Home My WebLink About710291.tiff RESOLUTION WHEREAS, a public hearing was held on Monday, December 13, 1971, in the chambers of the Board of County Commissioners of Weld County, Colorado, for the purpose of hearing the petitioner of Vern Johnson, Route 1, Box 160, Kersey, Colorado, requesting permission to locate a hog farm operation on the following described property, to-wit: South Half of the East Half of the Southwest Quarter (SzESW ) of Section Thirty (30), Township Four (4) North, Range Sixty-four (64) West of the 6th P. M. , Weld County, Colorado, containing 40 acres, more or less, and WHEREAS, the petitioner was present, and WHEREAS, there was some opposition to the request of petitioner to locate said hog farm operation on the above described premises, and WHEREAS, the said requested hog farm operation is located in an Agricultural Zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(3)(c) of the Zoning Resolution of Weld County, said hog farm operation may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Vern Johnson, Route 1, Box 160, Kersey, Colorado, to locate a hog farm operation on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That said hog farm operation shall not exceed 6, 000 head at any one time. 3. That petitioner shall proceed with due diligence to effect said hog farm operation and that he shall have up to one year from date hereof to begin construction of said operation. 4. That all applicable subdivision and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. Subject to road bond for construction of frontage road . Mr . Heinz stated the covenants will be tied to the Unit Development . There will be wells to furnish the water. Johnson , Vern Hill , Kenneth Salzer , Lowell Adams and Melvin Dinner , Attorney., DISCUSSION : Mr . Dinner presented the plot plan for the hog operation also how the buildings will be constructed . There will, be 20 con- finement pens and a total of 6000 hogs . Also explained how the paunch material from Monforts will be utilized in the feeding oper- ation. Mr. Bowles read .Mr . Lorenson ' s recommendations for approval , recommended by the Health Department , favorable comments from the Extension office , it is compatible with surrounding ° land use and zoning and the Land Use Policy. There are no indications of soil problems or pollution. It should be subject to construction to be-- gin within one year of approval by the County Commissioners and a maximum of 6000 head . MOTION : By Mr. Watson to take the matter under advisement. Second by Mr. Clark. A vote of "Aye" by Clark , Watson , Bowles and Nix. Motion carried . RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners subject to a maximum of 6000 head and construc- tion to begin within one year of approval by them. Bowles read a letter from the Health Department . statin'g it is not in the interest of good public health practice to approve any livestock raising , or ;feeding operation within a town or any confined area of human habitation . Mr. Dugan stated the waste material will not go into a cesspool but will be hauled away . Mr . Nix stated he felt it warrants an inspection . Mr. and Mrs . Mathews appeared in behalf of Mr . Dugan stating he had a clean operation . MOTION : By Mr . Clark to take the matter under advisement. Second by Mr. Nix . A vote of "Aye" by Clark , Watson , Bowles and Nix. Motion carried . Motion carried . .- APPLICANT : Miller "640" CASE NUMBER: 5-95 tape 387 SUBJECT : Preliminary plat of Casa Grande Estates First Addition LOCATION : Sec 17 T2 R67 less W2 NWa APPEARANCE : Robert Barrell , Marshall Riggs DISCUSSION : Mr. Barrell presented the preliminary plat stating Casa Grande is in the WZ NW4 which was ready for filing when it was dis- covered there is a gasoline pipe line which traversed the entire section from north to south . The easement had to be determined 700 and included on the plat. It is a 50 ' easement. An agreement with Center Weld Water District has been signed, Mr. Bowles stated Mr . Lorenson 's recommendations were for denial based on the Health Department ' s recommendation . A turkey farm is located adjacent to a portion of the Subdivision and if turkey farms are to be separated from subdivisions why not subdivisions from turkey farms? Glen Paul stated they have a high water table and high percolation, Mr. Bdrrell proposed an alternate method for getting rid of the effluent rather than leaching fields . Mr. Paul stated their regulations called for the conventional type and until the. other method is approved by the State Health Department he could not approve it. There was further discussion regarding the turkey operation. Mr . Bowles stated the remarks regarding the septic system were unsatisfying at this point. MOTION : By Mr. Nix to table the matter until more information regarding the septic system is submitted . Second by Mr. Watson. A vote of "Aye" by Clark , Watson , Bowles and Nix . Motion carried . Marx , Dave Shupe , Dale Olhausen DISCUSSION: Mr. Bowles stated Mr. Lorenson ' s recommendations were to table for a soils report. Mr. Shupe presented the soils report. Mr . Olhausen stated there had been a First Filing which has been recorded . They also applied for approval of a typical sewage treat- ment plant site which was approved by the Utility Board and the Planning Commission. It was denied by the County Commissioners . Easements on the back lot lines have been widened . There are 183 acres and 89 lots , average is a little over 2 acres per lot. It has been approved by the Health Department for septic systems . APPLICANT : Interladco SUBJECT : Development of subdivision LOCATION : 1 mile east of Kelim south of highway 34 APPEARANCE: Dale Olhausen , Warren Stoby , Jim Wilburn and Lynn Hammond. 701 I DISCUSSION : Mr. Stoby stated they had purchaseuthe property in 1968. Based on information they were able to obtain , they bought property away from the existing communities . They would like to comply with the regulations and rules in developing the area . as a Planned Unit Development. In their earlier discussions with Mr . Lorenson , they were told this type of development did not meet the Land Use Policy approved by the Planning Commission . Mr . Stoby stated they had bought the property with a residential com- munity in mind providing the amenities that would go with a over- all concept of the residential community of the highest quality. It has been revised because they found a Planned Unit Development would be more suitable . They also have an Estate planned sub- division they could present. Mr . Bowles stated it amounts to a scattered subdivision outside of existing service•:.areas , police, fire , etc. Previous subdivisions approved in scattered areas have proven that there are many complaints because these services are not immediately available. He felt there is no practical reason for something being located so completely isolated .as this would be. Mr . Watson explained the policy adopted by the Planning Com- mission . The "A" zone was discussed . Mr. Murphy stated about 90% of the realtors were in agreement. A lot of it would depend upon the implementation . There was discussion regarding the 20 • acre minimum lot, which they felt was too large. The proposed Rural -Residential zone was explained which will require a minimum lot size of 22 acres which will require a zone change which will be an intermediate zone between the Estate zone and the Agricultur( zone. Greeley, CO 80631 _ _ - ., L j In reply to your request the following is the soil interpretation for the _ SW3, Sec. 30, T4N, R64W, Weld County, Colorado. - The area in question is - ' planned for a homesite with septic tank filter field for on=site sewage disposal and for a hog feeding operation. \'. . The soil is mapped 51-B, Vona loamy sand; 1-3% slope, and 72-x, Valent sand, hilly. These are deep, well-drained, coarse textured soils. . The area has very little run off, if any, and is not subject to flood- - ieg. These soils have only slight, if ariy, limitations for homesites . with septic tanks and for feeding operations. If a lagoon or holding • pond were needed, it would necessitate a blanket' of_ impervious material. The soil survey is made on the basis of 40 inch borings, although in most cases the borings are made to depths of 50 to 60 inches. The soil map should be used for general planning and does not exclude the need for on-site investigation for specific engineering purposes. James A.
