WHEREAS, it has been determined by the Board of County
Commissioners, Weld County, Colorado, that a certain tract of
land, being the property of J. J. -T a Co-Partnership, composed
of T. S. Collins, Jr. , James Jay David and Joe T. Lucio, and more
particularly described as follows, to-wit:
Part of the Southwest Quarter (SW4) and part of the
Southeast Quarter (SE1) of Section 11, Township 6
North, Range 65 West of the 6th P. M. , Weld County,
Colorado, being more particularly described as follows:
Beginning at the Southwest Corner (SW Cor) of said
Section 11, and considering the West line of said Sec-
tion 11 , as bearing North 00° 04'23" East, with all
other bearings contained herein relative thereto;
Thence North 00°04'23" East, along the West line of
said Section 11, 2707. 23 feet to the West Quarter
Corner (W4 Cor) of said Section 11;
Thence South 89°29'31" East, 2255. 64 feet;
Thence South 31°52'22" East, 921. 74 feet;
Thence South 00°00'34" East, 1891. 34 feet to the South
line of said Section 11; thence South 89043'23" West, along
the South line of said Section 11, 2745. 97 feet to the Point
of Beginning;
Said described parcel of land contains 165. 015 Acres, more
or less, including a strip of ground 30 feet in width along the
West and South lines of said Section 11, reserved for County
Road Right-of-Way purposes and is subject to any rights-of-way
or other easements as recorded by instruments of record or as
now existing on said parcel of land,
does not come within the purview of the definition of the terms "subdivision"
and "subdivided lands" as set forth in CRS 106-2-23 (a) and (b) 1963, as
amended,
NOW, THEREFORE, BE IT RESOLVED, that the hereinabove
described tract of land owned by J. J. -T a Co-Partnership, composed of
T. S. Collins, Jr. James Jay David and Joe T. Lucio be exempted from
the definition of the terms "subdivision" and "subdivided land" as provided
for in the new Weld County Subdivision Regulations at Section 2-1, A. , (3)
adopted August 30, 1972.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 30th day of October, A. D. ,
1974, nunc pro tuns as of October 16th 1974.

RE: Recorded Exemption #146
Dear Sirs. _The tacked appl catj���''on and other items are in reference to a request,
by T. S. Collins, Jr. ,\,for a Recorded Exemption under Section 9 of the
Weld County Subdivision Regulations. The parcel of land in question is
approximately 165 acre 4 of irrigated agricultural land.
Based upon the -information submitted and Weld County requirements, the
Planning Commission staff recommends the request for a Recorded Exemption
be approved for the following reasons:
1 . It is the opinion of the staff that the proposed land
division is in compliance with the Weld County Compre-
hensive Plan in-so-far as it promotes agricultural use.
2. The proposed Recorded Exemption satisfies all requirements
set forth in Section 9-4 of the Weld County Subdivision
Regulations for a Recorded Exemption.
3. The proposed land division satisfies the intent clause,
Section 9-2, of the Weld County Subdivision Regulations
in that proposed parcel B contains essentially non-
