RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MONDAY, OCTOBER 11, 2021 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, October 11, 2021, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Steve Moreno, Chair Commissioner Scott K. James, Pro -Tern Commissioner Perry L. Buck Commissioner Mike Freeman Commissioner Lori Saine Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Houstan Aragon Controller, Barbara Connolly • MINUTES: Commissioner Buck moved to approve the Minutes of the Board of County Commissioners meeting of September 27, 2021, as printed. Commissioner Saine seconded the motion, and it carried unanimously. El READ ORDINANCE BY AUDIO: Commissioner James moved to read Emergency Ordinance #257-A and Code Ordinance #2021-15 by audio. The motion was seconded by Commissioner Freeman, and it carried unanimously. • PUBLIC INPUT: No public input was given. AMENDMENTS TO AGENDA: There were no amendments to the agenda. • CONSENT AGENDA: Commissioner James moved to approve the Consent Agenda, as printed. Commissioner Saine seconded the motion, and it carried unanimously. COMMISSIONER COORDINATOR REPORTS: Commissioner Buck stated 66% of the initial Emergency Rental Assistance (ERA) funds have been fulfilled, surpassing the Federal requirement of 65%, waiving the requirement for Weld County to revert funds or submit a Performance Improvement Plan. She further stated that as of October 8, 2021, $5,896,000.00 in ERA funds have been approved and on October 6, 2021, the Weld County Senior Symposium was held with 116 attendees and 26 sponsors. Commissioner Freeman explained he and Chair Moreno attended the Accelerate Colorado Conference in Washinton D.C. and commented on the benefits of visiting with other rulemakers of 12 l©3 Minutes, Monday, October 11, 2021 Page 1 2021-2851 BC0016 Colorado. Chair Moreno echoed Commissioner Freeman's observations regarding collaboration with local and state legislators and stated helpful information was provided by the President Biden Administration in regards to unemployment in the nation. Commissioner James stated Greenhouse Gas Rulemaking Sessions throughout the State have been completed, noting there were nine (9) sessions, and written comments are to be submitted by Friday, October 15, 2021. He further stated he and Commissioner Buck attended the Colorado Counties, Inc. (CCI), legislative committee, in which committee members proposed five (5) different taxation bills; however, only one (1) bill regarding County lodging taxes is moving forward. Commissioner Saine stated she, Commissioner James, Bruce Barker, County Attorney, Jason Maxey, Director of the Oil and Gas Energy Department, Tom Parko, Director of the Department of Planning Services, and Dan Joseph, Director of Environmental Health Services in the Department of Public Health and Environment, attended the Energy and Environment Leadership Symposium and discussed pursuing energy methods for economic concerns without sacrificing environmental concerns, oil and gas energy being essential, and in the past 20 years, dependence on fossil fuels for energy has gone from 86% to 84% and decarbonizing to 0% in the next 30 years is not only unobtainable, but would harm those living in poverty across the nation and world. PROCLAMATIONS: 1) NATIONAL FARMER'S DAY - OCTOBER 12, 2021: Chair Moreno read the proclamation for the record. In turn, each Commissioner shared their sentiments about the importance of agriculture as the backbone of Weld County, stating farmers drive the economy, with Weld County ranking first in the State of Colorado and eighth in the nation for agriculture production. WARRANTS: 1) GENERAL WARRANTS - OCTOBER 6, AND 8, 2021: Commissioner Buck moved to approve the General Warrants, as printed. Commissioner James seconded the motion, and it carried unanimously. BIDS: 1) APPROVE BID #B2100125, WELD COUNTY FUEL SITE UPGRADE - FACILITIES DEPARTMENT: Rob Turf, Purchasing Department, stated two (2) bids were received and staff recommends approval of the low bidder meeting specifications, Growling Bear Company, Inc., in the amount of $1,902,037.00. Commissioner Freeman moved to approve said bid. The motion was seconded by Commissioner James and it carried unanimously. OLD BUSINESS: 1) EMERGENCY ORDINANCE #257-A, IN THE MATTER OF A SUPPLEMENTAL APPROPRIATION FOR THE YEAR 2021 (CONT'D FROM 9/27/2021): Don Warden, Director of Finance and Administration, stated the County typically considers two (2) supplemental appropriation Ordinances each year for unforeseen costs that were not initially budgeted, explained there are two (2) line -item documents attached to Emergency Ordinance #257-A for Board review, and summarized the proposed supplemental appropriation items. There was no public testimony offered. Commissioner James moved to approve Ordinance #257-A on an emergency basis. Seconded by Commissioner Buck, the motion carried unanimously. kJ NEW BUSINESS: 1) CONSIDER CONTRACT ID #5277 AGREEMENT FOR PROFESSIONAL SERVICES AND AUTHORIZE CHAIR TO SIGN - HUMANE SOCIETY OF WELD COUNTY: Sonja Kohlgraf, Sheriff's Office, stated the agreement includes an 8% increase for the year of 2022, then the cost will rise in 2023-2024 based on the cost of living increase set forth by the Colorado Consumer Index. In response to Commissioner James, Ms. Kohlgraf stated the Humane Society of Weld County justified the 8% increase due to a $300.00 per diem, per animal cost; however, they agreed to Ms. Kohlgraf's negotiated Minutes, Monday, October 11, 2021 Page 2 2021-2851 BC0016 lower value in the subsequent years of the agreement based on the Colorado Consumer Index. In response to Chair Moreno, Ms. Kohlgraf explained the cost of housing an inmate is significantly less, but the Humane Society of Weld County was reluctant to negotiate further and, unfortunately, there are not an abundance of options for their services elsewhere. Mr. Warden clarified the County is obligated to hold abandoned pets for a minimum of three (3) days, afterwhich the Humane Society is responsible for the costs, including feeding and caring for the animal, as well as vaccinations. Commissioner Freeman noted the Humane Society of Weld County recoups some costs through adoption fees. Commissioner Saine suggested sourcing other options in future years. Commissioner Freeman moved to approve said agreement and authorize the Chair to sign. The motion, which was seconded by Commissioner James, carried unanimously. la 2) CONSIDER CONTRACT ID #5291 2021-2022 GRANT APPLICATION FOR BODY WORN CAMERAS FOR WELD COUNTY DETENTIONS AND COURT DEPUTIES, AND AUTHORIZE SHERIFF'S OFFICE TO SUBMIT ELECTRONICALLY: Ms. Kohlgraf explained the grant application is for the amount of $25,695.00 in funding to cover a portion of the additional 281 body worn cameras needed for detention and court deputies to comply with current regulations. Commissioner Buck moved to approve said application and authorize the Sheriff's Office to submit electronically. Commissioner James seconded the motion and it carried unanimously. 3) CONSIDER DECLARING CERTAIN EQUIPMENT AS SURPLUS PROPERTY, AUTHORIZE SALE OF SAME TO 11TH JUDICIAL DISTRICT ATTORNEY'S OFFICE, AND DELEGATE AUTHORITY TO CONTROLLER TO SIGN ANY NECESSARY DOCUMENTS: Barbara Connolly, Controller, stated the 11th Judicial District Attorney's Office offered to purchase two (2) vehicles that were set to go to auction, a 2012 Chevrolet Tahoe and a 2015 Ford Taurus, both totaling $3,000.00 each. The motion to approve said declaration of surplus property and sale of same to the 11th Judicial District Attorney's Office, and authorize the Controller to sign any necessary documents, was made by Commissioner Buck, seconded by Commissioner James, and it carried unanimously. PLANNING: 1) FIRST READING OF CODE ORDINANCE #2021-15, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 23 ZONING AND CHAPTER 24 SUBDIVISIONS, OF THE WELD COUNTY CODE (BULK REQUIREMENTS AND PUBLIC WATER): Angela Snyder, Department of Planning Services, reviewed the changes proposed in Code Ordinance #2021-15, including building coverage, replacing the 4% Rule, public water, and poultry in the R-5 Zone District. There was no public testimony concerning this matter. Commissioner James moved to approve Code Ordinance #2021-15 on First Reading. The motion was seconded by Commissioner Saine and carried it unanimously. RESOLUTIONS AND ORDINANCES: Ordinance #257-A was approved on an Emergency basis and Code Ordinance #2021-15 was approved on First Reading. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
