Chapter 23, ARTICLE 1— General Provisions
Amend Sec. 23-1-90. Definitions.

PUBLIC WA TER: A system for the provision to the public of water for human consumption
through pipes or other constructed conveyances if such system has at least fifteen (15) service
connections or regularly serves at least twenty-five (25) individuals, and which meets the
requirements of Section 24-3-70.B. The term includes systems that are owned or operated by
private, nonprofit entities, as well as:
a. Any collection, treatment, storage, and distribution facilities under control of the operator
of such system and used primarily in connection with such system; and
b. Any collection or pretreatment storage facilities not under such control which are used
primarily in connection with such system.
Chapter 24, ARTICLE Ill — Subdivision Design Standards
Amend Sec. 24-3-70. Potable water supply standards.
B. Public Water Supply Systems.
2. Where a public water supply system is provided through a municipality, water district,
water company or association, the applicant must provide evidence of an adequate water
supply and ability to serve the land division. If a new public water supply system is
proposed, the applicant shall provide a certified letter from the State Engineer stating that
proper water rights have been acquired, or a proper nontributary source is available for
the future use, prior to approval of the land division. The public water supply system shall
be approved by the Colorado Department of Public Health and Environment Water Quality
Control Division. If the applicant cannot demonstrate approval of the public water supply
system by the Water Quality Control Division because the system does not yet serve a
minimum of twenty-five (25) persons or fifteen (15) taps, the applicant may submit a full
design of the system for review by the County. Such design shall meet all requirements of
the Division of Water Quality's New Public Water System Capacity Planning Manual and
the Design Criteria for Potable Water Systems and shall be stamped by a Colorado -
licensed engineer. The applicant shall pay a reasonable fee that covers the costs incurred
by the County in reviewing of the public water supply system design, which may include
the costs of a contracted engineer.

WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority
of administering the affairs of Weld County, Colorado, and
HEREAS, the Board of County Commissioners, on December 28, 2000, adopted
Weld County Code Ordinance 2000-1, enacting a comprehensive Code for the County of Weld,
including the codification of all previously adopted ordinances of a general and permanent nature

ARTICLE I - General Provisions
Amend Sec. 24-1-40. Definitions.
For the purposes of Chapters 24 and 27, the following words and phrases shall have the
meanings stated in this Section:
Public water. A system for the provision to the public of water for human consumption through
pipes or other constructed conveyances if such system has at least fifteen (15) service
connections or regularly serves at least twenty-five (25) individuals. The term includes systems
that are owned or operated by private, nonprofit entities, as well as:
(a) Any collection, treatment, storage, and distribution facilities under control of the operator
of such system and used primarily in connection with such system; and
(b) Any collection or pretreatment storage facilities not under such control which are used
primarily in connection with such system.

ARTICLE III - Subdivision Design Standards
Amend Sec. 24-3-7Potable water supply standards.
A. — No change.
B. Public Water Supply Systems.
1. — No change.
2. Where a public water supply system is provided through a municipality, water district,
water company or association, the applicant must provide evidence of an adequate
water supply and ability to serve the land division. If a new public water supply system
is proposed, the applicant shall provide a certified letter from the State Engineer stating
that proper water rights have been acquired, or a proper nontributary source is available
for the future use, prior to approval of the land division. The public water supply system
shall be approved by the Colorado Department of Public Health and Environment Water
Quality Control Division. If the applicant cannot demonstrate approval of the public
water supply system by the Water Quality Control Division because the system does
not yet serve a minimum of twenty-five (25) persons or fifteen (15) taps, the applicant
may submit a full design of the system for review by the County. Such design shall meet
all requirements of the Division of Water Quality's New Public Water System Capacity
Planning Manual and the Design Criteria for Potable Water Systems, and shall be
stamped by a Colorado -licensed engineer. The applicant shall pay a reasonable fee
that covers the costs incurred by the County in reviewing of the public water supply
system design, which may include the costs of a contracted engineer.

directed to arrange for Municode to supplement the Weld County Code with the amendments
contained herein, to coincide with chapters, articles, divisions, sections, and subsections as they
currently exist within said Code; and to resolve any inconsistencies regarding capitalization,
grammar, and numbering or placement of chapters, articles, divisions, sections, and subsections
in said Code.
BE IT FURTHER ORDAINED by the Board, if any section, subsection, paragraph, sentence,
clause, or phrase of this Ordinance is for any reason held or decided to be unconstitutional, such
decision shall not affect the validity of the remaining portions hereof. The Board of County
Commissioners hereby declares that it would have enacted this Ordinance in each and every
section, subsection, paragraph, sentence, clause, and phrase thereof irrespective of the fact that
any one or more sections, subsections, paragraphs, sentences, clauses, or phrases might be
declared to be unconstitutional or invalid.

The Department of Planning Services staff recommends the following changes to the ordinance as
proposed at 1st reading:
1. 23-1-90 Change the definition for BUILDING COVERAGE: The percentage of a LOT covered by
BUILDINGS STRUCTURES, excluding fences.
Note the definition of BUILDING already includes structures and excludes fences. Any
STRUCTURE, excluding fences, erected for shelter or enclosure of persons, animals or personal
property of any kind.
2. Several sections Replace USR permit for accessory buildings exceeding 4% with a USR permit for
STRUCTURES exceeding maximum LOT COVERAGE in all R Zones.
Note there currently is not a USR option for exceeding the maximum lot coverage in the R Zones,
only a USR for accessory buildings exceeding 4%. This option would expand the opportunity to
exceed maximum lot coverage for all structures, not only accessory, through the USR process.
3. 23-3-70 Change the formula for figuring building coverage to be in acres instead of square feet.
Old formula: y= -0.152 In(x) + 1.7236, x is square footage of the lot, y is allowed building coverage
New formula: y = -0.149 In(x) + 0.1,x is the acreage of the lot, y is allowed building coverage (%)
4. Add to Section 23-3-440.F. Maximum BUILDING COVERAGE without an approved Use by

WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority
of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, on December 28, 2000, adopted
Weld County Code Ordinance 2000-1, enacting a comprehensive Code for the County of Weld,
including the codification of all previously adopted ordinances of a general and permanent nature
enacted on or before said date of adoption, and
WHEREAS, the Weld County Code is in need of revision and clarification with regard to
procedures, terms, and requirements therein.

WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority
of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, on December 28, 2000, adopted
Weld County Code Ordinance 2000-1, enacting a comprehensive Code for the County of Weld,
including the codification of all previously adopted ordinances of a general and permanent nature
enacted on or before said date of adoption, and

are, repealed and re-enacted, with amendments, and the various Chapters are revised to read as

ZONING
The following specific words and phrases, when appearing in this Chapter in uppercase

Tom Parko, Planning Services, presented Ordinance 2021-15 regarding proposed changes in the Weld
County Code, Angela Snyder, Planning Services, provided a brief description of the proposed changes in
building/lot coverage and allowing poultry in the R-5 Zone District in Chapter 23 Additionally, she provided
information on the proposed code changes regarding public water in Chapters 23 and 24.
The Chair asked if there was anyone in the audience who wished to speak for or against this application,
No one wished to speak
Commissioner Ford asked if there will be any problems with the 40% coverage on lots less than 6000
square feet or 10% coverage for larger lots. Ms. Snyder said that that staff looked at existing historic
townsites and other areas of the County and tried to come up with a number that would work for most lots.
She noted that there was one (1) lot in Carr that they found exceeded the limit; however, that property is
permitted under a USR (Use by Special Review)
Ms. Snyder noted that they have a change to the building coverage definition 'n Section 23-1-90 that is
currently proposed as "BUILDING COVERAGE The combined square footage of all STRUCTURES,
excluding fences d.vided by the total square footage of the LOT". She said that because ft can be confusing
and could be interpreted to mean the bottom of the structure would be counted instead of the actual
coverage and things, such as gazebos or other structures that do affect drainage might come into question
if they don't actually have a footprint. Therefore, Ms. Snyder recommends changing the proposed definition
to read l'BUIDING COVERAGE: The percentage of a LOT covered by STRUCTURES, excluding fences".
Commissioner Wailes referred to water storage tanks that are mushroom shaped and doesn't know if they
are on county property and asked how that works. Ms. Snyder said that most of those are located on
agricultural zoned property which they don't regulate coverage.
Commissioner Holland asked if this is referring to the area of impervious surface or the structure area. Ms
Snyder said in the agricultural subdivisions and townsites and in the estate zone, staff 's proposing to use
building coverage definition, which would mean the structures only. She added that other zones include
impervious surfaces.
Commissioner Edens asked what would be considered in the PIED ag zoned properties. Ms. Snyder said
that there are very few PUD ag properties. Mr. Parko said that usually the PUDs have ag uses but they will
typically be Estate, R-1 or Commercial. Mr. Snyder added that when designing the PUD, lot coverage can
be negotiated and incorporated into the stormwater management plan.
