A regular meeting of the Weld County Utilities Coordinating Advisory Committee was held on Thursday,
October 28, 2021 at 10:00 a.m., in the Hearing Room of the Weld County Planning Department at 1555 N 17th
Ave, Greeley, Colorado.
Members Present: Mike McRoberts, Robert Fleck, Veronica Garcia and Amy Mutchie.
Members Absent: Jared Rauch, Jerry Adams, Jeremy Young, Michael Wailes, Shelley Bergstrom, Mark
Alessi, and Lucas McConnell

STREET RIGHTS OF WAY RESULTING IN ONE (1) LOT.
LOT 17 THRU LOT 20 BLOCK 12 WATTENBERG AND THAT PART OF
VACATED LEONA AVENUE; PART OF SECTION 25, T1 N, R67W OF THE
6TH P.M., WELD COUNTY, COLORADO.
NORTH OF AND ADJACENT TO FREDERICK STREET; APPROXIMATELY
300 FEET WEST OF CAROLINE AVENUE.
Maxwell Nader, Planning Services, stated that the applicants are proposing to amend the existing south lot
line of the subject property and the Frederick Street right-of-way. The new south lot line will be located thirty
(30) feet into what is now Frederick Street right-of-way. Most utilities are in the right-of-way, which serve the
Town of Wattenberg. There is a waterline for the Town of Wattenberg Improvement Association that runs
through the north side of Frederick Street right-of-way. When the adjustment of the lot line occurs, the
waterline will now be located on the newly created property and no longer in the Frederick Street right-of-way,
therefore requiring a utility easement.
In response to the proposed Resubdivision, a utility easement shall be created for the Town of Wattenberg
Improvement Association waterline and other utilities. Said utility easement shall follow the Easement
Standard criteria set forth in Section 24-3-60 of the Weld County Code.
Section 24-3-60 states the following criteria are required to be followed:
A. Fifteen (15) feet minimum drainage and utility easements are required adjacent to public road rights -of -
way, unless otherwise recommended by the Utilities Coordinating Advisory Committee for technical
purposes.
B. Twenty (20) feet minimum drainage and utility easements are required along internal lot lines and shall be
apportioned equally on abutting properties, unless otherwise justified by the Utilities Coordinating
Advisory Committee for technical purposes.
C. Ten (10) feet minimum drainage and utility easements are required along exterior lot lines, unless
otherwise justified by the Utilities Coordinating Advisory Committee for technical purposes. Corner
exterior lots requires fifteen (15) feet.
D. Easements shall be designed to provide efficient installation of utilities and drainage swales. Proposed
easements may be modified by the Utilities Coordinating Advisory Committee. Public utility installations
shall be located to permit multiple installations within the easements to avoid cross connections, minimize
trenching and adequately separate incompatible systems.
Section 24-3-60.B is applicable for this utility easement request. The newly created twenty (20) foot utility
easement will be north of the new southern lot line. This utility easement will be solely on the subject lot
and not shared with the lot to the south of the subject lot. The lot to the south is not involved in this

request. Again, this utility easement will be utilized by the Wattenberg Improvement Association and other
applicable utilities.
The Weld County Department of Planning Services recommends that this request be approved.
Veronica Garcia, United Power, stated that they did review this request and noted that there is a pole that
they serve just off the fence and they will require access to that pole. She added that any costs or changes
would be at the cost of the applicant.
Mike McRoberts, Planning Development Review, asked if a utility easement should be shown on the plat to
identify that. Ms. Garcia replied that it should be included on the plat. Mr. McRoberts noted that it runs
parallel to the western property line with the pole inside the fence.
Mr. Nader said that we can include the required utility easements on this plat.
Amy Mutchie, Public Works, said that they would require those easements to be shown since the right-of-way
has been vacated which is the only thing that gives the utilities the right to be in there and there may be future
utilities that may come in. She added that there are some existing utilities that aren't shown so they want to
see an easement that is accommodating for those as well as some future utilities.
Rob Fleck, St. Vrain Sanitation, asked if they had already applied for an access permit. Mr. McRoberts said
Frederick Street is a maintained county road. Ms. Mutchie added that now that the right-of-way is vacated it
will become an easement.
Mr. McRoberts summarized that all of the utility easements should be identified on the plat.
Motion: Approve the final plan for RES21-0005 including all the required utility easements on the plat,
Moved by Rob Fleck, Seconded by Amy Mutchie. Motion carried unanimously.
