M. Weld County, Colorado, and more particularly described as follows: Commencing at the Southwest corner of said Section 23, thence North a distance of 330 feet to the point of beginning; thence East a distance of 660 feet; thence North a distance of 330 feet; thence West a distance of 660 feet; thence South a distance of 330 feet to the point of beginning, containing 5 acres, more or less, came on for hearing on January 8, 1973, and the Board of County Commissioners of the County of Weld, State of Colorado, having heard the testimony and evidence adduced upon said hearing and having considered the testimony, evidence and recommendations of the Weld County Planning Commission filed with said Board, and having carefully weighed the same, now makes the following findings: 1. The evidence discloses that the applicant failed to sustain the burden of proof as to the need for a change of zone or that the present zone is erroneous or that circumstances warrant a change of zone at that time. 2. The evidence discloses that the present zoning is complementary to the surrounding area. 3. The evidence discloses that the proposal would constitute spot zoning and that if a commercial activity was allowed, it would encourage strip commercial development along County Road No. 6 and that this would not be in the interest of good planning. 4. The evidence and investigation shows that there is a need for a study and development of a comprehensive plan for Weld County, which would include the area sought to be rezoned, and therefore, any rezoning of subject property at this time would be premature and not in the interest of good planning. 5. That each of the preceding findings in and of themselves and independent of each other constitutes a separate and individual ground for denial of the change of zone. RESOLUTION WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado, has heard the application of Bill Cates, c/o Charles Kuechenmeister, Box 512, Greeley, Colorado, for a change of zone from "A" Agriculture District to "B" Business District of a parcel of land as hereinabove recited and made a part hereof by reference and WHEREAS, the said Board has carefully considered the petition, evidence and testimony and the recommendations of the Weld County Planning Commission and has given the same such weight as it in its discretion deems proper, and is now fully advised in the premises; NOW, THEREFORE, BE IT RESOLVED, that the petition of Bill Cates, c/o Charles Kuechenmeister, Box 512, Greeley, Colorado, requesting a change of zone from "A" Agricultural District to "B" Business District of a parcel of land indicated above be, and it hereby is denied on each of the grounds as set forth in the Board's findings herein. The following resolutions were presented : f >: 7 1 0 • FINDINGS AND RESOLUTION CONCERNING PETITION OF PATRICK COLLINS FOR A DOG KENNEL OPERATION EXPANSION The petition of Patrick Collins, Route 4, Box 115 G, Longmont, Colorado, for permission to expand a dog kennel operation on the following described property, to-wit: A tract of land located in the SE: of Section 12, Township 2 • ' North, Range 68 West of the 6th P. M. , Weld County, Colorado and more particularly described as follows: \O\ Beginning at the Southeast Corner of said Section 12, thence North along, the East line of said Southeast Quarter a distance of 494. 0 feet to the true point of beginning, thence continuing North along the East line of said Southeast Quarter a distance of 330 feet to a point; thence South 89°15'30" West and parallel to the South line of said Southeast Quarter a distance of 1329. 42 feet; thence South 00°0'33" West and parallel to the East line of said Southeast Quarter a distance of 330 feet; thence North 89°15'30" East and parallel to the South line of said Southeast Quarter a distance of 1330. 27 feet to the true point of beginning, containing 10. 07 acres more or less, came on for hearing on February 13, 1973, and the Board of County Commissioners of the County of Weld, having heard the testimony and evidence adduced upon said hearing, and having considered the testi- mony, evidence and statements and recommendations of the Weld County Planning Commission filed with said Board, and having carefully weighed the same, now makes the following findings: 1. The evidence and investigation shows that the expansion of said dog kennel operation lies in a potential growth area and the same would be too visible and unsightly and not indicative of good planning. 2. The evidence and further investigation shows that certain inhabi- tants of the immediate vicinity and of the surrounding area are predominantly opposed to having the existing dog kennel operation expanded at the present location. 3. Still further investigation by the Board shows that there are a number of kennel operations in the portion of the County where the appli- cant's property is situate and that further expansion of the dog population in that area would be a public nuisance to the surrounding property owners and tend to inhibit growth in the area. ' 4. That each of the preceding findings) in and of themselves and independent of each other, constitutes a separate and individual ground for denial of the request for the expansion of said dog kennel operation. RESOLUTION WHEREAS, the Board of County Commissioners of the County of Weld has heard the application of Patrick Collins for permission to ex- pand a dog kennel operation on the following described property, to-wit: A tract of land located in the SE 4 of Section 12, Township 2 North, Range 68 West of the 6th P. M. , Weld County, Colorado and more particularly described as follows: Beginning at the Southeast Corner of said Section 12, thence North along the East line of said Southeast Quarter a distance of 494. 0 feet to the true point of beginning, thence continuing North along the East line of said Southeast Quarter a distance of 330 feet to a point; thence South 89°15'30" West and parallel to the South line of said Southeast Quarter a distance of 1329. 42 feet; thence South 00°0'33" West and parallel to the East line of said Southeast Quarter a distance of 330 feet; thence North 89°15'30" East and parallel to the South line of said Southeast Quarter a distance of 1330. 27 feet to the true point of beginning, containing 10. 07 acres more or less, and WHEREAS, the said requested dog kennel operation expansion is in an agricultural zone as set forth by the Weld County Zoning Resolution, and , t.._ WHEREAS, according to Section 3. 3 (3) of the Zoning Resolution cf - Weld County, said dog kennel operation expansion may be authorized upon the approval of the Board of County Commissioners of Weld County, and I. WHEREAS, said Board has made its findings upon the evidence and testimony submitted to it, which findings precede this resolution and by reference are incorporated herein and made a part hereof, and WHEREAS, the said Board has carefully considered the petition, evidence and testimony and the recommendation of the Weld County Planning Commission, and has given the same such weight as it in its discretion deems proper, and is now fully advised in the premises; NOW, THEREFORE, BE IT RESOLVED, that the petition of Pat rick Collins, Route 4, Box 115 G, Longmont, Colorado 80501, for permission to expand a dog kennel operation on the land indicated above be, and it hereby is denied upon each of the grounds set forth in the Board's findings therein.
