That such oil storage tanks shall be limited as shown on plan as submitted or on plan as may be submitted. 3. Kitayama i DISCUSSION : Would like to have a little extra fuel available in case of a shortage . Tanks are already installed . One tank is 300 ,000 gallons and the other is a little smaller . Tanks are set back sufficient distance . Planning staff recommends approval as it agrees with Comprehensive Plan ; agrees with surrounding land use and zoning ; Health Dept . recommends approval ; NOTE : Construction already complete . There was a question raised regarding a dike around the tanks . Mr . Kitayama stated that he had inquired about it , and it was only for their own personal use ; others he had seen did not have any diking around them . Motion carried . % DISCUSSION : This application had to come before the Board for a Special Use Permit as they were larger than normal . -------------- ---- APPLICANT : Harold Hicks CASE NUMBER : Z-228 Tape 511 SUBJECT : Zone Change "A" to "C" LOCATION : Pt SE4 Sec 8 T4 R64 APPEARANCE : Stan Chrisman , Triangle Realty DISCUSSION : This is a request for a cabinet shop to be allowed in an old school house to be remodeled . Mr . Hicks owns the property and Mr . Chitwood is in the process of buying the land with the condition this is approved . Mr . Chrisman stated he felt this would put no further load on County services , or be any hazard to traffic . School building is too large for a single family dwelling and this seemed to be a good way to go . They have 100% approval of surrounding property owners , as far as the proposed use goes . There is approxi - mately 1 . 80 acres to be rezoned . Planning staff recommends denial as it does not agree with the Comprehensive Plan ; does not agree with the surrounding land use and zoning ; creates spot commercial zoning . Mr . Lorenson added that the County Attorney did give - written opinion on this . Even though Mr . Chitwood may have a good idea that is really not all that bad , the "C" zone would open the area up to any com- mercial operation the next owner might want to put there . QP9 It would be better if this application could come through as a PUD , but , there is only 2 acres and you have to have 5 in order to go that route . Mr . Lorenson suggested that the building could possibly be converted into a storage building for farm use . APPLICANT : Jack Hack CASE NUMBER : SUP 228 Tape 511 SUBJECT : Dog Kennel LOCATION : Pt SE4 Sec 18 T2 R67 APPEARANCE : Mr . Hack and Francis Kershoval of the St . Vrain Agency DISCUSSION : Mr . Hack wanted to use 15 acres out of 120 for a dog kennel for greyhounds . This is right next to two subdivi - sions . It is also located a mile from Firestone and could possibly fall into their comprehensive plan which is under review at the present time . Mr . Hack stated that the sprint fields would be on the corner of the property and the per- manent runs would be at the back of the property , so there would not be jogs out all the time . Planning staff recommends approval as it agrees with the Comprehensive Plan ; agrees with surrounding land use and zoning if the "subject to" conditions are met ; Health Dept . recommends approval . Approval subject to : 1 ) Construction beginning within one years ' time from date of approval and dogs being limited to 32 ; 2) Kennel area being moved to the west end of property thus being one half mile from Casa Grande subdivision . Mr . Lorenson also added that the well water would have to have approval to be used for this purpose . Mr . Hack felt that condition #2 would put his dogs too far away from his protection . APPLICANT : Bob Ehrlich CASE NUMBER : SUP 230 Tape 511 SUBJECT : Feedlot Expansion LOCATTION : EZ Sec 14 T4 R67 APPEARANCE : Mr . Ehrlich DISCUSSION : Mrs . Lee stated that Milliken had submitted a letter recommending denial of the feedlot expansion "east" of the Town . However , this particular application is south of Milli - ken . The Town will resubmit an opinion . Mr . Ehrlich stated they wanted to build two small pens to house another 300 head . Will dig a 70 ' trench to recycle waste waters on their own property . Through the breakdown in communication with the Town of Milliken , this will slow down Mr . Ehrlich ' s time schedule . Would like a possible approval with conditions if possible . Mr . Anderson ' s field check showed no problems . The Extension Office made one comment concerning the retention pond , stating that it would need to be of sufficient size to retain . 75 acre feet of runoff , plus an additional 3 feet in 953 depth . Planning staff noted that it did agree with the Comprehensive Plan and does agree with surrounding land use and zoning . Mr . Anderson stated that he had made the preliminary field check and did note that the area is developing into residential . Did not notice any alkalie problem , however . It was felt that there was definitely a need for something like this , but that it needed to be located somewhere where it would not receive quite as much opposition as it has to date . Mrs . Lee read letter from the Division of Water Resources which stated they felt there was now an adequate supply of water if the lawn irrigation restrictions were imposed . Mr . Paul stated that the quality of this water , however , would not meet Health Dept . standards . It has an extremely high iron content . Town of Erie is still in opposition . RESOLUTION : Be it therefore resolved to recommend denial to the Board of County Commissioners as it does not agree with land use policy , does not agree with adjacent land use and zoning , Town of Erie recommends denial , Health Dept . recommends denial , and water quality does not meet Health Dept . standards . Motion carried . 954 . y i SUBJECT : Proposed Revision of Greeley ' s Comprehensive Plan Tape 509 DISCUSSION : Proposed consultants , Bowers and Smith , were present to present their plan . Will use quite a bit of staff time in place of actual monies . Will present alternative choices of what could be done with the land in the future . Want to make choices to benefit the community . Would like to obtain as much community opinions and comment as possible . Would like to have this completed by early May of ' 74 . This pro- ject will cost around $18 ,000 . $15 ,000 has been placed in the budget by the City of Greeley and the remaining $3 ,000 will be taken care of by Weld County through the transferring of funds from the Regional Budget . The Planning office has quite a bit of information and maps that will be used . Will also set up community meetings and workshop meetings . RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners to transfer funds from the Regional Budget to be used in aiding the City of Greeley in the updating of their Comprehensive Plan and to further en- dorse the firm of Bower & Smith to be the consultants . SUBJECT : City of Evans Contract for Planning Services Tape 510 DISCUSSION : The Planning Commission has never passed a resolution to actually adopt the contract between Evans and the Weld County Planning Commission . Have not had any opinion from the County Attorney ' s office yet . Fortner stated that mainly the wording had been changed after several meetings with the County Attorney ' s office . The work with UNC ' s data bank is somewhat confusing as it does not give a true and accurate read out . It was discussed to break down the A zone in two types instead of three , Irrigated and Dry land , with an 80 acre minimum lot size for irrigated land and 160 acre minimum lot size for dry land . In order to get a building permit on a smaller lot size , they would have to apply for a conditional use permit . The Planning Commission can impose stricter require- ments , but we cannot redefine subdivision . Mr . Fortner ex- plained that PUD requirements and conditional use permits would be imposed on anybody applying for a building permit on lots less than the minimum lot size . RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners to ammend the Weld County Zoning Resolution , Sections 3 . 3 , 6 . 1 and 12 . 2 . Regarding the information on the back of the petition, I would have to go to the county assessor's office (or other county records) to get them. As you told me by phone on August 23rd, your office can get this information. 2. The petition supporting the special use permit is enclosed with sig- natures of tiroperty owners within approximatel7 500 feet of the pro- ierty described in the application. 3. The 60' X 120' area of the tanks are marked on the enclosed plot plan. Distances to other existing structures are also marked. 4. Regarding residences within one mild, I also mentioned to you that this would include houses in nn area of over four square miles (which would be approximately equivalent to the town of Brighton in size), and it would be a momumentous task to work this out. It would have to be done from meps from official recozac. As an alternative, you mentioned that I should point out residences perhaps within fifteen- hundred feet from the tanks. These include: a. A mouse on the premise about 80 feet south of the tanks. It is presently used for housing of three Japanese farm trainees. b. My own residence on the premise approximately FOO feet from the tanks to the east. c. Gorden Hurley residence about 350 feet south-west of the tanks and across the road which is elevated about three feet above the tanks and the tank area.. The above are the only residences within the area that could con- ceivably be affectea by the tanks; two belong to us and the other has a. good barrier in case of any accident. The use of these tanks is to provide standby #2 fuel oil to heat greenhouses when the primary natural gas fuel is curtailed, as was done much of last winter. This amount of storage will provide us with approximately enough winter standby fuel if our use is similar to the winter of 1972-73. With the shortage of oil, it is imperative that we buy throughout the year and hold it. This fuel is only for our own use. The plot plan enclosed should show the location of other build- ings and the fall of the land so as to fall away from any residences. The drainage pit located completely within the premise is large enough to contain any spillage. Enclosed are various forms you requested. Somr forms you have told me won't apply for this use.
