party of the second part, the receipt whereof is hereby confessed and
acknowledged, have granted, bargained, sold and conveyed, and by these
presents do grant, bargain, sell, convey and confirm unto the said party
of the second part, and its assigns, forever, all the following described
lots or parcels of land, situate, lying and being in the County of Weld
and State of Colorado, to-wit:
The South 52 feet of Lots 1, 2, 3 and 4, in Block 3,
Pence Second Subdivision, in the Town of Ault,
Weld County, Colorado, according to the recorded
map or plat thereof.
TOGETHER with all and singular the hereditaments and appurtenances
thereunto belonging, or in anywise appertaining, and the reversion and
reversions, remainder and remainders, rents, issues and profits thereof;
and all the estate, right, title, interest, claim and demand whatsoever
of the said parties of the first part either in law or equity, of, in and
to the above bargained premises, with the hereditaments and appurten-
ances. TO HAVE AND TO HOLD the said premises above bargained
and described, with appurtenances, unto the said parties of the second
part, for themselves, their heirs, executors and administrators, do
covenant, grant, bargain and agree to and with the said parties of the

second part, their heirs and assigns, that at the time of the ensealing
anddelivery of these presents we are well seized of the premises above
conveyed, as of good, sure, perfect, absolute and indefeasible estate
of inheritance, in law, in fee simple, and have good right, full power
and lawful authority to grant, bargain, sell and convey the same in
manner and form aforesaid, and that the same are free and clear from
all former and other grants, bargains, sales, liens, taxes, assessments
and incumbrances of whatever kind or nature soever, reservations,
exceptions, easements and restrictions of record; and subject to 1970
taxes due and payable in 1971, and the above premises, in the quiet
and peaceable possession of the said parties of the second part, their
heirs and assigns, against all and every person or persons lawfully
claiming or to claim the whole or any part thereof, the said parties
of the first part shall and will WARRANT AND FOREVER DEFEND.
IN WITNESS WHEREOF, the said parties of the first part have
hereunto set their hands and seals the day and year first above written.

Gentlemen:
At your request I have examined three Abstracts of Title and
the records of the Security Abstract Company of Weld County,
Colorado, covering the title to the following described real property
located in Weld County, Colorado, to-wit:
The South 52 feet of Lots 1, 2, 3 and 4, in Block 3,
Pence Second Subdivision, in the Town of Ault,
Weld County, Colorado, according to the recorded
map or plat thereof.
Title to this property is abstracted by the Security Abstract
Company of Weld County, Colorado, and last certified to under
certificate No. 21, 015, dated November 9, 1970, at 7:45 o'clock A. M.
From such examination I find as follows:
Fee simple title to all of the above described real property is
vested in O. A. BUNCH and ELSIE V. BUNCH, as Joint Tenants and
not as tenants in common, subject to and except the following:
1. Subject to exceptions and reservations as contained in
United States Patent, recorded December 12, 1892, in
Book 57, Page 224, Weld County Records.
2. Subject to liquor clause restriction as contained in deed
from Aaron J. Eaton to Charles McAllister, recorded June
10, 1895, in Book 123, Page 470, Weld County Records.

3. The property is entitled to the benefits and subject
to the burdens by reason of its inclusion in the
boundaries of the Northern Colorado Water Conservancy
District.
4. The property is entitled to the benefits and subject
to the burdens by reason of its inclusion in the
boundaries of the Ault Sanitation District and the Ault
Fire Protection District.
5. Subject to the Weld County Zoning Resolution and
all amendments thereto. Also, subject to Weld County
Subdivision Regulations and Mobile Home and Mobile
Home Park Regulations and all amendments thereto.
6. Abstract does not certify as to payment of 1969 taxes;
however, investigation shows that same have been paid,
1970 taxes, due and payable in 1971, are now a lien.
7. Rights of persons in possession, potential liens by
reason of recent improvements to the premises, if any,
and unrecorded easements or rights-of-way, if any,
may be ascertained by physical inspection of the property.
In my opinion, the title as set out above and subject to the
foregoing is good and merchantable.
