Dear Mr. Newton: I thank you for your prompt letter of January 6th , with respect to the proposed road in Township 4 , Range 64, Weld County. I drew up the petition and sent it out into the country to be signed and did not check it over very carefully , but from my check I was under the impression that all of the right of way was covered by the signatures. In your letter you say there are signers for all of the right of way , except the E-k of the NW4 of Section •11 , the E2 of the SE* of Section 11 , and the SW-1- of Section 13 . The entire NW* of Section 11 is owned by 0 . J. Standley. I think you will find opposite his name the description of his land , which is the entire Li- of Section 11 and the Wk of the SE-1-.. The E'- of the SE* of Section 11 is owned by J. B. Merrill, the hotel keeper at Kersey , who circulated the petition and signed /00 it , as I recollect it. I do not recollect at this time a/�� • • - SMITH, BROOK & FERGUSON MR. C . E. NEWTON - 2, - who is the owner of the SW-1 of Section 13, but if his signature is not on the petition now , I am quite sure it can be obtained. In °hacking this line of road over, we find that there are signers for all the right of wily except the East half of the Northwest quarter of Section 11; the East half of the Southeast quarter of Seotion 11 ; and the Southwest quarter of Section 13. If ;,you are unable to secure signers for right of way for the road just mentioned, the petition can be accepted as it is, viewers appointed by the Board and damages awarded to those owning the land who have not signed the right of way. The roads and property affected by them all lie adjacent to Box Elder Creek. The material is heavy and there is no chance of any difficulty with sands. The only obstructions to be crossed are the Lower Latham Ditch running across the South half of Section 1 and the North half of Section 12 and Box Elder Creek itself. If a bridge is put across the Lower Latham Ditch, which is very small at this point , it will not even be necessary to bridge Box Elder Creek at this time. In fact , if the road is laid out and the fences moved, it will not be necessary to do any work of any consequence at this time , except build the bridge over the Lower Latham Ditch. The enclosed petition is signed by all of the adjacent land owners , so that there will be no question about right of way. It is exceedingly important that as speedy action as possible be taken -crr+--atia matter, because these roads are necessary to SMITH, BROOK & FERGUSON CLERK OF THE BOARD OF COUNTY COMMISSIONERS - 2 - get the crops to market this summer and fall and to get into the land , practically all of which is now in cultivation. I , for example , own the North- east quarter of Section 11 , and at present I have no road either to Kersey or to Kuner. If there is any fee required in connection with this matter or any further information you desire , I will be pleased to pay the fee and appear before your Board at any time .
