Chris Gathman From: Chris Gathman Sent: Wednesday, January 13, 2021 11:27 AM To: Louise Schenck Subject: Staff has reviewed and determined that Well Permit will need to be applied for and approved prior to scheduling hearings Attachments: Division of Water Resources 1222.pdf Importance: High Dear Chad and Louise, I have discussed the referral with the Colorado Division of Resources with our staff. I have also spoke to the Division of Water Resources regarding their response. Staff has determined that a well permit will need to be applied for (to reflect the actual lot size) and approved before we can proceed with scheduling the Planning Commission and Board of County Commissioners hearings associated with your case. Use by Special Review permits run with the land (are permanent) — the permit (if approved) would be based on the fact that the well is permitted for more than one residence. This applies not only to today— but also in the event in future if/when the existing well would have to be replaced. We therefore need evidence that the well has been re -permitted through the Division of Water Resources —to provide verification that the new/updated well will be able to provide water to more than one residence before we can proceed. Let me know if you have any questions.
