Kerber, that Ar. Paumgartener has signed this petition as owding part of :section 13-7-61. The road viewers, when laying out said road for the a cc omodat io n of the people, made a detour around a small lake there in Section 13-7-61. The law require=s the viewers to la: out the road as near as practicable, on t.•:-,e ::ection line, and ;any chancre•t 'wi_atsoever from the Section line, the Poard has heretofcre h.ad the authority to make w: en necessar�yyj. Mr. Baumgartner tells me that he has just received notice of the opening of this road and that the detour provided in such • road cuts into the land which he owns. AB I look at this matter the road viewers should have assessed damages for this detour in favor of Mr. Baum- gartner. Was this done? If not , as I understand it,' the Board of County Commissioners will be authorized to agree with Mr. Baumgartx er upon the amount of such dt cge.In case the viewers failvto assess any damage could you not present this matter to the Board for consideration and. advise me as to their attitude?
