RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT,
USR20-0036, FOR A 199 -FOOT TALL TELECOMMUNICATION ANTENNA TOWER
AND ASSOCIATED GROUND EQUIPMENT IN THE A (AGRICULTURAL) ZONE
DISTRICT - CACTUS HILL RANCH COMPANY, C/O MATT SCHILZ, PUBLIC RADIO
FOR THE FRONT RANGE / KRFCFM
A public hearing was conducted on March 3, 2021, at 10:00 a.m., with the following present:

The following business was transacted:
e I hereby certify that pursuant to a notice dated January 22, 2021, and duly published
January 24, 2021, in the Greeley Tribune, a public hearing was conducted to consider the request
of Cactus Hill Ranch Company, c/o Matt Schilz, Public Radio for the Front Range / KRFCFM for
a Site Specific Development Plan and Use by Special Review Permit, USR20-0036, for a 199 -foot
tall Telecommunication Antenna Tower and associated ground equipment in the A (Agricultural)
Zone District. Bob Choate, Assistant County Attorney, made this a matter of record.
e Maxwell Nader, Department of Planning Services, presented a brief summary of the proposal,
stated the site will house the tower, a shelter for transmitters, receivers and other equipment, and
will be surrounded by a six (6) -foot, security fence. He relayed, after researching it, the applicant
found co -location was not possible at the current tower location and indicated the new tower will
allow for co -location in the future. He stated the site will have no more than ten (10) people on it
during construction and no more than three (3) people, after construction, to provide maintenance.
He indicated Planning staff received no correspondence regarding the application, stated the site
is within the Coordinated Planning Agreement (CPA) of the Towns of Windsor, Severance and
Timnath, and described surrounding zoning and uses. Mr. Nader entered the favorable
recommendation of the Planning Commission into the record as written and displayed images of
the site and surrounding views. In response to Chair Moreno, Mr. Nader confirmed the new tower
will be 199 feet tall.

Zackery Roberson, Department of Public Works (PW), stated access for the site is roughly
0.45 miles east of State Highway 257, it does meet County Code and an Access Permit has been
issued. He mentioned PW is requesting a Road Maintenance Agreement for construction only
and presented the drainage and grading requirements.
e Lauren Light, Department of Public Health and Environment (EH), stated portable toilets are
acceptable during construction and Development Standards (DS) #9-14 address EH items.
e Matt Schilz, Public Radio for the Front Range/ KRFCFM, represented the applicant and stated
the new tower is needed due to overgrown cottonwood trees at the current antenna's location.
The USR would allow the applicant to move the tower to open space, increase the height and
transmit power to the antenna, in turn, providing information to a larger service area.
IR No public testimony was offered concerning this matter.
e In response to Commissioner Freeman, Mr. Nader confirmed there is no need to add a
Condition of Approval (COA) for the Decommissioning Plan, as the existing Development
Standard (DS) #6 is sufficient. Responding to Commissioner Buck, Mr. Schilz stated the radio
station plays music and provides information on community events and issues. There were no
changes made to the Resolution by the Board.
IR Commissioner Freeman moved to approve the request of Cactus Hill Ranch Company,
c/o Matt Schilz, Public Radio for the Front Range / KRFCFM, for a Site Specific Development
Plan and Use by Special Review Permit, USR20-0036, for a 199 -foot tall Telecommunication
Antenna Tower and associated ground equipment in the A (Agricultural) Zone District, based on
the recommendations of Planning staff and the Planning Commission, with the Conditions of
Approval and Development Standards, as written, and the motion was seconded by
Commissioner James. In response to Chair Moreno, Mr. Schilz indicated, on behalf of the
applicant, he had, reviewed, and agreed to abide by, the Conditions of Approval and Development
Standards, as written. The motion carried unanimously, and there being no further discussion,
the hearing was completed at 10:16 a.m.
