RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO WEDNESDAY, SEPTEMBER 15, 2021 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, September 15, 2021, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Steve Moreno, Chair Commissioner Scott K. James, Pro-Tem Commissioner Perry L. Buck Commissioner Mike Freeman Commissioner Lori Saine Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Houstan Aragon IR MINUTES: Commissioner Saine moved to approve the Minutes of the Board of County Commissioners meeting of September 1, 2021, as printed. Commissioner James seconded the motion, and it carried unanimously. El CERTIFICATION OF HEARINGS: Commissioner Saine moved to approve the Certification of Hearings conducted on September 1, 2021, as follows: 1) PCSC21-0009 - Smith Family Trust and 6 B's Property, LLC, and 2) 3MUSR21-95-1075 - R.M. Hiner Construction Company, Inc. Commissioner James seconded the motion, which carried unanimously. El PUBLIC INPUT: No public input was given. AMENDMENTS TO AGENDA: There were no amendments to the agenda. CONSENT AGENDA: Commissioner James moved to approve the Consent Agenda, as printed. Commissioner Freeman seconded the motion, and it carried unanimously. PRESENTATIONS: 1) CERTIFICATE OF RECOGNITION FOR CENTENNIAL CLUB OF WELD COUNTY - CHARLES SINDEN: Chair Moreno read the certificate for the record. Betty Robb, on Charles Sinden's behalf, thanked the Commissioners for their recognition. Each of the Commissioners, in turn, congratulated Mr. Sinden on his 100th birthday and shared their appreciation for his service as a veteran of World War II. (Clerk's note: the group gathered for a photo opportunity.) to/..o Minutes, Wednesday, September 15, 2021 Page 1 2021-2697 BC0016 IE 2) WELD COUNTY CONSTITUTION DAY CONTEST WINNERS ANNOUNCEMENT - ART/PHOTOGRAPHY, ESSAY, AND POETRY: Chair Moreno introduced the Constitution Day Contest. Tanya Van Beber, Colorado General Assembly Representative, explained she had the honor of reading the fifty-four (54) essays submitted that displayed the principles and values of being an American Citizen and touched her heart as the essays spoke volumes to the students' grasp of understanding of the foundation of the country and the freedoms of American citizens. Ms. Van Beber announced each of the essay contest winners and read several of their quotes. Dan Woog, Colorado General Assembly Representative, thanked the parents of the participating students for reinforcing the teachings of the Constitution to their children and introduced the winners of the art and photography contest. Commissioner Saine mentioned what an honor it was to read the five (5) poem submissions and shared a powerful excerpt from one of the winners. Chair Moreno stated the contest winners have been invited to attend the September 27, 2021, Board meeting. 3) RECOGNITION OF SERVICES, SHERIFF'S OFFICE — KENNETH LEACH: Chair Moreno read the certificate for the record. Steve Reams, Weld County Sheriff, shared experiences from the past twenty (20) years of working alongside Kenneth Leach and commended him for the years dedicated to the Sheriff's Office. Donnie Patch, Weld County Undersheriff, presented Mr. Leach with a plaque from his coworkers. Mr. Leach thanked the Sheriff's Office, his parents, and the U.S. Army Rangers for their support. The Commissioners, in turn, expressed their appreciation to Mr. Leach for his service to the citizens of Weld County and wished him all the best in his retirement. (Clerks Note: The group gathered for a photo opportunity.) le WARRANTS: 1) GENERAL WARRANTS - SEPTEMBER 14, 2021: Commissioner Buck moved to approve the General Warrants, as printed. Commissioner James seconded the motion, and it carried unanimously. Fi BIDS: 1) PRESENT BID #B2100118, SOUTHWEST WATER WELL CONTROL SYSTEM REPLACEMENT - FACILITIES DEPARTMENT: Rob Turf, Purchasing Department, stated three (3) bids were received and staff will review and make a recommendation for approval on September 29, 2021. 2) PRESENT BID #B2100119, GREELEY WATER WELL CONTROL SYSTEM REPLACEMENT - FACILITIES DEPARTMENT: Mr. Turf, stated three (3) bids were received and staff will review to make a recommendation for approval on September 29, 2021. CI NEW BUSINESS: 1) CONSIDER CONTRACT ID #5230 AGREEMENT FOR PROVISION OF ALTERNATIVE TRANSPORTATION SOLUTIONS AND AUTHORIZE CHAIR TO SIGN - ALC SCHOOLS, LLC: Jaime Ulrich, Director of the Department of Human Services, stated the department will utilize the service for transporting foster care youth to and from school. Commissioner Buck moved to approve said agreement and authorize the Chair to sign. The motion, which was seconded by Commissioner James, carried unanimously. El 2) CONSIDER CONTRACT ID #5241 CHILD PROTECTION AGREEMENT FOR SERVICES AND AUTHORIZE CHAIR TO SIGN - BRAD'S HOUSE, LLC: Ms. Ulrich stated the agreement provides mental health services to youth in out -of -home placement. Commissioner Freeman moved to approve said agreement and authorize the Chair to sign. Seconded by Commissioner Buck, the motion carried unanimously. Minutes, Wednesday, September 15, 2021 Page 2 2021-2697 BC0016 3) CONSIDER CONTRACT ID #5242 APPLICATION FOR FAMILY FIRST TRANSITION ACT FUNDING AND AUTHORIZE CHAIR TO SIGN: Ms. Ulrich explained the application seeks funding for the Child Welfare Division to create and implement a therapeutic foster care program through training, respite services, and support for the highly skilled foster homes. The motion to approve said application and authorize the Chair to sign was made by Commissioner Buck, seconded by Commissioner Saine, and it carried unanimously. PLANNING: 1) CONSIDER CONTRACT ID #5219 ACCEPT WARRANTY COLLATERAL FOR USE BY SPECIAL REVIEW PERMIT, USR19-0071 - DPG FARMS, LLC, AND CALVIN GOZA, C/O J-2 CONTRACTING COMPANY: Jazmyn Trujillo -Martinez, Department of Planning Services, requested the reduction of project collateral in the amount of $1,590,308.68 to serve as warranty collateral in the amount of $238,546.30 procured in the form of a bond rider issued by North American Specialty Insurance. She expanded the applicant has completed the required improvements and the staff of the Departments of Public Works and Planning Services have completed site inspections and deemed the improvements acceptable. Commissioner James moved to approve the acceptance of said warranty collateral for USR19-0071. The motion was seconded by Commissioner Saine and it carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
