Filing, said plat is to include utilities easements recorded, but not plated,
said area is more particularly described as follows:
A subdivision in Weld County, Colorado located in the West Half
of the Southwest Quarter (SW4) of Section 24 and in the East Half
of the Southeast Quarter (E2SE4) of Section 23 all in Township
6 North, Range 66 West of the 6th P. M., Weld County, Colorado,
being more particularly described as follows:
Beginning at the West Quarter Corner (W4 Cor) of said Section 24
and considering the North line of the Southwest Quarter (SW4) of
said Section 24 to bear South 89° 44' 08" East with all other bearings
contained herein being relative thereto:
Thence South 89° 44' 08" East along the North line of the Southwest Quarter
(SW4) of said Section 24, 1316.17 feet to the Northeast Corner of the
West Half of the Southwest Quarter (NE Cor WZ SW4) of said Section 24:
Thence South 00° 13' 38" West along the East line of the West Half

accompanying plat to the use of the public forever and hereby dedicate those
portions of said real property which are labeled as easements on the accompanying

This Agreement, made and entered into this V — day of
—IL--N11-- , 1971, by and between OGILVY IRRIGATING AND
LAND COMPANY, a corporation, and DAVID FAGERBERG, JR. , and
WHEREAS , Fagerberg owns a parcel of land in the South-
west Quarter of the Southwest Quarter (SW'SWC-4) of Section Twenty-four
(24), Township Six (6) North of Range Sixty-six (66), West of the 6th P. M. ,
Weld County, Colorado, lying West of the existing County Road, and
WHEREAS , Ogilvy owns a parcel of land in the said South-
west Quarter of the Southwest Quarter (SV4Wi;) lying West of said County
Road, East and North of that body of water known as Seeley Lake and North
of Seeley Lake Subdivision, according to the recorded plat thereof, and
WHEREAS , the parties desire to develop portions of their
said property jointly and to submit a subdivision plat thereof to the Weld
County Board of County Commissioners, and
WHEREAS , the parties desire to share certain costs of said
development.
NOW, THEREFORE, inconsideration of the premises, the
parties hereto mutually bargain and agree as follows:

(1) The above recitals are incorporated herein by reference as
though fully set forth.
COPY . The existing County Road shall be vacated and for the purposes
v y of this Agreement, all land presently constituting the road surface of said public
road, lying North of County Road 66 extended Westward to form a cul-de-sac,
shall be considered property of Fagerberg and all area in said cul-de-sac shall be
deemed property of Ogilvy.
(3) The parties agree to jointly develop the area and each shall
pay a proportionate share of development as follows:
(a) Ogilvy shall pay the following share of each cul-de-sac
adjoining each jointly owned lot. The per lot cost of each subdivision shall be
determined by dividing the number of lots into the cost of such cul-de-sac.
The cost so determined shall be divided among jointly owned lots on the basis
of acreage. That is to say, each owner of a jointly owned lot shall pay that
Iroportion of the total cul-de-sac charge for such lot which the acreage owned
bears to the total acreage of said lot.
(b) Fagerberg shall pay all expenses for moving the County
Road and having the same vacated, including all excavation expenses.
(c) Fagerberg shall pay all costs for all roads within the sub-
division which connect the County Road with cul-de-sacs.
(d) All engineering costs that can be attributable to jointly
owned property shall be divided on an acreage basis and all which are attributable
to Fagerberg alone, shall be paid by him. STATE OF COLORADO (t Rs.

(e) All water development costs shall he borne by Fagerberg
except water development costs on jointly owned lots shall be divided by the
parties hereto on an acreage basis, such development costs being limited to
transporting water from the cul-de-sac to the lot involved.
(4) The parties agree that as lots are sold, the proceeds from
those which are jointly owned shall be divided on an acreage basis.
(5) The parties agree that drainage from the area East and
North of the existing County Road and North of County Road 66 shall be pro-
vided to the said Seeley Lake and the parties to this Agreement agree to
execute suitable documents to assure such drainage. The costs of any drain
file shall be shared on the basis of the distance crossed for each owner.
(6) The parties agree that the acreage owned by each of jointly
owned lots shall be determined upon a survey and shown on the final subdivision
plat. Each party shall sign said subdivision plat and execution of such plat
shall acknowledge the correctness of the acreage shown thereon concerning
jointly owned lots.
(7) The parties further agree to execute whatever documents
are necessary to carry out the purposes of this Agreement.
