USR21-0014, FOR ONE (1) SECOND SINGLE-FAMILY DWELLING PER LEGAL LOT IN
THE A (AGRICULTURAL) ZONE DISTRICT - VICTORIA AND SHAWN MCCUNE
A public hearing was conducted on November 17, 2021, at 10:00 a.m., with the following present:

The following business was transacted:
Ei I hereby certify that pursuant to a notice dated October 13, 2021, and duly published
October 15, 2021, in the Greeley Tribune, a public hearing was conducted to consider the request
of Victoria and Shawn McCune, for a Site Specific Development Plan and Use by Special Review
Permit, USR21-0014, for one (1) Second Single -Family Dwelling per legal lot in the
A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of
record.
Chris Gathman, Department of Planning Services, presented a brief summary of the proposal
on a 2.5 -acre lot in Nelson Subdivision, off of Appaloosa Avenue and County Road (CR) 37. He
stated 13 referrals were sent out, and six (6) were received back, with two (2) providing comments.
Mr. Gathman explained the applicant is requesting a mother-in-law residence, and has applied
for a second well, which has been issued under Permit No. 85459-F, and there is a septic system
onsite. Mr. Gathman shared the property is in an area which can support the development, within
an existing residential subdivision and within the three (3) mile referral areas of the Cities of
Brighton and Fort Lupton, although neither returned a referral response. He stated the site is also
located within the Fort Lupton and Weld County Intergovernmental Agreement (IGA) boundary,
and the City of Fort Lupton responded on July 14, 2021, stating they are not interested in pursuing
annexation. He shared the second home proposed is a modular home, and the parcel has an
unpermitted existing horseshoe access driveway onto Appaloosa Avenue, which is a gravel road
as designated on the Weld County Functional Classification map. He further stated the applicant
has proposed to gate and fence one (1) of the existing accesses, create a separate access for
the second dwelling, and obtain access permits which will meet minimum criteria. Mr. Gathman
relayed the traffic information submitted indicates residential traffic only, which is approximately
nine (9) vehicle round trips per dwelling. He stated an acceptable drainage narrative has been

submitted, which lists drainage detention exception number three (3), which is a second dwelling
permit in the A (Agricultural) Zone District. Mr. Gathman explained he reviewed the application
regarding pending Code changes for lot coverage requirements and this site will be just under the
ten percent (10%) overall lot coverage based on information found. Mr. Gathman entered the
favorable recommendation of the Planning Commission into the record as written and displayed
images of the site and surrounding views.
Lauren Light, Department of Public Health and Environment (EH), reviewed the water and
sewer provisions, stating only two (2) Development Standards are included in the Resolution that
address water and sewer and EH has no outstanding issues.
Victoria and Shawn McCune, applicants, relayed Mr. Gathman's statements regarding the
mother-in-law home sum up their desire to add to their property.
El No public testimony was offered concerning this matter.
3__= In response to Chair Moreno, Mr. and Mrs. McCune indicated they have reviewed, and agreed
to abide by, the Conditions of Approval and Development Standards, as drafted.

ft Commissioner Saine moved to approve the request of Victoria and Shawn McCune for a Site
Specific Development Plan and Use by Special Review Permit, USR21-0014, for one (1) Second
Single -Family Dwelling per legal lot in the A (Agricultural) Zone District, based on the
recommendations of Planning staff and the Planning Commission, with the Conditions of Approval
and Development Standards, as presented. The motion was seconded by Commissioner James,
and it carried unanimously. There being no further discussion, the hearing was completed at
11:13 a.m.
