RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO WEDNESDAY, FEBRUARY 24, 2021 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, February 24, 2021, at the hour of 9:00 a.m. • ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Steve Moreno, Chair Commissioner Scott K. James, Pro-Tem Commissioner Perry L. Buck Commissioner Mike Freeman Commissioner Lori Saine Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Isabella Juanicorena • MINUTES: Commissioner Saine moved to approve the Minutes of the Board of County Commissioners meeting of February 22, 2021, as printed. Commissioner James seconded the motion, and it carried unanimously. • READ ORDINANCE BY AUDIO: Commissioner James moved to read Code Ordinance #2021-03 by audio. The motion was seconded by Commissioner Freeman, and it carried unanimously. • PUBLIC INPUT: Steve Teets, Greeley resident, requested clarification regarding the County's position on annexing to the State of Wyoming. In response, Commissioner James confirmed this is an effort by certain residents of Weld County, as is their right to pursue, but Weld County government is not responsible for or involved in the matter. • AMENDMENTS TO AGENDA: There were no amendments to the agenda. • CONSENT AGENDA: Commissioner Freeman moved to approve the Consent Agenda, as printed. Commissioner James seconded the motion, and it carried unanimously. WARRANTS: 1) GENERAL WARRANTS - FEBRUARY 22, AND 23, 2021: Commissioner James moved to approve the General Warrants, as printed. Commissioner Freeman seconded the motion, and upon a roll call vote, the motion carried four to one, with Commissioner Saine opposed. O5l©5/eo�1 Minutes, Wednesday, February 24, 2021 Page 1 2021-0519 BC0016 • BIDS: 1) APPROVE BID #B2100051, TRAFFIC PAINT AND BEADS - DEPARTMENT OF PUBLIC WORKS: Rob Turf, Purchasing Department, stated staff recommends selecting the lowest bidders who met specifications, Ennis -Flint, Inc., and Potter Industries, LLC, for a total amount of $307,630.00. Commissioner Saine moved to approve said bids. The motion was seconded by Commissioner James and it carried unanimously. • 2) PRESENT BID #B2100049, CORONER FACILITY CABLING — DEPARTMENT OF INFORMATION TECHNOLOGY: Ryan Rose, Director of the Department of Information Technology, stated three (3) bids were received and staff will make a recommendation on March 10, 2021. Ei NEW BUSINESS: 1) CONSIDER CONTRACT ID #4451 MEMORANDUM OF UNDERSTANDING FOR CHILDREN'S HABILITATION RESIDENTIAL PROGRAM (CHRP) AND HOME AND COMMUNITY BASED SERVICES (HOBS) WAIVER SERVICES AND AUTHORIZE CHAIR TO SIGN - ENVISION: Jamie Ulrich, Director of the Department of Human Services, stated the non -financial Memorandum of Understanding with Envision is for an in -take case manager who will identify children and families that will benefit from their assistance. Commissioner James moved to approve said memorandum of understanding and authorize the Chair to sign. The motion was seconded by Commissioner Freeman and it carried unanimously. • 2) CONSIDER CONTRACT ID #4472 INTERGOVERNMENTAL AGREEMENT FOR USE OF VIDEO MONITORING SYSTEM OF GREELEY-EVANS TRANSIT AND AUTHORIZE CHAIR TO SIGN — CITY OF GREELEY: Mike Wallace, Director of the Department of Public Safety Communications, stated the Intergovernmental Agreement is with Greeley -Evans Transit for access to their video monitoring system by the Public Safety Communications Dispatch Center. In response to Commissioner James, Mr. Wallace confirmed there are no costs to the County and the terms have been reviewed by legal. Commissioner Buck moved to approve said intergovernmental agreement and authorize the Chair to sign. Seconded by Commissioner Freeman, the motion carried unanimously. • 3) CONSIDER CONTRACT ID #4473 QUOTE FOR PURCHASE OF DIAGNOSTX REMOTE RECEIVER - LOCUS DIAGNOSTICS, LLC: Mr. Wallace stated the quote is for purchase of a device that allows the Public Safety Wireless Division to read public safety equipment in regards to radio equipment in vehicles, as well as the equipment that is carried on their person. He noted this will provide diagnostics of the performance of the equipment and notification if a repair is needed. In response to Chair Moreno, Mr. Wallace confirmed the quote is for a one-time cost. Commissioner James moved to approve said quote. The motion was seconded by Commissioner Saine and it carried unanimously. • 4) CONSIDER CONTRACT ID #4507 AWARD LETTER AND INTERGOVERNMENTAL AGREEMENT FOR EXTENSION OF 2020 PAUL COVERDELL FORENSIC SCIENCE IMPROVEMENT GRANT FOR NORTHERN COLORADO REGIONAL FORENSIC LABORATORY, AND AUTHORIZE CHAIR TO SIGN AND SUBMIT ELECTRONICALLY: Daren Ford, Director of the Northern Colorado Regional Forensic Laboratory, stated a grant, in the amount of $17,614.00, was received in 2020, but due to COVID-19 restrictions, was unable to utilize the funding. He shared the grant has been extended until June 2021 for use of the remaining funds for training. Commissioner Buck moved to approve said award letter and intergovernmental agreement, and to authorize the Chair to sign and submit electronically. The motion, which was seconded by Commissioner Freeman, carried unanimously. Minutes, Wednesday, February 24, 2021 Page 2 2021-0519 BC0016 • 5) CONSIDER CONTRACT ID #4496 2022 PAUL COVERDELL FORENSIC SCIENCE IMPROVEMENT GRANT APPLICATION AND CERTIFICATION OF COMPLIANCE WITH REGULATIONS FORM FOR NORTHERN COLORADO REGIONAL FORENSIC LABORATORY, AND AUTHORIZE CHAIR TO SIGN ELECTRONICALLY AND ELECTRONIC SUBMITTAL: Mr. Ford stated there is an opportunity to apply for training funds amounting to $24,300.00 for 2022. Commissioner Freeman moved to approve said application and certification of compliance with regulations form, and authorize the Chair to sign electronically and electronic submittal. Commissioner Buck seconded the motion and it carried unanimously. • 6) CONSIDER CONTRACT ID #4505 2020-2021 EDWARD BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT (JAG) PROGRAM APPLICATION FOR PURCHASE OF 3 -DIMENSIONAL FORENSIC SCENE RECONSTRUCTION SCANNER AND AUTHORIZE ELECTRONIC SUBMITTAL: Sonja Kohlgraf, Sheriff's Office, presented the application for the purchase of a 3 -Dimensional Forensic Scene scanner amounting to $62,890.00 to efficiently scan a crime scene, which can record 45 million data points, and noted yearly maintenance will cost approximately $8,200.00. In response to Commissioner James, Ms. Kohlgraf explained the functions of the scanner. The motion to approve said application and authorize electronic submittal was made by Commissioner Buck, seconded by Commissioner James, and it carried unanimously. 7) CONSIDER CONTRACT ID #4506 2020-2021 EDWARD BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT (JAG) PROGRAM APPLICATION AND CERTIFICATIONS FORM FOR BODY WORN CAMERA PURCHASES, AND AUTHORIZE CHAIR TO SIGN ELECTRONICALLY AND ELECTRONIC SUBMITTAL: Ms. Kohlgraf stated this application is for the purchase of 130 body -worn cameras, hardware and wave points, at a cost of $511,250.00. She noted the body -worn cameras will be used to comply with Colorado Senate Bill 20-217, and explained jail and court deputies will wear said cameras when responding to disturbances. In response to Chair Moreno, Ms. Kohlgraf confirmed the application is for a portion of the Sheriff's Office staff, as there are over 400 employees in the Sheriff's Office. Commissioner Buck stated she is in opposition to the Bill since it is an unfunded mandate, but because it is required of the Sheriff's Office, she is in support of approval of the Resolution to maintain compliance. Commissioner Freeman moved to approve said application and certification form and authorize the Chair to sign electronically and electronic submittal. The motion was seconded by Commissioner James and it carried unanimously. • 8) CONSIDER CONTRACT ID #4498 SOFTWARE LICENSE AND SERVICES AGREEMENT FOR LIFESPOT MOBILE DEVICE APP AND AUTHORIZE CHAIR TO SIGN — PREPARE PROTECT DEFEND, LLC: Ms. Kohlgraf stated the agreement is for the LiveSpot mobile device application, which allows victims to alert first responders when an active shooter is present. Commissioner Freeman moved to approve said agreement and authorize the Chair to sign. Seconded by Commissioner Buck, the motion carried unanimously. • 9) CONSIDER GRANT APPLICATION FOR ENERGY AND MINERAL IMPACT ASSISTANCE FUND (EIAF) PROGRAM FOR CR 43 IMPROVEMENTS PROJECT (MARCH CYCLE -TIER I) AND AUTHORIZE ELECTRONIC SUBMITTAL: Elizabeth Relford, Deputy Director of the Department of Public Works, requested the Tier I Colorado Department of Local Affairs (DOLA) application be submitted to receive a $200,000.00 grant for a full -depth Road Project on County Road (CR) 43, spanning approximately 3.75 miles. She indicated there is an overmatch of more than $1,000,000.00, and stated this project directly impacts Weld County's Haul Route Program (HARP) Program for Oil and Gas haul routes, and she noted the application incorporates new resiliency criteria. Commissioner James commended Ms. Relford on her efforts for this grant and commented on the changes to the application made by the State. In response to Chair Moreno, Ms. Relford confirmed this application will not require Minutes, Wednesday, February 24, 2021 Page 3 2021-0519 BC0016 a presentation and reported the application should have a quick review period. Commissioner James moved to approve said application and authorize electronic submittal. The motion, which was seconded by Commissioner Buck, carried unanimously. El 10) CONSIDER REVOCATION OF PERMIT AUTHORIZING ERECTION, CONSTRUCTION, AND MAINTENANCE OF ELECTRIC TRANSMISSION AND DISTRIBUTION LINE AND SYSTEM ALONG AND UPON COUNTY HIGHWAYS - POUDRE VALLEY RURAL ELECTRIC ASSOCIATION (PVREA): Bob Choate, Assistant County Attorney, stated due to a Resolution that was approved in 1940, PVREA has not been applying for the necessary permits according to Chapter 8, Article XIII, of the Weld County Code. He stated PVREA has since assured they will proceed with adhering to correct permitting requirements and he recommended referring the matter back to staff for further communications. Commissioner Buck thanked Mr. Choate for his due diligence. Commissioner Freeman moved to refer the matter back to staff. The motion was seconded by Commissioner James and it carried unanimously. • 11) CONSIDER COMPLIANCE ORDER ON CONSENT CONCERNING IMPROVEMENT PROJECTS ON SH 392 AT INTERSECTIONS WITH CRS 47 AND 74, AND AUTHORIZE CHAIR TO SIGN: Mr. Choate stated an enforcement action had been performed by the Colorado Department of Public Health and Environment, Water Quality Control Division, in which a violation for improvement projects was issued in 2018. He expressed disagreeance of the violation as it was alleged, but recommended the stipulation order be executed, as the terms are financially agreeable and continued litigation would result in large financial risks, and confirmed there have been no additional notices of violation from the State. Commissioner James moved to approve said compliance order on consent and authorize the Chair to sign. Commissioner Freeman seconded the motion and it carried unanimously. • 12) SECOND READING OF CODE ORDINANCE #2021-01, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 8 PUBLIC WORKS, OF THE WELD COUNTY CODE (APPENDIX 8-Q WELD COUNTY ENGINEERING AND CONSTRUCTION CRITERIA): Commissioner Freeman moved to read by title only. Seconded by Commissioner James, the motion carried unanimously. Bruce Barker, County Attorney, read the title for the record. Dawn Anderson, Department of Public Works, explained the purpose of the Ordinance and detailed the Engineering and Construction Criteria Manual provides updates for contractors and applicants. She noted there have been no changes between First and Second Reading. No public comment was given. Commissioner James moved to approve Code Ordinance #2021-01 on Second Reading. The motion was seconded by Commissioner Freeman and it carried unanimously. • 13) FIRST READING OF CODE ORDINANCE #2021-03, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTERS 2 ADMINISTRATION AND 5 REVENUE AND FINANCE, OF THE WELD COUNTY CODE (FLEET SERVICES CODE CHANGES): David Springer, Department of Fleet Services, stated the purpose of this Ordinance is to reflect the organizational changes to the Department of Fleet Services. Commissioner Freeman expressed no issues with the changes and reaffirmed they are to make the Code consistent with the organizational structure that currently exists within the department. No public comment was given. Commissioner Buck moved to approve said Code Ordinance #2021-03 on First Reading. Seconded by Commissioner Freeman, the motion carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. Code Ordinances #2021-01 and #2021-03 were approved on Second and First Reading, respectively.
