X/,8 �"G/ t RESOLUTION WHEREAS, a public hearing was held on September 11, 1972, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of W. H. Webster, Route 4, Box • 164A, Greeley, Colorado, requesting permission for expansion of an existing cattle feed lot operation on the following described property, to-wit: The Northeast Quarter (NE j) of Section Six (6), Township Five (5) North, Range Sixty-Four (64) West and the Northwest Quarter (NW4) of Section Six (6), Township Five (5) North, Range Sixty-Four (64) West of the Sixth P. M. , Weld County, Colorado, and WHEREAS, the petitioner was present and represented by counsel, and WHEREAS, there was some opposition to the request of petitioner for the expansion of said cattle feed lot operation, and WHEREAS, the said requested cattle feed lot operation is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(3)(c) of the Zoning Resolution of Weld County, said cattle feed lot operation or any expansion thereof may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner, and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of W. H. Webster, Route 4, Box 164A, Greeley, Colorado, for expansion of an existing cattle feed lot operation on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That petitioner shall proceed with due diligence to expand said cattle feed lot operation and shall have up to one year from date hereof to begin construction for the expansion thereof. 3. That when expansion of said cattle feed lot is completed, same shall not contain more than 24, 000 head at any one time. 4. That petitioner shall construct sealed lagoon or lagoons as proposed. 5. Subject to a greenbelt being established at least 200 feet wide along State Highway No. 263 thus screening off such roadway with a suitable type of vegetation. PL0609 3P.' S/911 720314 - 4 rJ 6. Subject to only one road entrance onto the property from State Highway No. 263. 7. Subject to a 20 foot road right of way dedicated to Weld County for road purposes along County Road No. 49. 8. Subject to said feed lot facility being located not less than 660 feet from State Highway No. 263 in accordance with Section 3.3-A (2) (B) of the Zoning Resolution of Weld County. • 9. Need variance of 10' set back from County Road #61. Existing structure has been therefor 50 years. An addition on the other side of the house would not work out. There is an existing 6' extension which will be torn down and a 12' extension (x 24' ) will be added, actually making it only 6' closer then it presently is. No projected highway expansion plans. CASE NUMBER: V-351:72:55 SUBJECT: Set Back LOCATION: NWA S of Ogilvy Ditch; •NE/4 Sec 6 T5 R64 APPEARANCE: Charles Karowsky, Attorney; Jim Whitmore; Bill Webster DISCUSSION: Appeal is based on a hardship situation. Mr. Karowsky stated that they were not appealing from the County Commissioners, but appealing directly • to the Board of Adjustment under Zoning Regulations. Request for expansion of feedlot was made and granted by the County Commissioners in September. Farr Farms has been granted permission to install a commercial feedlot operation north of Webster's request. Present feed- lot capacity (for Webster). is 15,000,head of livestock. If entire expansion is granted, it would allow an additional '8,685 head. At the present time, if the 660' set back from county road were to be inforced, they would lose approximately 3,000 head from original request which was granted. Under the regulations of the County, a 200' greenbelt is re- quired which Webster has allowed for. State Highway bounds this property on the South side. There is a letter in the file from the State Highway Department in which they indicate they have no objections to the building of pens within the 660' set back. If the 660' set back were imposed, there would be approximately 460' of wasted land because of the unique shape and size of this particular parcel of ground. Mr. Whitmore pointed out on the' map the different parts of the feedlot. City lagoon immediately north of this area. Mr. Karowsky stated that their position was this, .."The 660' requirement in this instance works an undue hardship because of the' unique nature of the area and the use to which it is being put and because of the intense feeding operations that are going on now; we would be left with a strip of land that could be used most advantageously for •this purpose (feedlot)"... Did not feel that they would-be burdening the community with another 3,000 head. Bill Webster 'outlined briefly the procedures of cleaning the pens. Lagoons will at no time be located into the 200' greenbelt. Robert Burroughs, Attorney representing Robert McConnell. The reason they are opposed to this is not because of any State law requirements, but rather because of the County Zoning Resolution (Quoted 3.3(3)(b)). The people opposing this felt this was binding and should be enforced. Mr. Burroughs also-quoted 8.3 Reasons for Rezoning; and 9.1 (3)(c). 22, 123 & 124 Page 189 /� Mr. Burroughs further stated that he did'not feel it had been shown • that this property was unique in any manner or different from any of the other property in this area. Mr. McConnell did not feel that the 660' x 1/2 mile long strip of land required for the set back was a poor piece of land. He felt it could be farmed without any trouble. Lagoon is right across from Mr. McConnell's house. Lagoons smell bad. Resolution also states 660' from a dwelling on another lot. Mr. Karowsky stated that the lagoon lying to the east was there prior to zoning in 1966. Webster's Feedlot has been there since 1961. Did not feel that they would be putting any burden on the neighbors. Mr. McConnell's main objection was that if there was a law and a reso- lution that protects the other property owners in the area, then it should be adhered to. Felt the odor would be less the farther away the feedlot is. Mrs. Mitani also stated her objections. They have lived there since 1944, prior to the feedlot. It is dusty, smells, and has a lot of flies. Mrs. Cambell also stated similar opposition. Mr. Frick felt the zoning laws should be enforced. Mr. Lorenson stated the staff' s recommendations are for approval , it agrees with the land use policy , is compatible with surrounding land use and zoning , it has Health Dept. approval and water is avail - able from North Weld Water District . If approved it should be subject to : a sealed lagoon as recommended by SCS and increas- ing the size to a total of 9 . 7 acre feet to meet the Colo . Water Pollution standards as recommended by the Extension office . The lagoons to be located at least 400 ft . from the West bank of the Lone Tree Creek and a line installed to pump the waste up to the walking sprirler as required by the Health Dept. Construction to begin within 1 year of approval by the County Commissioners and limited to the pen size as indicated by the submitted plans . There should be screening along the entire south boundary peri - meter adjacent to the road for vegetation . Mr. Burrous questioned the 400 ft. requirement, stating they wanted to use the 'natural depressions . Mr. Woods voiced objections to locating the screen- ing 20 ' inside the property line , or 50 ' from the center of the road . Mr. Lorenson stated a dike could be built in lieu the 400' set-back for the lagoons from the creek. 824 RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners subject to the recommendations of the Planning staff and and 50 ' ROW dedication with the trees being planted 20' inside the property line . Mr . Lorenson stated he is recommending approval of the application as it agrees with the land use policy and is compatible with surrounding land use • and zoning . Mr. Lorenson stated the Health Department may have some requirements . Mr . Paul stated they will need to get a per- mit to operate from the Pollution office and the State Pollution Control . Mr . Lange stated the items they will have on this are exempt under existing air pollution statutes and they have applied to the State Air Pollution Commission and they were granted an exemption . Mr. Lorenson recommended a planted screen around the perimeter and construction to begin within one year of approval by the Board of County Commissioners and limited to the items shown on the submitted plan . Mr. Gaskins voiced some ob- jection to the screening requested . RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners subject to Mr . The staff recommends approval as it agrees with the land use policy, is compatible with surrounding land use and zoning , the design is judged adequate by the Extension agent . If approved it should be subject to any conditions required by the Health Dept. , construction of a lagoon as proposed , construction to begin within 1 year of approval by the Board of County Commissioners and limited to the pen size (159 ,000 sq . ft. ) and facilities as shown on the submitted plan . Mr. Miller stated according to his interpretation of the zoning regu- lations , dog kennels are a permitted use in an "A" zone . The kennel would be several hundred feet in all directions from any other house and a half-mile from the chicken oper- ation . Mr. Bailey was questionfwhether he will dwell on the property. SUBJECT: Utility Installation Agreement DISCUSSION : Miss Telep stated that after reviewing the proposed agreement , she felt it should be considered at some other level., and perhaps a public hearing held . Mr . Anderson stated he felt it is something that could be handled by the utilities themselves . MOTION : By Mr. Heitman to reject the proposal that the Utilities Installation Agreement be handled through the Planning Commission . After further discussion , Mr. Heitman withdrew his motion . MOTION : By Mr. Clark that no action be taken at this time and it is immature at this time . Second by Mr. Watson . A vote of "Aye" by Anderson , Clark , Heitman , Nix , Rothe and Watson . Motion carried . SUBJECT : Model Subdivision Ordinance for Incorporated Towns . DISCUSSION : Mr . Ohi presented the Model Subdivision Ordinance that would allow the incorporated towns to adopt , by reference . The ordinance is based on the Weld County Subdivision Resolution so that subdivision regulations will be as uniform as possible 826 _ - throughout the county. The model ordinance should be approved by both the Weld County Planning Commission and Board of County Commissioners as an official publication of Weld County to en- able towns in the county to adopt it by reference . . Miss Telep stated she would like to review the ordinance, RESOLUTION : tape 457 Be it therefore resolved to recommend approval subject to to the legality of such ordinance being approved by Miss Telep . SUBJECT : Letter from Jerry Bigbee DISCUSSION : Each member had received a letter from Mr. Bigbee asking review of single family housing tracts in place of the proposed mobile home park which he has previously submitted . The Com- mission instructed Mr. Lorenson to inform Mr. Bigbee in order to appear before the Planning Commission , an application and plat in the proper form would have to be submitted . APPLICANT : David Bailey - con ' t. DISCUSSION : There was further discussion regarding the location of the dog kennel applied for. It was agreed there should be a condition that the owner live on the property. RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commission subject to the permit be issued for the kennel after Mr. Bailey' s home is constructed and occupied . The current study is largely , concerned with developing tools to aid in the implementation of the Weld County policy in regard to agricultural land use , analysis of programs in other states aimed at protecting agricultural lands , analysis of land use policy in Weld County in reference to the policies of the State , collection and analysis of Agricultural Census data for the County. Creation of a system of maps to be used in decisions on land use . SUBJECT : Regional Work Program assignments DISCUSSION.: Mr. Cruce stated the State Planning Office would like to create a planning staff on the regional level . They felt that one man from the Larimer office and one from the Weld county office rather than having several work on the scope of services required by HUD. Mr . Cruce stated that both counties have well developed planning staffs and felt the work program could be implemented by staff members of the two counties . Mr. Lorenson stated there will be four members of the staff performing doing regional planning functions . AREA AND TRAFFIC The total area in existing feed lot pens is 81.6 acres, area in proposed lot is 36.7 acres, making a total of 118.3 - acres in pens. Total land in both proposed and existing feed lot is 213 acres. This leaves 94.7 acres for both existing and proposed green belt and support facilities . We feel this helps keep dust, odor and noise at a minimum. Pens are located 60 feet or more from public roads and 20b feet or more from state roads. Fences will be !4.-pole, _ 3" in diameter. Bunks will be concrete with a 7 foot concrete apron. Alleys will be a minimum of 30 feet wide. This feed lot expansion will not create any traffic hazard because all travel will be confined to a closed area and will not cross state, county or public roads . r • When dust conditions exist the feedlotea;iS sprinkled with tanker trucks . - MANURE HANDLING • Pens are cleaned on a continuous basis,. Manure is mounded in the summer and winter months or stockpiled on our farms in the Lucerne, Eaton and Gill areas. Manure is removed by truck to local farms in the spring and fall months. Pens and manure piles are sprayed and baited with USIA .approved insecticides to control flies . A commercial company is employed on a continous basis for rodent control. • • ' 'WASTE HOLDING- PONDS Holding pond for part (A) , west addition, south of Ogilvey Ditch is for 36.7 acres of pen area and 5.73 acres . of alley. A total of 42.43 acres in this expansion, includ- ing the pond area. This pond will have a bottom area of 275 x 275 feet or 1.73 acres . The side slope will be 3:1, pond depth 7. feet with° a 2 foot free-board. Pond location will be 200 feet north of Highway 263, • 940 feet east of the west boundary "and extend 300 feet to the east and 300 feet to the north. They plan to enlarge their existing feedlots. The area in which the feedlots are located is on the second terrace of the South Platte River and on the first terrace of Lone Tree Creek which bisects the NE3 Section 6. The area is not subject to flooding from the South Platte and Lone Tree Creek has had some channel deepening and straightening to facilitate runoff from any flooding which may occur. Several holding ponds have already been constructed to catch any runoff from the feedlots in the NE3 and another is proposed to catch any runoff from the proposed feedlots in the NW%. Most of the soils in this area are shallow to sand and gravel (20 to 40 inches) and the holding ponds are being sealed with manure.
