RE: APPROVE MEMORANDUM OF UNDERSTANDING FOR FOSTER PARENT SUPPORT
AND AUTHORIZE CHAIR TO SIGN - FOSTER SOURCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Memorandum of Understanding for
Foster Parent Support between the County of Weld, State of Colorado, by and through the Board
of County Commissioners of Weld County, on behalf of the Department of Human Services, and
Foster Source, commencing May 1, 2021, and ending September 30, 2021, with further terms
and conditions being as stated in said memorandum of understanding, and
WHEREAS, after review, the Board deems it advisable to approve said memorandum of
understanding, a copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Memorandum of Understanding for Foster Parent Support
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Department of Human Services, and Foster
Source, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said memorandum of understanding.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 26th day of May, A.D., 2021, nunc pro tunc May 1, 2021.

Please review and indicate if you would like a work session prior to placing this item on the
Board's agenda.
Request Board Approval of the Department's Memorandum of Understanding (MOU) with Foster
Source. Temporary federal funding was made available to the State through the Coronavirus Aid, Relief,
and Economic Security (CARES) Act. The funding was distributed by the State to individual counties to
be used to address COVID-19 issues while also supporting the program goals of Title IV -B and child
welfare services. The Department plans to use $12,000.00 of the total $40,000.00 temporary funding it
received to pay Foster Source for offered programs, training, and support to Weld County foster parents.
The term of this MOO is May 1, 2021 through September 30, 2021.
This MOU has been reviewed and approved by Legal (G. Kalousek).
I do not recommend a Work Session, I recommend approval of this Memorandum of Understanding
(MOU) and authorize the chair to sign.

DEPARTMENT OF HUMAN SERVICES AND FOSTER SOURCE

THIS MEMORANDUM OF UNDERSTANDING is entered into this „%lp, day of
, 2021, by and between the Board of County Commissioners, on behalf of the Weld
County partment of Human Services, hereinafter referred to as "Human Services," and Foster
Source.
Purpose
1. The purpose of this Memorandum of Understanding (MOU) is to establish protocol for
Human Services to provide temporary funding to Foster Source and outline what services
Foster Source will provide to Weld County foster parents.
Background
1. Weld County Foster Parents have been impacted by the COVID-19 Pandemic. In an effort to
support Foster Parents and their families at all times, but especially through this Pandemic,
Human Services has sought the services of Foster Source to provide programs, trainings, and
support to Weld County foster parents.
2. Foster Source provides all services to foster parents throughout Colorado free of charge. In
an effort to offer more of these beneficial services to Weld County foster parents, Human
Services will provide temporary funding to Foster Source to increase the number of programs
and trainings offered during the term of this MOU.
3. Temporary federal funding was made available to the State through the Coronavirus Aid,
Relief, and Economic Security (CARES) Act. The funding was distributed by the State to
individual counties.
4. Funds must be used to address COVID-19 issues and must also support the program goals of
Title IV -B and child welfare services.
5. Upon notification from the State, county departments are to immediately begin spending
down this CARES Act funding. Funding must be spent by counties no later than September
30, 2021.
Term of this Memorandum of Understanding
This Memorandum of Understanding ("MOU" or "Agreement") shall be effective beginning
May 1, 2021 and shall end September 30, 2021.
Responsibilities of Foster Source
1. Foster Source will offer thefollowing four programs to Weld County foster parents
throughout the term of this MOU:
a. The Learning Source: This program provides continuing education for foster
parents. The classes are free for foster parents and include free childcare (when in
person), giving foster parents personal time through respite and kids time to spend
with other children who have experienced similar displacement issues. Classes
help make the foster parenting experience a community effort. Through this
program, Foster Source helps children and their foster parents create positive
family dynamics by building trusting relationships and offering essential tools to
navigate difficulties. Training topics include trauma, navigating the special
education system, attachment, the Indian Child Welfare Act (ICWA), unconscious
bias, various therapy options, disorders, behaviors, LGBTQ support group and
expert panels. Past expert panels have included a child welfare alumni panel,
judicial panels, appellate courts panels and elected officials panels. It is expected
that 20 to 30 Weld County foster parents will participate in the Learning Source
throughout the term of this MOU. The Learning Source program does not need to
be exclusive to Weld County foster parents.
b. Foster Source Relief Services: In order to nurture foster parents so that they can
foster better and longer, Foster Source may provide items that a foster family
identifies that would soften the foster care experience for the family and/or the
child in their care. When foster parents are valued, children in care begin to heal
sooner. The four (4) items that are requested most often are weighted items, car
seats, mattresses and bunk beds. Foster Source often helps supply diapers, family -
sized freezer meals as well as gift cards for items or experiences. It is expected
that 40 to 50 Weld County Foster Parents will participate in the Foster Source
Relief Services throughout the term of this MOU.
c. Virtual Therapy: Foster Source provides virtual therapy through its partnership
with SonderMind, a network of therapists throughout Colorado. Foster Source
sponsors these mental health sessions for foster parents throughout Colorado.
Currently, there is no limit on how many sessions are sponsored. It is anticipated
that five (5) to 15 Weld County Foster Parents will participate in Virtual Therapy
throughout the term of this MOU.
d. Leader of the Herd: Parenting Practice Lab: As prey animals, horses are a lot like
traumatized children; their survival depends on heightened awareness and
knowing who to trust. By working with horses in these labs, parents are able to
learn and practice essential skills for managing challenging, trauma -based
behaviors. No riding is involved. This five (5) hour workshop is in partnership
with Groundwork Ranch. It is expected that eight (8) to 12 Weld County foster
parents will participate in the Parenting Practice Lab throughout the term of this
MOU. The Parenting Practice Lab does not need to be exclusive to Weld County
Foster Parents.
2. If meal distribution is offered during the term of this MOU, the meals utilizing the funding
from Human Services will be for Weld County foster parents only.
3. Foster Source sends weekly e -mails highlighting upcoming events they will be hosting for
the next several weeks. Human Services staff are on this e-mail distribution list and will use
this e-mail to notify Weld County foster parents of events they may want to participate in.
4. Foster Source will submit a monthly report to Denise Suniga, Child Welfare Resource
Manager (sunigadk@weldgov.com), listing the names of Weld County foster parents and the
activities they participated in during the previous month.
5. Upon execution of this MOU, Foster Source will invoice Human Services for $12,000.00 to
provide the services outlined in this MOU. The invoice will be sent to Denise Suniga at
sunigadk@weldgov.com)
Responsibilities of Human Services
1. Upon execution of this MOU and once an invoice from Foster Source has been received,
Human Services will utilize the temporary CARES Act funding for payment of services to
Foster Source in the amount of $12,000.00.
2. Human Services will assist with advertising Foster Source's programs to Weld County foster
parents.
3. If meal distribution is offered, Human Services can assist Foster Source with the distribution
of meals.
Modifications. This Agreement may be modified in writing, in whole or in part, upon approval
of the signers.
Termination. This Agreement may be terminated at any time by either party giving thirty (30)
days written notice to the signers. No portion of this MOU shall be deemed to create an
obligation on the part of the County of Weld, State of Colorado, to expend funds not otherwise
appropriated, as this MOU is subject to the availability of funding. Therefore, Human Services
may terminate this MOU at any time if the source of funding for the services made available to
Foster Source is no longer available to Human Services, or for any other reason. Foster Source
reserves the right to suspend services to clients if funding is no longer available.
Entire Agreement. This MOU contains the entire agreement and understanding between the
parties with respect to the subject matter hereof, and may not be changed or modified except as
stated herein. This MOU shall be binding upon the parties hereto, their successors, heirs, legal
representatives, and assigns. Foster Source and Human Services may not assign any of its rights
or obligations hereunder without the prior consent of both parties.
No Third -Party Beneficiary. It is expressly understood and agreed that the enforcement of the
terms and conditions of this MOU, and all rights of action relating to such enforcement, shall be
strictly reserved to the undersigned parties and nothing in this MOU shall give or allow any claim
or right of action whatsoever by any other person not included in this MOU. It is the express
intention of the undersigned parties that any entity other than the undersigned parties receiving
services or benefits under this MOU shall be an incidental beneficiary only.
Governmental Immunity. No term or condition of this contract shall be construed or
interpreted as a waiver, express or implied, of any of the immunities, rights, benefits, protections
or other provisions, of the Colorado Governmental Immunity Act &24-10-101 et seq., as
applicable now or hereafter amended.
Independent Contractor. Foster Source agrees that it is an Independent Contractor and that
Foster Source's officers, agents or employees will not become employees of Human Services,
nor entitled to any employee benefits from Human Services as a result of the execution of this
MOU. Foster Source shall perform its duties hereunder as an Independent Contractor. Foster
Source shall be solely responsible for its acts and those of its agents and employees for all acts
performed pursuant to this MOU. Foster Source, its employees and agents are not entitled to
unemployment insurance or workers' compensation benefits through Human Services and
Human Services shall not pay for or otherwise provide such coverage for Foster Source or
any of its agents or employees. Unemployment insurance benefits will be available to Foster
Source and its employees and agents only if such coverage is made available by Foster
Source or a third party. Foster Source shall pay when due all applicable employment taxes
and income taxes and local head taxes (if applicable) incurred pursuant to this MOU.
Severability. If any term or condition of this MOU shall be held to be invalid, illegal, or
unenforceable by a court of competent jurisdiction, this MOU shall be construed and enforced
without such provision, to the extent that this MOU is then capable of execution within the
original intent of the parties.
IN WITNESS WHEREOF, the parties hereto have duly executed the Agreement as of the day,
month, and year first above written.
