HomeMy WebLinkAbout20212841.tiffHEARING CERTIFICATION DOCKET NO. 2021-51 RE: AMENDED PLANNED UNIT DEVELOPMENT CHANGE OF ZONE, PUDZ21-0002, OF NORTH COUNTRY PUD (PUDZ14-0001), TO ALLOW ONE (1) SECOND SINGLE-FAMILY DWELLING UNIT PER LOT IN THE PLANNED UNIT DEVELOPMENT - ERIK AND TAMMY ANGLUND, AND JOHNNY AND NANCY FRITS A public hearing was conducted on October 13, 2021, at 10:00 a.m., with the following present: Commissioner Steve Moreno, Chair Commissioner Scott K. James, Pro-Tem Commissioner Perry L. Buck Commissioner Mike Freeman Commissioner Lori Saine Also present: Acting Clerk to the Board, Jan Warwick Assistant County Attorney, Bob Choate Planning Services Department representative, Maxwell Nader Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated August 17, 2021, and duly published August 20, 2021, in the Greeley Tribune, a public hearing was conducted to consider the request of Erik and Tammy Anglund, and Johnny and Nancy Frits, to amend Planned Unit Development Change of Zone, PUDZ21-0002, of North Country PUD (PUDZ14-0001), to allow one (1) Second Single -Family Dwelling Unit per lot in the Planned Unit Development. Bob Choate, Assistant County Attorney, made this a matter of record. IR Maxwell Nader, Department of Planning Services, presented a brief summary of the proposal and explained Second Single -Family Dwellings are not permitted in the E (Estate) Zone District, including PUDs with E (Estate) Zone District uses, unless expressly called out and approved by the Board of County Commissioners; however, an amended Final Plan will be required after the PUDZ is approved and recorded. He relayed nine (9) referrals were sent out, seven (7) agencies responded without concerns or included conditions that have been addressed in the Conditions of Approval (COA), and two (2) referral agencies did not respond. He stated both Lots A and B have existing permitted accesses onto County Road (CR) 1, which is a paved arterial road, per the Weld County Functional Classification map, the latest average daily traffic counts 3,016 vehicles per day, with 15% trucks, and the 85th percentile speed is 60 MPH. He relayed an acceptable Traffic Narrative has been received allowing for removal of Condition of Approval (COA) #1.A (Traffic Impact Analysis) and an acceptable Drainage Narrative has been received; therefore, COA #1.6 (Drainage Narrative) may also be removed. Mr. Nader stated the site is located within the three (3) mile radius of the Town of Mead, who expressed no concerns. Mr. Nader relayed the applicant requested the PUD Final Plan be processed administratively, stating Planning Staff would support the request. —�-' Lauren Light, Department of Public Health and Environment, explained the second homes shall be served by the Long's Peak Water District, stating they can share the existing tap(s), unless subdivided in the future. Additionally, they shall have individual septic systems, only being allowed to share with the main house(s) if originally designed that way, which will be addressed when building permits are applied for. She stated the Department of Public Health and Environment suggested several notes for the plat that relate to water and septic, and staff has no other items for this request. Erik Anglund, applicant, stated his appreciation in working with staff. • No public testimony was offered concerning this matter. ---1 The Board reviewed and discussed the COA, and agreed to all Conditions as presented. In response to Chair Moreno, Mr. Anglund indicated he had reviewed, and agreed to abide by, the Conditions of Approval as presented. • Mr. Choate reminded the Board, if approved, to include the administrative approval of the Final Plan in their motion. • Commissioner Buck moved to approve the request of Erik and Tammy Anglund, and Johnny and Nancy Frits, to amend Planned Unit Development Change of Zone, PUDZ21-0002, of North Country PUD (PUDZ14-0001), to allow one (1) Second Single -Family Dwelling Unit per lot in the Planned Unit Development, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval, as presented, allowing for administrative approval of the Final Plan. The motion was seconded by Commissioner Saine, and it carried unanimously.
