WELD COUNTY
CODE ORDINANCE 2021-19
IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS,
CHAPTER 5 REVENUE AND FINANCE, OF THE WELD COUNTY CODE
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF
WELD, STATE OF COLORADO:
WHEREAS, the Board of County Commissioners of the County of Weld, State of
Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with
the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, on December 28, 2000, adopted Weld
County Code Ordinance 2000-1, enacting a comprehensive Code for the County of Weld,
including the codification of all previously adopted ordinances of a general and permanent nature
enacted on or before said date of adoption, and
WHEREAS, the Weld County Code is in need of revision and clarification with regard to
procedures, terms, and requirements therein.
NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of the
County of Weld, State of Colorado, that certain existing Chapters of the Weld County Code be,
and hereby are, repealed and re-enacted, with amendments, and the various Chapters are
revised to read as follows.

BE IT FURTHER ORDAINED by the Board that the Clerk to the Board be, and hereby is,
directed to arrange for Municode to supplement the Weld County Code with the amendments
contained herein, to coincide with chapters, articles, divisions, sections, and subsections as they
currently exist within said Code, and to resolve any inconsistencies regarding capitalization,
grammar, and numbering or placement of chapters, articles, divisions, sections, and subsections
in said Code
BE IT FURTHER ORDAINED by the Board, if any section, subsection, paragraph,
sentence, clause, or phrase of this Ordinance is for any reason held or decided to be
unconstitutional, such decision shall not affect the validity of the remaining portions hereof The
Board of County Commissioners hereby declares that it would have enacted this Ordinance in
each and every section, subsection, paragraph, sentence, clause, and phrase thereof irrespective
of the fact that any one or more sections, subsections, paragraphs, sentences, clauses, or
phrases might be declared to be unconstitutional or invalid
The above and foregoing Ordinance Number 2021-19 was, on motion duly made and

Mileage zones were created to introduce a flat rate
and establish consistency in mileage rates from year
to year. The mileage zone is based on the distance
from the Weld County Sheriff's Office Law
Administration Builcing to the Post Office based on Zip
Code. The mileage fee will be charged based on the
Zip Code of the mailing address of the Civil paperwork,
and will only be charged once regardless of how many
attempts are made or the miles actually driven.

32. Staff time for applicants or constituents that
propose novel uses or development that does not fit
into established fee categories where staff will spend
4 or more hours of review, oversight or assistance.
The hourly rate shall be calculated on a full cost
recovery basis of the County's costs for the staff
positions involved in the assistance. The full cost
recovery rate shall be determined by the Director of
Finance and Administration and shall include salary,
fringe benefits, support costs (services and supplies)
and indirect costs calculated in accordance with the
County -wide cost allocation plan per Federal OMB -87
methodologies.
Constituents shall deposit the estimated amount of
the costs prior to assistance. The County will draw
upon it based on the standard hourly rate for each
staff providing the review, oversight or assistance.

2 The fee to amend an application for a Special Review Permit for Solid Waste Disposal Sites and Facilities shall not
exceed $20,000.00. The full amount shall be submitted to the Department of Planning Services at the time a
complete application is submitted. The fee will be held and charged against by the County based on the standard
hourly rate for each department administering or reviewing the permit. The departments shall include, but not be
limited to, the Department of Planning Services, Health Department, Public Works and the County Attorney's
Office. The standard hourly rate shall be established by the Weld County Finance Department for the actual time
spent on the review of the application and facility. The rate shall be calculated on a full cost recovery basis of the
County's cost and shall include salary, fringe benefits, support costs (services and supplies) and indirect costs

APPENDIX 5-L REQUIRED BID AMOUNT
Pursuant to Article XIV, Section 14-9, Section 5 of the Weld County Home Rule Charter, written, sealed bids and a
ten-day period for consideration and investigation of the bids are required for purchases in excess of an amount set
annually by the Board of County Commissioners by ordinance. Through repeal and reenactment of this Appendix,
the amount set for the year ;2017 2022 is $25,000.00; however, the amount is $150,000.00 for all contracts for a
disaster emergency event in the case where a declaration of disaster is made by the Board of County Commissioners.
