James, Pro -Tern Commissioner Perry L. Buck Commissioner Mike Freeman Commissioner Lori Saine - EXCUSED Also present: Acting Clerk to the Board, Jan Warwick Assistant County Attorney, Bob Choate Planning Services Department representative, Michael Hall Health Department representative, Lauren Light The following business was transacted: ▪ I hereby certify that pursuant to a notice dated September 14, 2021, and duly published September 17, 2021, in the Greeley Tribune, a public hearing was conducted to consider the request of Robert Borum, for a Site Specific Development Plan and Use by Special Review Permit, USR21-0011, for a Home Business (machine shop) outside of subdivisions and historic townsites in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. • Chair Moreno reviewed the procedures to follow should this case result in a tie vote due to four (4) Commissioners being present and Commissioner Saine being excused. • Michael Hall, Department of Planning Services, presented a brief summary of the proposal and described on -site structures and expansion of one of the existing buildings. He relayed the business is allowed up to eight (8) employees, in addition to family members, and they currently employ two (2) full-time employees and one (1) contractor. Mr. Hall stated no heavy truck traffic is expected, as only employee passenger vehicles and routine delivery driver access will occur. He relayed one 12 square -foot sign, with business information, will be located on the north side of the existing access point, visible from County Road (CR) 6. Additionally, limited fluids will be stored, utilized and collected in the building, including coolants, oils and solvents, no fuel storage is proposed, scrap metal will be recycled, and a dumpster will be utilized to collect non -hazardous solid -waste, which will be emptied on a weekly basis. Mr. Hall shared notices were sent to six (6) surrounding property owners, no responses were received, 18 referrals were sent out, and 13 agencies responded. Mr. Hall provided a brief overview of the Department of Planning Services Engineering, stating the parcel has an existing, unpermitted access onto CR 17, which does not cc PLCMH/ -re), PW (nnK ) , £HC LL) tr.-a/IWO! 2021-2880 PL2801 HEARING CERTIFICATION - ROBERT BORUM (USR21-0011) PAGE 2 meet the minimum access spacing of 150 feet from the nearest access point; however, based on the configuration of the parcel, the location of the business and improvements on the parcel, the applicant will be able to obtain an Access Permit. He relayed CR 17 is a local, gravel road as designated on the Weld County Functional Classification Map, the latest average daily traffic on CR 17 counts 118 vehicles per day, with 15% trucks, and the 85th percentile speed is 47 MPH. He further stated traffic information submitted indicated approximately five (5) passenger vehicles and two (2) delivery trucks daily, round trips and up to two (2) semi -trucks and two (2) tandem trucks on a monthly round-trip basis. He stated the site will require tracking control of either double cattle guards and 100 feet of road base, or road base on all driving surfaces, and a Road Maintenance Agreement is requested, including, but not limited to, dust control and damage repair to specified travel routes. He relayed the applicant has submitted a Drainage Narrative that identifies an acceptable drainage exception. Mr. Hall stated the site is located within the City of Fort Lupton's Coordinated Planning Agreement boundary, who returned a Notice of Inquiry form dated February 18, 2020, expressing interest in discussing annexation; however, they had no concerns with development of the property, and the applicant does not wish to annex at this time. He relayed the subject property is located within the three-mile referral area of Adams County and the Cities of Dacono, Fort Lupton and Northglenn, and their referral responses dated July 8, and June 28, 2021, respectively, had no comments or concerns with the request. Mr. Hall described the surrounding uses and location of surrounding towns, indicated the closest neighboring residence is approximately 560 feet south of the building to be utilized as part of the machine shop, and the site is approximately ten (10) acres. He entered the favorable recommendation of the Planning Commission into the record as written and displayed images of the site and surrounding views. Lauren Light, Department of Public Health and Environment, relayed the existing residence is served by a domestic well and a septic system permitted for three (3) bedrooms. She stated an application was submitted to the state to reclassify the well to commercial, a Condition of Approval (COA) requiring a copy of the permit is included, and a septic system serving the shop also has a COA requiring a commercial permit for possible expansion of this permit, prior to recording. She reiterated trash will be collected on a weekly basis, metal will be recycled, oils will be collected twice a year, and the typical dust and waste standards are included. Ms. Light stated DS #11 - 20 address Environmental Health items. Bryan Borum, on behalf of Robert Borum, applicant, stated the business had been in operation since 2005, he described the history of the business, as a contract manufacturer of mainly aluminum, some stainless and plastic, steel parts, some fabrication with a welder out of south Denver, lathe turning and milling. In response to Chair Moreno, Mr. Borum confirmed all work is performed inside the building. Mr. Borum stated the loudest noise is generated by the air compressor, but it is also inside the building, which allows for control of the noise. No public testimony was offered concerning this matter. El The Board discussed Conditions of Approval. In response to Commissioner Freeman, Melissa King, Department of Planning Services Engineering, stated all commercial endeavors require a request for a Road Maintenance Agreement; however, Commissioner Freeman recommended deleting COA #1.E (Road Maintenance Agreement), due to the low traffic volume. In response to Commissioner James, Mr. Hall stated the applicant shall provide written 2021-2880 PL2801 HEARING CERTIFICATION - ROBERT BORUM (USR21-0011) PAGE 3 acknowledgment of his awareness of the Fort Lupton Fire Protection advisory comments. Mr. Hall recommended removal of COA #1.F.14 (CDOT access). The Board discussed Development Standards. In response to Chair Moreno, Mr. Borum stated there is no existing gate, and responding to Commissioner James, he confirmed landscaping for drainage is all that is proposed. In response to Chair Moreno, Mr. Borum confirmed there are currently a total of four (4) employees. In response to Commissioner Freeman, Mr. Hall explained the hours of operation were listed on the application, and after discussion, the Board agreed to delete DS #6 (Hours of Operation). In response to Chair Moreno, Ms. Light confirmed DS #16 (Noise Levels) are the same as in an A (Agricultural) Zone. Commissioner Freeman recommended deletion of DS #25 and #26 (Road Maintenance Agreement), Mr. Hall concurred. The Board agreed to all of the aforementioned changes. In response to Chair Moreno, Mr. Borum indicated he had reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as amended. El No public testimony was offered regarding changes made to the Conditions of Approval and Development Standards. El Commissioner Freeman moved to approve the request of Robert Borum for a Site Specific Development Plan and Use by Special Review Permit, USR21-0011, for a Home Business (machine shop) outside of subdivisions and historic townsites in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as amended. The motion was seconded by Commissioner James, and it carried unanimously. There being no further discussion, the hearing was completed at 10:32 a.m. This Certification was approved on the 3rd day of November, 2021.
