RESOLUTION
WHEREAS, a hearing was held on December 18, 1972, in the chambers
of the Board of County Commissioners, Weld County, Colorado, for the
purpose of hearing the petition of Rick Dill, Box 488, Ault, Colorado 80610
requesting permission to locate a dairy operation on the following described
property, to-wit:
A parcel of land more particularly described as being the
South 320 feet of the Southwest Quarter of the Southwest
Quarter (SW4SW4) of Section Thirty (30), Township Eight
(8) North, Range Sixty-five (65) West of the Sixth Principal
Meridian, Weld County, Colorado, containing 10 acres,
more or less, and
WHEREAS, the petitioner was present, and
WHEREAS, there was no opposition to the request of petitioner to
locate said dairy operation on the above described premises, and
WHEREAS, the said requested dairy operation is located in an
Agricultural Zone as set forth by the Weld County Zoning Resolution,
and
WHEREAS, according to Section 3. 3(3)(c) of the Zoning Resolution
of Weld County, said dairy operation or any expansion thereof may be
authorized upon the approval of the Board of County Commissioners of
Weld County, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present; has studied the request of the
petitioner and studied the recommendations of the Weld County Planning
Commission, and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, that the application of Rich Dill, Box 488; Ault,
Colorado 80610, to locate a dairy farm operation on the premises
indicated above be, and it hereby is granted under the conditions following:
1. That any water and sanitation facilities to be installed shall
be approved by the State Health Department.
2. That petitioner shall-proceed with due diligence to construct
said dairy operation and shall have up to one year from date hereof to begin
construction of same; otherwise, the Board may, for good cause shown, on
its own motion, revoke the permit herein granted.
3. That when said dairy operation facility is completed, same shall
be limited in pen size to 37, 000 sq. ft. , all as shown on plan as submitted.
4. That all applicable subdivision and zoning regulations shall be
followed and complied with in accordance with the Zoning Resolutions of
Weld County, Colorado.

December 19 , 1972 at 4 : 00 P . M. in the office of the County Commissioners ,
Court House .

DISCUSSION : Mr . Lorenson recommended the application be approved as it
agrees with the Planning Commission Land Use Policy , it is com-
patible with surrounding land use and zoning , it is recommended for
approval by the Health Department, it is considered good design by
the Extension office . No pollution hazard is noted . Water is avail -
able from Central Weld Water District. If approved it should be sub-
ject to construction limited to the pen size of 40 ,000 sq . ft. and
facilities shown on Exhibit A and construction to begin within one
year of approval by the Board of County Commissioners .

DISCUSSION: Mr. Lorenson recommended the plat be approved as it follows
the approved preliminaty plan . It should be subject to the County

Commissioners acceptance of land dedication and subdivision im-
provement agreement and bond . A statement on the plat showing no
access to County Road 53 from Lots 1 and 2 , Block 2 and several
minor corrections on the plat. Mr. Lorenson stated Dr . Hoff is
proposing the dedication of lot 10 , Block 1 in order to fulful the
park requirements of the Subdivision Regulations , approximately
1 . 1 acres . In the improvement agreement there will be two more
hydrants installed , street signs and street monuments . There is an
existing bond. from 1968 . The County Attorney will have to determine
if this bond is valid to cover this filing . The cul -de-sac to be
constructed is in the property owned by Housing Unlimited . An
agreement between them and Dr. Hoff will have to be resolved before
submitting the resolution to the County Commissioners .
RESOLUTION :
Be it therefore resolved to recommend approval to the Board
of County Commissioners subject to an agreement regarding the bond-
ing for the improvements . Motion by Mr. Nix and second by Mr. Watson .

DISCUSSION : Mr. Lorenson stated the planning staff recommended denial .
Continued expansion in residential area will increase conflict with
adjacent residents . The Colorado Division of Water Resources gives
the opinion that "the well permit issued to Mr. Collins would not
allow him to use the water from that well for an 80 dog kennel " .
Mr. Lorenson read the letter from the Colorado Division of Water Re-
sources . Mr•. .Wright stated he was unaware of this letter or that
there was a problem regarding water. Mr. Collins indicated water
is available from a water line which is just a short distance to the
south of them. Mr. Wright presented plans showing the existing
and proposed facilities . Mr. Collins will devote full time to the
kennel if the application is approved . There is a kennel on the
adjoining property. Mr. Lorenson suggested if it is recommended for
approval , it should be subject to a contract for the water .

of County Commissioners subject to the recommendations . Motion by

APPEARANCE : Walker Miller '
DISCUSSION : Mr. Miller presented the application , stating the property
is being leased . The facility is to extract the impurities from the
gas and the liquids . Mr . Lorenson stated the planning staff recommends
approval as it is consistant with the' Land Use Policy, it is compatible
with surrounding land use and zoning . The site is poor agriculture use .
There is conditional approval by the Health Dept. If approved it should

be subject to a permit from the Colorado Air Polllution Control
Commission , a planted screen on the north , east and west side
of the site . Construction should be limited to the items shown
on Exhibit C , C-1 , C-2 , C-3., and C-4. Construction to begin with-
in one year of approval by the Board of County Commissioners .

SUBJECT: Sewage Treatment plant for Spacious Living
LOCATION : Sec 31 T1 R65
APPEARANCE : Gordon Mc►.ain
DISCUSSION : Mr. Glen Paul asked to have this application on the agenda
as a discussion item. Mr. Paul stated they have had a lot of trouble
with the septic tanks in the area . Mr. McLain has bought the dev-
elopment and is willing to put in all the sewage facilities and re-
commended this be done. The system will have to be approved by the
Weld County Health Department and the State Health Department.
Mr. McLain stated he will be responsible for the maintenance of the
plant. There are approximately 270 dwelling units . Mr. Lorenson
stated on the Lochbuie Development submitted and the design criteria
is to provide not only sewer service to the existing units , but the
proposal is for another 1500 dwelling units or a population of
5250 or a grand total of 6125 . The design is approximately 700%
over the existing requirements . If approval is given for this size
facility , it should be considered in no way an implication that
a new development or new town would be approved . Mr. Mclain said
any future development that would be proposed would be on the order
of Dacono , the sale of lots and modular units or an incorporated
town . No action was taken .
SUBJECT : Section 9 of the Subdivision Regulations
DISCUSSION; Mr . Lorenson stated the State Land Use Commission requested
the term "minor subdivision" be changed to "recorded exemptions " .
Section 9 will have to be amended to change the wording. The
procedure will remain the same. The changes need' to be reviewed
and action taken at the next regular meeting .
SUBJECT : Property owned by Jerry Bigbee •
DISCUSSION : The property in question was recommended for denial by the
Planning Commission for a Mobile Home Subdivision . Mr. Bigbee would
like some suggestions from the Planning Commission on what would be
allowed to utilize the property. Mr. Bigbee has suggested a wide
variety of agricultural uses and is willing to put it into a Planned
Unit Development . form,. for five acre parcels . The question of where
the water would come from was brought up.
ANNOUNCEMENT : The first meeting in January will be Monday , January 8th
instead of January 2nd .

Mr. Anderson called the meeting to order.
SUBJECT: Comprehensive Plan for Weld County.
DISCUSSION : Jim Ohi went into detail .of the proposed Plan regarding
what the Plan actually is and the intention of the Plan . It
is a guide for future development in the County. It makes a broad
evaluation of the County' s assets and the forces of growth and
change that may irreparably alter these assets . The Plan presents
the likely results of. these forces if they are not guided and ac-
commodated in a logical and coherent way. The Plan then discusses
the choices that are available to the County as it enters an era
of unprecedented growth and development. As a result of this
'analysis of assets , the forces of change that are acting upon these
assets , and the alternatives open to the County ( including that of
allowing what may happen to happen) , the Plan proposes a direction
of growth and development that the Planning Commission staff feel
will protect the assets that make Weld County a desirable place to
live and , at the same time , accomodate and direct urban growth in a
way that will lead to coherent communities . After further dis-
cussion of the proposed Plan , the meeting adjourned .

DISCUSSION' Mr . Lorenson stated he recommended the application be
approved . The operation is now in existance . It is not con-
sidered a hazard to the surrounding land use . It has had no
action on it in the past which would legally recognize it as a
special use permit so this action would allow that and grant the
use without any questions of it' s being a non-conforming use .
It should be subject to all requirements of the American Trap
Association and the National Skeet Shooting Association . Mr.
Wall stated he is president of the club and it has been in exist-
ance for 50 years . They have had no accidents of any type. The
nearest residence is a mile and a half.
RESOLUTION :
Be it therefore resolved to recommend approval to the
Board of County Commissioners subject to the staff recommendations .

It should be subject to a statement on the plat that there will
be no access onto 16th. St . These lots have not been developed .
Three lots are being replatted into 2 lots .

DISCUSSION : Mr. Lorenson stated he initiated this action through the
planning staff. The area was originally platted as Fairways
Living Ranchettes for large residential lots and recorded in 1963 .
In 1967 MH zoning was applied for and recommended for approval to
the County Commissions as temporary for 6 months . However , when
the Resolution was written it didn ' t state temporary 6 months
zoning unless development occurred . Mr. Kanemoto has purchased
the property and wishes to develop the subdivision as platted
for conventional homes . Some of the streets and utilities have
been installed . MH zoning would allow approximately 300 units
where services are not available . Mr. Olsen stated he represents
the surrounding property owners and they are very much in favor
of this action . Mr. Paul stated he would like to have 7 perco-
lation tests made. Mr . Lorenson stated it should be subject to

a utility plat and approval of the Utility Board .

of County Commissioners subject to the requirements of the Health

DISCUSSION: Mr . Lorenson stated he would like to call their attention
to the previous zone requests on this property, three being denied ,
one approved and one in process recommended for denial . He rec-
ommended this application be denied as it is not consistent with
land use policy , the contract for sale of land may not be legal
under the subdivision regulations . The entire area needs develop-
ment plan which piece-meal zoning will not accomplish . A service
type operation requires large septic system which may endanger
well water sources . The area continues to develop in a substandard
manner with respect to water and sewer and planning in general .
The occupants of surrounding existing sites have not kept promises
made before the Planning Commission or have violated the regula-
tions . Mr. Adams , zoning inspector reviewed the actions of the
Board of Adjustment with respect to the mobile homes and violations
in the area . Mr. Deisch presented the application and stated
the area would be used to operate a service station for the
applicant ' s vehicles . The applicant is a trucker who hauls frozen
foods essentially from Idaho . Trucks would be refueled at this
station . They would average 3 to 5 trucks per day.. They would
also make minor repairs . Their plans are to refurbish the exist-
ing scale house and to erect a larger building contiguous to it .
There would be no storage of trucks on the property, no retail
wholesale distribution . There was discussion regarding the
mining carried on in the area previously. It was determined that
Mr. Althen and Mr. Boyer , owners of the property , are in violation
of the subdivision regulations under the previous law because 5
parcels have been sold .
MOTION : By Mr. Watson to table the application indefinitely until
certain legal problems are resolved . Second by Mr. Clark. A vote
of "Aye" by Anderson , Clark , Elliott, Nix, Rothe , Watson and
Weigand . Motion carried .

DISCUSSION : Mr. Lorenson stated Mr . Wade has requested a change of
zone to repair mobile homes on approximately 10 acres . Mr. Wade
applied for a building permit for a shed but refused to pay the
fee because it is an agricultural zone . It was determined if
agricultural land is not used for that purpose, a building permit
fee is required .

DISCUSSION : Mr. Bernard explained the sequence of events in the area ,
on property sold by Harvey Weber, regarding building permits issued .
Mr. Kollar applied fora second building permit on a second parcel
he has purchased in the area . The building permit was refused
because of no frontage on a dedicated ROW. Other building permits
had been issued with a 30' recorded easement to their parcels :
Miss Telep discussed the definition of. "access " . Mr. Lorenson
requested a written legal opinion regarding this . Miss Telep
suggested this problem of subdividing by Mr. Weber be taken up
with the Colorado Real Estate Commission .
MOTION : By Mr. Weigand to take the matter under advisement. Second
by Mr. Nix. A vote of "Aye" by Anderson , Clark , Elliott , Nix ,
Rothe, Watson and Weigand . Motion carried .

DISCUSSION : Mr . Carter presented an airport map stating this had
been presented to the Planning Commission in April . The Air-
port Board is requesting an amendment to the Zoning Resolution
to create an Airport Zone District . This is necessary before
they can request FAA participation . Mr. Lorenson stated the
only problem is the definition of the term "structure" which
needs- to be clarified . Mr. Carlisle stated this zoning is nec-
essary to obtain federal funds for land acquisition .
RESOLUTION :
Be it therefore resolved to recommend to the Board of
County Commissioners to amend the Zoning Resolution to create
an Airport Zone and incorporate the regulation in the Revised
Zoning Resolution when it is completed . Motion by Mr . Nix,
second by Mr. Weigand . A vote of "Aye" by Clark , Elliott, Nix,
Rothe , Watson and Weigand. Motion carried .

SUBJECT : Regulations on Land Dedication
DISCUSSION: Mr. Lorenson presented a chart showing how land
dedication is determined where subdividing occurs . The
zoning , the size of the lots and the population projected
for the area will determine the amount. The County Com-
missioners would have the option of accepting the land or
8 fee equal to the amount of property. In a rural area the
fee could be applied to a regional park or flood plain , etc .
SUBJECT : Planning contract with Windsor for Planning Services
DISCUSSION : Mr. Lorenson read a letter from Jim Ohi to the Town
of Windsor regarding extending the contract for planning ser-
vices for a year on the same basis of $200.00 they have been
paying for the last 6 months .
RESOLUTION :
Be it therefore resolved to recommend to the Board of
County Commissioners to renew to planning services with Windsor
for another year at $200 .00 per month . Motion by Mr. Nix, second
by Mr . Weigand . A vote of "Aye" by Clark, Elliott , Nix , Rothe ,
Watson and Weigand : Motion carried .

DISCUSSION : After further discussion , it was the consensus of
opinion that the entire 80 acres should be platted as a unit-
development industrial park with limitations on the type of
development that would occur according to the water and sewer
services available . This should be done by the owners of the
property.

Be it therefore resolved to recommend denial to the Board
of County Commissioners on the recommendation of the planning
staff. Motion by Mr. Clark , second by Mr. Nix. A vote of "Aye"
by Clark , Elliott , Nix , Rothe , Watson and Weigand . Motion carried .

DISCUSSION : There was further discussion regarding issuing a building
permits on a 30 ' recorded easement. Miss Telep was instructed to
render a written legal opinion on the term "access" .

other permits had been written in this area on the same basis .
Second by Mr. Weigand . A vote of "Aye" by Clark , Elliott , Nix,

In reply to your request the following is the soil evaluation for the
SW3 SW'k Sec. 30, TBN, R65W, Weld County, Colorado. Evaluation is to
determine the suitability of the soil for installation of a toilet in
a dairy barn using a septic tank filter field for on site sewage, _ •
disposal.
The area .ia trapped (see attached sketch) as 17-A, Nunn clay loam,. ..
0-1% slope; 668-AB, Renohill loam and clay loam, 0-3% slope; and 87B-B,
Shingle soils, 1-3% slope. The Nunn soils are deep, moderately well
drained, moderately fine to fine textured soils with moderately slow
permeability. The Renohill and Shingle soils are moderately fine tem-.
tured soils overlying interbedded shale and sandstone, 20 to 40 inch
. for Renohill and 10 to 20 inches for Shingle. Renohill and Shingle
soils have severe limitations for septic tank filter fielder—tie-N
soils have moderate to severe limitations. The area is not subject
to flooding. ,
The soil survey is made on the basis of 40 inch borings, although in
most cases the borings are made to depths_ of 50 to 60 inches. The soil
' amp should be used for general planning and does not exclude the. need
for on-site investigation for specific engineering purposes.
