RESOLUTION RE: ACCEPT PETITION AND AUTHORIZE VACATION OF SECTION LINE ROAD RIGHT-OF-WAY LOCATED EAST OF COUNTY ROAD 21 AND WEST OF COUNTY ROAD 23, ALSO KNOWN AS COUNTY ROAD 114 - GLORIA SNELL AND DARLENE G. BLANEY TRUST, C/O ED SNELL WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Petition for Vacation of Right -of -Way from Gloria Snell, 542 North Wheatland Highway, Wheatland, Wyoming 82201-9512, and the Darlene G. ROW VACATION REQUEST Public Works has received a request to vacate a non-maintaincd Right of Way (ROW) along the alignment of what would be County Road 114 bctwccn County Road 21 and County Road 23. Thcrc is presently a two -track road that appears to be within the ROW. Thc County does not maintain this Right of Way. PROPERTY INFORMATION Thc petitioners are requesting to vacatc the ROW so that they can morc efficiently utilize their property. Thc subject property is zoned Agricultural is a working ranch. The Petitioners arc sisters and have indicatcd his land has bccn passed down for generations and together thcy ranch ovcr 1,000 acrcs. Thc applicants havc not subdividcd any of their land nor have they rcqucstcd any land use permits. Thcy intend to maintain thc agricultural usc on thc property as it has historically becn donc. Thcy believe they are thc only ones who usc the two -track road. Thcy own the 639+ contiguous acrcs directly adjaccnt to the ROW being pctitioncd for vacation. Vacating thc ROW improvcs thcir grazing operation rcmoving the need to "fence out" the ROW rather than allowing livestock to pass through unobstructed. It also allows thcm morc flcxibility in thc building envelope for watcr wells, corrals, and livestock shelters by eliminating setbacks required from public ROW. HISTORICAL ROAD RIGHT OF WAY Thc road filc identifies thc original petitioned ROW as road #511 found at Book 11 Page 195 in 1906. Rcvicw of thc road file indicates aftcr the original pctition was filed and the appointed Road Viewers additional rights of way to road filc #511 including 511m in 1907 at Book 11 Page 285 and finally being declared a Public highway by thc Board of County Commissioncrs on March 30, 1907 in Book 83, Pagc 208, Rcception Number 118394. Now known more commonly as the alignment of County Road 114; it is currently a non-maintaincd 60' road right of way. Included with the referral is thc complete Road File. Rcvicw of historical road maps available would support the claim that the ROW has always becn an unimproved or primitive ROW. GENERAL INFORMATION No othcr parcels appear to rely on this ROW to access their property as it lies between County Road 21 and County Road 25, both maintained roads. There is maintaincd ROW to the south along County Road 112 and to the north along County Road 118 which provide connectivity and alternative routes to the surrounding arca. Thcrc dots not appear to be any utilities within the ROW to be vacated nor have the Petitioners identified any easements previously conveyed. Based on the information found we have determined the following: • 60' of ROW exists for CR 114 per Road Record dated March 30, 1907 in Book 83, Page 208, Reception Numbcr 118394. • The Public Works CIP 5 Ycar Plan dots not identify any improvements to County Road 114. • No parcel is left without access is the vacation is approved. • No other County or Municipality borders the ROW. • Previous vacations have bccn approved to improve the farming and ranching activities. ADJACENT MUNICIPALIES No part of the ROW to be vacated is located within other the municipal boundaries. The proposed vacation is approximately 6 miles north and West of the Town of Nunn in an area predominantly agricultural range land. The property does not fall within 3 milts of any other town or city, nor does it fall within any IGA. Public Work's findings include: • The historical ROW has bccn in place for over 100 years and a road has not bccn built or maintained by Weld County since the right of way was accepted. • Construction of County Road 114 is not idcntificd on the Public Works 5 Year Capital Improvement Plan. • Based on information available Public Works did not find any ROW Use Permits issued within the ROW to be vacated. • No other County or Municipality borders the ROW to be vacated. • Vacating the ROW does not leave any land adjoining the roadway without access. • The petitioners own the property on both sides of the ROW to be vacated. Public Works finds the historical ROW is not necessary for the public and meets the criteria necessary for vacating right of Way. Further, Public Works agrees ROW creates an unnecessary burden to the landowner because of necessary setbacks required from the ROW limit the owns ability to fully utilized their property.
