Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS GENERAL PROJECT INFORMATION/LOCATION Project description: A Site -Specific Development Plan and Use by Special Review Permit for Medium Scale Solar Facility outside of subdivisions and historic towns ites in the A (Agricultural) Zone District. This project is north of CR 62 and is east of CR 45. Parcel number 080334000024. Access is from CR 62. ACCESS Weld County Public Works has reviewed the application materials related to access. Access will be onto County Road 62. This portion of County Road 62 is under the jurisdiction of the City of Greeley. Contact the City of Greeley concerning access permitting. ROADS AND RIGHTS -OF -WAY This portion of County Road 62 is under the jurisdiction of the Town of Greeley. The municipality has jurisdiction over access to the road. Please contact the municipality to verify the right-of-way requirements, access permit or for any additional requirements that may be needed to obtain or upgrade the permit. DRAINAGE REQUIREMENTS This area IS within an Urbanizing Drainage Area: Urbanizing Drainage Areas typically require detention of runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained water at the historic runoff rate of the 1 -hour, 5 -year storm falling on the undeveloped site for URBANIZING areas. Detention Pond summarized in a Drainage Report: The applicant has submitted a preliminary drainage report. A final drainage report and detention pond design completed by a Colorado Licensed Professional Engineer is required prior to recording the USR map. The drainage report must include a certification of compliance stamped and signed by the PE. A Certification of Compliance form can be found on the Public Works Development Review website. General drainage report checklist is available on the engineering website. More complete checklists are available upon request. Historic Flows: The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from the property. GRADING PERMIT A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications are accepted after the planning process is complete (plan recorded). An Early Release Request Form may be entertained only after the applicant, Public Works and Planning Department have reviewed the referral and surrounding property owner comments. The Early Release Request may or may not be granted depending on referral comments and surrounding property owner concerns. Contact an Engineering representative from the Public Works for more information. A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact: Colorado Department of Public Health and Environment, Water Quality Control Division, 303-692-3575. CONDITIONS OF APPROVAL A. A Final Drainage Report and Certification of Compliance stamped and signed by a Professional Engineer registered in the State of Colorado is required. (Department of Public Works) B. The plan shall be amended to delineate the following: 1. This portion of County Road 62 is under the jurisdiction of the City of Greeley. Please contact the municipality to verify the right-of-way. Show and label the right-of-way. Show the approved access(es) on the site plan and label with the approved access permit number if applicable. (Department of Public Works) 2. Show and label the accepted drainage features. Stormwater ponds should be labeled as "Stormwater Detention, No -Build or Storage Area" and shall include the calculated volume. Environmental Health Services has reviewed this Site -Specific Development Plan and Use by Special Review Permit for a Medium Scale Solar Facility outside of subdivisions and historic townsites in the A (Agricultural) Zone District. As no employees will be located at the site, permanent water and sewer is not required. Screened portable toilets, hand washing units and bottled water can be utilized during construction. We recommend the following requirements are incorporated into the permit as development standards: 1. During construction, all liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. During construction, no permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S. 3. During construction, waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The facility shall operate in accordance with Chapter 14, Article 1 of the Weld County Code. 4. Fugitive dust and fugitive particulate emissions shall be controlled throughout the duration of construction of the facility. Reflectivity or glare from solar arrays could be detrimental to pilot and aircraft safety. The Federal Aviation Administration (FAA) has determined that certain configurations of solar arrays can present temporary or constant glare issues that may temporarily blind pilots. The airport has done work with solar arrays in the past and even has one on property so they can be compatible with our land use. The Greeley -Weld County Airport Authority requests that an FAA Form 7460-1 be submitted by the applicant to determine any effects on our airspace. The 7460 will determine whether the solar array will affect physical airspace (structure penetration etc), radio and radar frequencies, and navigable airspace. In addition, the Greeley -Weld County Airport Authority requests that a glare analysis be performed for the site. The site currently sits under several aircraft "patterns" and is adjacent to our runways. A glare analysis should show how much glare can be expected from the panels to pilots in the area at all times of day and the year. If glare can be minimized through a diffuse coating or outer layer on the panels, we would be in favor of it. Should the FAA Form 7460-1 and glare study find no significant impact to the safe and efficient use of the Greeley -Weld County Airport and it's airspace, we will have no further comments. Water Division 1, Water District 3 Dear Mr. Hall: We have reviewed the above referenced proposal for Site Specific Development Plan and Use by Special Review for a medium scale solar facility. The submitted material does not appear to qualify as a "subdivision" as defined in section 30-28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments will not address the adequacy of the water supply plan for this property or the ability of the water supply plan to satisfy any County regulations or requirements. The application seeks to construct a medium scale solar facility on the north half of a 40 -parcel. The parcel currently contains a single-family dwelling, a shed, and the remainder of the property is used for agricultural purposes. The proposed solar facility will be to the north of the existing structures on land currently used for agricultural purposes. Potable water is not required for the solar facility during operation. During construction, the water supply will be bottled water, and portable toilets will be utilized for sanitation. If necessary, dust control will be accomplished with the use of a water tanker. During operation, the facility will be unmanned and will not be frequented by employees at long intervals, therefore a permanent water supply is not required. The site is proposed to be restored to its original use for agricultural purposes once the temporary facility is decommissioned in 20-30 years. The current water supply for the existing single-family dwelling on the property was not identified in the application materials. The property is within the boundaries of the North Weld County Water District, therefore it is possible that the dwelling is served by an existing tap. If the single-family dwelling is served by a well, Weld County Assessor records show that the dwelling was constructed in 1899, therefore it is likely that a domestic well on the property would not be of record with this office. The well with permit no. 4447-R was decreed as Well No. 4447 in Division 1 Water Court Case no. W-884 for irrigation use. Well permit no. 4447-R is included in the Well Augmentation Subdistrict of the Central Colorado Water Conservancy District's augmentation plan decreed in case no. 03CW0099. The well may continue to be used for irrigation purposes in accordance with the terms and conditions of its well permit and decree(s). The Drainage Report, prepared by Westwood, states that there will be a detention pond constructed on -site as a part of this project. The applicant should be aware that, unless the structure can meet the requirements of a "storm water detention and infiltration facility" as defined in section 37-92-602(8), C.R.S., the structure may be subject to administration by this office. The applicant should review the Division of Water Resources' Administrative Statement Regarding the Management of Storm Water Detention Facilities and Post-Wildland Fire Facilities in Colorado, available on our website, to ensure that the notification, construction, and operation of the structure meets statutory and administrative requirements. The applicant is encouraged to use the Colorado Stormwater Detention and Infiltration Facility Notification Portal, located at https://maperture.digitaldataservices.com/gvh/?viewer=cswdif, to meet the notification requirements.
