TITLE: Notice of Termination of Agreement for Medical Services with Sunrise Community Health Center

Brief description of the problem/issue:
For the Board's review and approval is a request to terminate an Agreement between Sunrise Community
Health Center (Sunrise) and the Board of County Commissioners of Weld County for the use and benefit of the
Weld County Department of Public Health and Environment (WCDPHE).
In 2002, and again in 2010, WCDPHE entered into agreements with Sunrise to provide prenatal services to
WCDPHE patients in our Greeley clinic located at 1555 North 17th Avenue. As of April 23, 2020, Sunrise
ceased providing the agreed upon services at the WCDPHE Greeley facility.
Pursuant to the 2010 Agreement, either party may terminate the agreement for any reason upon thirty (30)
days written notice of intent to terminate provided to the other party. Therefore, the Health Department is
requesting the Board's permission to terminate this Agreement, effective April 30, 2021, and further requesting
that"the Chair sign the Notice of Termination Agreement for Medical Services letter that has been prepared for
this purpose.
What options exist for the Board? (include consequences, impacts, costs, etc. of options):
At the Board's discretion, they may elect to continue with this Agreement, and request that Sunrise return to
our facility to provide the agreed -upon services. However, this will also require annual payment of $100,000 to
Sunrise to continue these services on behalf of the Health Department. Since funding is no longer available to
provide these services to WCDPHE's prenatal patients, these services will be 100% county -funded.
Alternatively, the Board may agree to terminate this Agreement and cease providing clinical space in our
Greeley facility to the Sunrise Community Health Center and cease all further payments to Sunrise for this
purpose.
Recommendation: I recommend approval to terminate the Agreement with Sunrise Community Health Center.

Re: Notice of Termination of Agreement for Medical Services
Dear Ms. Moran:
In December 2002 and then again in May 2010, the Weld County Board of County Commissioners
(Board) entered into an agreement with Sunrise Community Health Center (Sunrise) on behalf of the
Weld County Department of Public Health and Environment (WCDPHE). The 2010 agreement
replaced the 2002 agreement and is the controlling document.
In these agreements, Sunrise agreed to provide routine medical services and prenatal medical services
to qualifying clients at an average of 12.5 new clients per month (minimum) and 150 new clients
annually. Sunrise agreed to provide these services to individuals at the WCDPHE facility. WCDPHE
agreed to provide exam rooms, office space, and equipment as further described in the agreement.
Additionally, WCDPHE agreed to make payments to Sunrise for the services provided from funding
received by WCDPHE from the Maternal and Child Health Services Grant (MCH).
As of April 23, 2020, Sunrise has ceased providing the agreed upon services at the WCDPHE facility.
Additionally, WCDPHE is no longer receiving the funding under the MCHS grant being used to
reimburse Sunrise for the services provided.
Section 11 of the 2010 Agreement provides that either party may terminate the agreement for any
reason as long as thirty (30) days written notice of intent to terminate is given to the other party.
Therefore, this letter is official notice that the Board and WCDPHE are terminating this
agreement effective April 30, 2021.
